LIQUIDATED DAMAGES/COMPENSATION:
2.6 GAIL shall make alternative arrangement for the vehicles at the sole
risk and cost of the contractor, in case of breakdown of the vehicle
and failure of the contractor to provide substitute vehicle within 01
hour and recover such extra cost and expenses from the contractor
from the amount due to the contractor.
If the contractor fails to provide the vehicle of specified model/make
and makes the vehicle of other make or old model available, GAIL
shall have the right to recover Rs 1/- per K.M. per vehicle towards
penalty charges or reject the vehicle from deployment at GAIL service
and may terminate the contract.
2.7 The special condition shall prevail over the GCC.
2.8 If there is any deviation as per Special Condition or Scope of
Work or if any complaint is received from the user, a penalty of
Rs. 500/- will be levied upon the contractor for each complaint.
3.. EVALUATION OF BID:
Bid shall be evaluated on item wise L-1 basis. Each group of items is
considered as one item.
4.0. ACCIDENTS / DAMAGES / CLAIMS / LIABILITIES:
4.1 In the event of any accident or damages while the Vehicle is on the duty of
GAIL shall be completely free from any liability of any nature connected with
the accident / damage (s). The contractor himself will be fully and exclusively
responsible for any damage to Vehicle or any personal injury to driver or any
other person in the employment of the contractor, occupants of the Vehicle or
any person (s) or damage to any property or person. This includes any third
party claims. However, if the damage or loss is incurred by GAIL or its
employees as a result of any accident or any other reason involving the failure
of the Vehicle / driver, the contractor shall reimburse on demand and without
any demur the compensation / damages if any sustained by GAIL on this
account.
4.2 The contractor will be solely responsible for any consequences under laws,
arising out of any accident caused by the Vehicle / equipment to the property
or personnel of GAIL. The contractor shall also be responsible for any claim /
compensation that arises due to damage / cause or injuries sustained by any
third party / parties / including life permanent injuries etc., by his / their
Vehicle in addition to damages / disabilities / death etc. the GAIL employees /
property. The contractor shall reimburse on demand and without any demur
the compensation / damages if any sustained by the GAIL on this account.
