3.3 Covering letter alongwith its enclosures accompanying the Tender Document and all further correspondence shall be<br />
submitted in duplicate.<br />
3.4 Tenderers are advised to submit quotations based strictly on the terms and conditions and specifications contained in the<br />
Tender Documents and not to stipulate any deviations.<br />
3.5 Tenders should always be placed in double sealed covers, superscribing ["QUOTATION DO NOT OPEN" Tender <strong>for</strong><br />
_________________________ Project <strong>of</strong> <strong>GAIL</strong> (India) Limited due <strong>for</strong> opening on _______________________]. The Full<br />
Name, Address and Telegraphic Address, Fax No. <strong>of</strong> the Tenderers shall be written on the bottom left hand corner <strong>of</strong> the<br />
sealed cover.<br />
4. Documents:<br />
4.1 General: The tenders as submitted, will consist <strong>of</strong> the following:<br />
(i) Complete set <strong>of</strong> Tender Documents (Original) as sold duly filled in and signed by the tenderer as prescribed in<br />
<strong>different</strong> clauses <strong>of</strong> the Tender Documents.<br />
(ii) Earnest money in the manner specified in Clause 6 here<strong>of</strong>.<br />
(iii) Power <strong>of</strong> Attorney or a true copy there<strong>of</strong> duly attested by a Gazetted Officer in case an authorised representative has<br />
signed the tender, as required by Clause 14 here<strong>of</strong>.<br />
(iv) In<strong>for</strong>mation regarding tenderers in the pro<strong>for</strong>ma enclosed.<br />
(v) Details <strong>of</strong> work <strong>of</strong> similar type and magnitude carried out by the Tenderer in the pro<strong>for</strong>ma provided in the tender<br />
document.<br />
(vi) Organisation chart giving details <strong>of</strong> field management at site, the tenderer proposes to have <strong>for</strong> this job.<br />
(vii) Details <strong>of</strong> construction plant and equipments available with the tenderer <strong>for</strong> using in this work.<br />
(viii) Solvency Certificate from Scheduled Bank to prove the financial ability to carry out the work tendered <strong>for</strong>.<br />
(ix) Latest Balance Sheet and Pr<strong>of</strong>it & Loss Account duly audited.<br />
(x) Details <strong>of</strong> present commitment as per pro<strong>for</strong>ma enclosed to tender.<br />
(xi) Data required regarding SUB-CONTRACTOR(s)/ Supplier/ Manufacturers and other technical in<strong>for</strong>mations the<br />
tenderer wish to furnish.<br />
(xii) Provident fund registration certificate<br />
(xiii) List showing all enclosures to tender.<br />
4.2 All pages are to be Initiated: All signatures in Tender Documents shall be dated, as well as, all the pages <strong>of</strong> all sections <strong>of</strong><br />
Tender Documents shall be initialed at the lower right hand corner and signed wherever required in the tender papers by the<br />
TENDERER or by a person holding power <strong>of</strong> attorney authorising him to sign on behalf <strong>of</strong> the tenderer be<strong>for</strong>e submission <strong>of</strong><br />
tender.<br />
4.3 Rates to be in Figures and Words: The tender should quote in English both in figures as well as in words the rates and<br />
amounts tendered by him in the Schedule <strong>of</strong> Rates <strong>of</strong> Tender submitted by the CONTRACTOR <strong>for</strong> each item and in such a way<br />
that interpolation is not possible. The amount <strong>for</strong> each item should be worked out and entered and requisite total given <strong>of</strong> all<br />
items, both in figures and in words. The tendered amount <strong>for</strong> the work shall be entered in the tender and duly signed by the<br />
Tenderer. If some discrepancies are found between the RATES in FIGURES and WORDS or the AMOUNT shown in the tender,<br />
the following procedure shall be followed:<br />
a) When there is difference between the rates in figures and words, the rate which corresponds to the amount worked out<br />
by the tenderer shall be taken as correct.<br />
b) When the rate quoted by the tenderer in figures and words tally but the amount is incorrect the rate quoted by the<br />
tenderer shall be taken as correct.<br />
c) When it is not possible to ascertain the correct rate by either <strong>of</strong> above methods, the rate quoted in words shall be taken<br />
as correct.<br />
4.4 Corrections and Erasures: All correction(s) and alteration(s) in the entries <strong>of</strong> tender paper shall be signed in full by the<br />
TENDERER with date. No erasure or over writing is permissible.<br />
4.5 Signature <strong>of</strong> Tenderer:<br />
4.5.1 The TENDERER shall contain the name, residence and place <strong>of</strong> business <strong>of</strong> person or persons making the tender and shall<br />
be signed by the TENDERER with his usual signature. Partnership firms shall furnish the full names <strong>of</strong> all partners in the<br />
tender. It should be signed in the partnership's name by all the partners or by duly authorised representatives followed by<br />
the name and designation <strong>of</strong> the person signing. Tender by a corporation shall be signed by an authorised representative,<br />
and a Power <strong>of</strong> Attorney in that behalf shall accompany the tender. A copy <strong>of</strong> the constitution <strong>of</strong> the firm with names <strong>of</strong> all<br />
partners shall be furnished.<br />
4.5.2 When a tenderer signs a tender in a language other than English, the total amount tendered should, in addition, be<br />
written in the same language. The signature should be attested by at least one witness.<br />
4.6 Witness: Witness and sureties shall be persons <strong>of</strong> status and property and their names, occupation and address shall be stated<br />
below their signature.<br />
4.7 Details <strong>of</strong> Experience: The tenderer should furnish, alongwith his tender, details <strong>of</strong> previous experience in having successfully<br />
completed in the recent past works <strong>of</strong> this nature, together with the names <strong>of</strong> Employers, location <strong>of</strong> sites and value <strong>of</strong><br />
contract, date <strong>of</strong> commencement and completion <strong>of</strong> work, delays if any, reasons <strong>of</strong> delay and other details alongwith<br />
documentary evidence(s).<br />
4.8 Liability <strong>of</strong> Government <strong>of</strong> India: It is expressly understood and agreed by and between Bidder or/<strong>Contract</strong>or and M/s <strong>GAIL</strong><br />
(India) Limited, and that M/s <strong>GAIL</strong> (India) Ltd., is entering into this agreement solely on its own behalf and not on behalf <strong>of</strong><br />
any other person or entity. In particular, it is expressly understood and agreed that the Government <strong>of</strong> India is not a party to<br />
this agreement and has no liabilities, obligations or rights hereunder. It is expressly understood and agreed that M/s <strong>GAIL</strong><br />
(India) Ltd. is an independent legal entity with power and authority to enter into contracts solely on its own behalf under the<br />
applicable Laws <strong>of</strong> India and general principles <strong>of</strong> <strong>Contract</strong> Law. The Bidder/<strong>Contract</strong>or expressly agrees, acknowledges and<br />
understands that M/s <strong>GAIL</strong> (India) Ltd. is not an agent, representative or delegate <strong>of</strong> the Government <strong>of</strong> India. It is further<br />
understood and agreed that the Government <strong>of</strong> India is not and shall not be liable <strong>for</strong> any acts, omissions, commissions,<br />
