7.5 The WORK under the CONTRACT shall however, continue during the Arbitration<br />
proceedings and no payment due or payable to the CONTRACTOR shall be withheld<br />
on account <strong>of</strong> such proceedings. The venue <strong>of</strong> arbitration shall be New Delhi.<br />
7.6 The award <strong>of</strong> the Arbitrator shall be final and binding on both the parties.<br />
7.7 Subject to a<strong>for</strong>esaid the provisions <strong>of</strong> the Indian Arbitration and Conciliation Act,<br />
1996 or any statutory modification or re-enactment there<strong>of</strong> and the rules made there<br />
under, and <strong>for</strong> the time being in <strong>for</strong>ce, shall apply to the arbitration proceeding under<br />
this clause.<br />
8.0 JURISDICTION:<br />
The CONTRACT shall be governed by and constructed according to the laws in <strong>for</strong>ce<br />
in INDIA. The CONTRACTOR hereby submits to the jurisdiction <strong>of</strong> the Courts situated<br />
at MUMBAI <strong>for</strong> the purpose <strong>of</strong> disputes, actions and proceedings arising out <strong>of</strong> the<br />
CONTRACT.<br />
9.0 SUMMARY TERMINATION OF CONTRACT DUE TO SUBMISSION OF FALSE<br />
DOCUMENT:<br />
9.1 Bidders are required to furnish the complete and correct in<strong>for</strong>mation/documents<br />
required <strong>for</strong> evaluation <strong>of</strong> their bids. If the in<strong>for</strong>mation/documents <strong>for</strong>ming <strong>basis</strong> <strong>of</strong><br />
evaluation is found to be false/<strong>for</strong>ged, the same shall be considered adequate<br />
ground <strong>for</strong> rejection <strong>of</strong> the Bids and <strong>for</strong>feiture <strong>of</strong> Earnest Money Deposit.<br />
9.2 In case, the in<strong>for</strong>mation/document furnished by the contractor <strong>for</strong>ming <strong>basis</strong> <strong>of</strong><br />
evaluation <strong>of</strong> his bid is found to be false/<strong>for</strong>ged after the award <strong>of</strong> the contract, <strong>GAIL</strong><br />
shall have full right to terminate the contract and get the remaining job executed at<br />
the risk & cost <strong>of</strong> such contractor without any prejudice to other rights available to<br />
<strong>GAIL</strong> under the contract such as <strong>for</strong>feiture <strong>of</strong> Security Deposit, withholding <strong>of</strong><br />
payments etc.<br />
9.3 In case the issue <strong>of</strong> submission <strong>of</strong> false document comes to the notice after<br />
execution <strong>of</strong> the work, <strong>GAIL</strong> shall have full right to <strong>for</strong>feit any amount due to the<br />
contractor along with <strong>for</strong>feiture <strong>of</strong> Security Deposit furnished by the contractor.<br />
9.4 Further, such contractor/bidder shall be blacklisted <strong>for</strong> future business with <strong>GAIL</strong>.<br />
