Contract for Hiring Services of different types of call basis ... - GAIL

8.1 The successful bidder shall deposit with GAIL, an amount of
Rs.15,000/- per vehicle as security deposit in the form of
demand draft from a Nationalized Bank or a Bank Guarantee in
favour of GAIL as per Performa enclosed in GCC. The validity period
shall be up to 3 months after contractual completion date.
8.2 The security deposit shall be refunded within three months after
successful completion of contract period after adjustment of any
dues of GAIL
8.3 No interest shall be paid by GAIL on EMD/SD of tenderer/contractor.
The EMD of unsuccessful tenderer shall be refunded without any
interest thereon within one month after final decision on the
tenders has been taken.
8.4 In case the tenderer backs out from his offer or fails to supply the
vehicle(s) after the offer of the tenderer having been accepted by
GAIL, the EMD deposited by the tenderer shall be forfeited.
9 Liquidated Damages/Compensation : (see Special Conditions).
9.1 Hired vehicle must report for duty with sufficient fuel for 350 km.
run. If sufficient fuel is not available, then km. run and time
consumed in refueling will be on contractor’s account.
9.2 If the vehicles are not provided, GAIL reserves the right to
hire the vehicles from the market. Any additional amount incurred
shall be to contractor’s account and the same shall be recovered
from the bills or any other dues of the contractor.
10 Damages to the GAIL.
The cost/ liquidated damages are also recoverable from the
contractor if such hired vehicles on the service of GAIL cause
damage to any equipment material or property belonging to GAIL.
The valuation of damages to be decided by GAIL shall be binding
on the Contractor.
