concerning the extent <strong>of</strong> targets set out in the weekly and monthly programmes and the degree <strong>of</strong> achievements the decision<br />

<strong>of</strong> the ENGINEER-IN-CHARGE will be final and binding on the CONTRACTOR.<br />

11 Tenderer’s Responsibility<br />

11.1 The intending tenderers shall be deemed to have visited the SITE and familiarised submitting the tender. Non-familiarity with<br />

the site conditions will not be considered a reason either <strong>for</strong> extra claims or <strong>for</strong> not carrying out the works in strict con<strong>for</strong>mity<br />

with the DRAWINGS and SPECIFICATIONS or <strong>for</strong> any delay in per<strong>for</strong>mance.<br />

12 Retired Government or Company Officers<br />

12.1 No Engineer <strong>of</strong> Gazetted rank or other Gazetted Officer employed in Engineering or Administrative duties in an Engineering<br />

Department <strong>of</strong> the States/ Central Government or <strong>of</strong> the EMPLOYER is allowed to work as a CONTRACTOR <strong>for</strong> a period <strong>of</strong> two<br />

years after his retirement from Government Service, or from the employment <strong>of</strong> the EMPLOYER without the previous<br />

permission <strong>of</strong> the EMPLOYER. The CONTRACT, if awarded, is liable to be cancelled if either the CONTRACTOR or any <strong>of</strong> his<br />

employees is found at any time to be such a person, who has not obtained the permission <strong>of</strong> the State/Central Government or<br />

<strong>of</strong> the EMPLOYER as a<strong>for</strong>esaid be<strong>for</strong>e submission <strong>of</strong> tender, or engagement in the CONTRACTOR'S service as the case may be.<br />

13 Signing <strong>of</strong> the <strong>Contract</strong>:<br />

13.1 The successful tenderer shall be required to execute an AGREEMENT in the pro<strong>for</strong>ma attached with TENDER DOCUMENT<br />

within 15 days <strong>of</strong> the receipt by him <strong>of</strong> the Notification <strong>of</strong> Acceptance <strong>of</strong> Tender. In the event <strong>of</strong> failure on the part <strong>of</strong> the<br />

successful tenderer to sign the AGREEMENT within the above stipulated period, the Earnest Money or his initial deposit will be<br />

<strong>for</strong>efeited and the acceptance <strong>of</strong> the tender shall be considered as cancelled.<br />

14 Field Management & Controlling/Coordinating Authority:<br />

14.1 The field management will be the responsibility <strong>of</strong> the ENGINEER-IN-CHARGE, who will be nominated by the EMPLOYER. The<br />

ENGINEER-IN-CHARGE may also authorize his representatives to assist in per<strong>for</strong>ming his duties and functions.<br />

14.2 The ENGINEER-IN-CHARGE shall coordinate the works <strong>of</strong> various agencies engaged at site to ensure minimum disruption <strong>of</strong><br />

work carried out by <strong>different</strong> agencies. It shall be the responsibility <strong>of</strong> the CONTRACTOR to plan and execute the work strictly<br />

in accordance with site instructions to avoid hindrance to the work being executed by other agencies.<br />

15 Note to Schedule <strong>of</strong> Rates:<br />

15.1 The Schedule <strong>of</strong> Rates should be read in conjunction with all the other sections <strong>of</strong> the tender.<br />

15.2 The tenderer shall be deemed to have studied the DRAWINGS, SPECIFICATIONS and details <strong>of</strong> work to be done within TIME<br />

SCHEDULE and to have aquainted himself <strong>of</strong> the condition prevailing at site.<br />

15.3 Rates must be filled in the Schedule <strong>of</strong> Rates <strong>of</strong> original Tender Documents. If quoted in separate typed sheets no variation in<br />

item description or specification shall be accepted. Any exceptions taken by the tenderer to the Schedule <strong>of</strong> Rates shall be<br />

brought out in the terms and conditions <strong>of</strong> the <strong>of</strong>fer.<br />

15.4 The quantities shown against the various items are only approximate. Any increase or decrease in the quantities shall not<br />

<strong>for</strong>m the <strong>basis</strong> <strong>of</strong> alteration <strong>of</strong> the rates quoted and accepted.<br />

15.5 The EMPLOYER reserves the right to interpolate the rates <strong>for</strong> such items <strong>of</strong> work falling between similar items <strong>of</strong> lower and<br />

higher magnitude.<br />

16 Policy <strong>for</strong> Tenders Under Consideration:<br />

16.1 Only Those Tenders which are complete in all respects and are strictly in accordance with the Terms and Conditions and<br />

Technical Specifications <strong>of</strong> Tender Document, shall be considered <strong>for</strong> evaluation. Such Tenders shall be deemed to be under<br />

consideration immediately after opening <strong>of</strong> Tender and until such time an <strong>of</strong>ficial intimation <strong>of</strong> acceptance /rejection <strong>of</strong> Tender<br />

is made by <strong>GAIL</strong> to the Bidder.<br />

16.2 Zero Deviation: Bidders to note that this is a ZERO DEVIATION TENDER. <strong>GAIL</strong> will appreciate submission <strong>of</strong> <strong>of</strong>fer based on<br />

the terms and conditions in the enclosed General Conditions <strong>of</strong> <strong>Contract</strong> (GCC), Special Conditions <strong>of</strong> <strong>Contract</strong> (SCC),<br />

Instructions to Bidders (ITB), Scope <strong>of</strong> Work, technical specifications etc. to avoid wastage <strong>of</strong> time and money in seeking<br />

clarifications on technical/ commercial aspects <strong>of</strong> the <strong>of</strong>fer. Bidder may note that no technical and commercial clarifications will<br />

be sought <strong>for</strong> after the receipt <strong>of</strong> the bids. In case <strong>of</strong> any deviation/noncon<strong>for</strong>mity observed in the bid, it will be liable <strong>for</strong><br />

rejection.<br />

17 Award <strong>of</strong> <strong>Contract</strong>:<br />

17.1 The Acceptance <strong>of</strong> Tender will be intimated to the successful Tenderer by <strong>GAIL</strong> either by Telex/ Telegram/ Fax or by Letter or<br />

like means-defined as LETTER OF ACCEPTANCE OF TENDER.<br />

17.2 <strong>GAIL</strong> will be the sole judge in the matter <strong>of</strong> award <strong>of</strong> CONTRACT and the decision <strong>of</strong> <strong>GAIL</strong> shall be final and binding.<br />

18 Clarification <strong>of</strong> Tender Document:<br />

18.1 The Tender is required to carefully examine the Technical Specifications, Conditions <strong>of</strong> <strong>Contract</strong>, Drawings and other details<br />

relating to WORK and given in Tender Document and fully in<strong>for</strong>m himself as to all conditions and matters which may in any<br />

way affect the WORK or the cost there<strong>of</strong>. In case the Tenderer is in doubt about the completeness or correctness <strong>of</strong> any <strong>of</strong> the<br />

contents <strong>of</strong> the Tender Documents he should request in writing <strong>for</strong> an interpretation/clarification to <strong>GAIL</strong> in triplicate. <strong>GAIL</strong> will<br />

then issue interpretation/clarification to Tenderer in writing. Such clarifications and or interpretations shall <strong>for</strong>m part <strong>of</strong> the<br />

Specifications and Documents and shall accompany the tender which shall be submitted by tenderer within time and date as<br />

specified in invitations to tender.<br />
