2.9 If the hired vehicle develops any defect during the journey, the
contractor shall be liable to arrange the substitute vehicle of
similar/matching specification to the user within minimum time
depending on the distance.
3. Documents and statutory Responsibility:
3.1 The vehicles asked for tender should be fit in all respects for use in
accordance with Motor Vehicle Act and Rules and existing laws as
applicable from time to time. The vehicle(s) must be equipped with
valid documents i.e Registration Book, Insurance Certificate,
Fitness Certificate, pollution Certificate Permit and with all taxes,
fees, levies paid up to date during the currency of the contract.
The responsibility of any lapse in this regard shall be that of the
contractor exclusively and GAIL stands completely indemnified by
the contractor against such defaults.
3.2 Drivers provided with the vehicle(s) must be physically/medically
fit, professionally sound and legally competent in all respects
holding valid license as described under prevailing Motor Vehicle
Act and Rules/other applicable Acts and Rules on the subject.
3.3 The contractor will be solely responsible for any consequences and
Claim under the law arising out of any accident caused by the
hired vehicle to the equipment/property/personnel of GAIL. He
shall also be responsible for any claim/compensation that arises
due to damages/injuries/property etc. caused by the hired
vehicle.
The contractor’s staff shall abide by the existing security and
safety rules/regulations/precautions as per instructions given
from time to time. The contractor and his employees may also be
required to pledge secrecy and non-divulgence of the nature of the
work of GAIL that may be prejudicial to the interest of GAIL.
3.4 If the driver(s) engaged/deputed with the hired vehicle(s) by the
contractor for carrying GAIL’s officers/staff person(s) is found to be
undisciplined, misbehaving with GAIL’s officers/staff or under the
influence of any intoxicant, Gail may ask the contractor to replace
such driver(s) otherwise the hired vehicle may not be accepted for
