courses reflect Sunni Islamic doctr<strong>in</strong>e, which, <strong>the</strong>y ma<strong>in</strong>ta<strong>in</strong>, expla<strong>in</strong>s why "non-Muslims"<br />

are exempt.<br />

An Alevi parent <strong>in</strong> January 2004 filed suit <strong>in</strong> <strong>the</strong> European Court of Human Rights<br />

charg<strong>in</strong>g that <strong>the</strong> mandatory religion courses violate religious freedom; <strong>the</strong> case was<br />

ongo<strong>in</strong>g at <strong>the</strong> end of <strong>the</strong> period covered by this report. In a June 2004 report, <strong>the</strong><br />

European Commission aga<strong>in</strong>st Racism and Intolerance recommended that <strong>the</strong><br />

Government ei<strong>the</strong>r make <strong>the</strong> courses optional or revise <strong>the</strong> content so that <strong>the</strong>y<br />

genu<strong>in</strong>ely and fairly cover all religions.<br />

Officially recognized religious m<strong>in</strong>orities may operate schools under <strong>the</strong> supervision of <strong>the</strong><br />

M<strong>in</strong>istry of Education. Such schools are required to appo<strong>in</strong>t a Muslim as deputy pr<strong>in</strong>cipal;<br />

reportedly <strong>the</strong>se deputies have more authority than <strong>the</strong>ir nom<strong>in</strong>al supervisors. The<br />

curriculum of <strong>the</strong>se schools <strong>in</strong>cludes Greek Orthodox, Armenian Orthodox, and Jewish<br />

<strong>in</strong>struction. In May 2004, <strong>the</strong> Education M<strong>in</strong>istry stated that children with "non-Muslim"<br />

mo<strong>the</strong>rs could attend m<strong>in</strong>ority schools; previously, only those with "non-Muslim" fa<strong>the</strong>rs<br />

were permitted.<br />

The Caferis, <strong>the</strong> country's pr<strong>in</strong>cipal Shi'a community number<strong>in</strong>g between 500,000 and 1<br />

million (concentrated mostly <strong>in</strong> eastern Turkey and Istanbul), do not face restrictions on<br />

<strong>the</strong>ir religious freedoms. They are free to build and operate <strong>the</strong>ir own mosques and to<br />

appo<strong>in</strong>t <strong>the</strong>ir own imams; however, as with <strong>the</strong> Alevis, <strong>the</strong> Diya<strong>net</strong> does not allocate<br />

funds for this purpose. The Caferis claim to have faced discrim<strong>in</strong>ation and repression <strong>in</strong><br />

<strong>the</strong> past, but such <strong>in</strong>cidents reportedly have been rare <strong>in</strong> recent years.<br />

Restrictions on Religious Freedom<br />

Government policy and practice contributed to <strong>the</strong> generally free practice of religion;<br />

however, state policy imposes some restrictions on religious groups and on religious<br />

expression <strong>in</strong> government offices and state-run <strong>in</strong>stitutions, <strong>in</strong>clud<strong>in</strong>g universities.<br />

"Secularists" <strong>in</strong> <strong>the</strong> military, judiciary, and o<strong>the</strong>r branches of <strong>the</strong> bureaucracy cont<strong>in</strong>ued<br />

to wage campaigns aga<strong>in</strong>st what <strong>the</strong>y label as proponents of "Islamic fundamentalism."<br />

These groups view "religious fundamentalism," which <strong>the</strong>y do not def<strong>in</strong>e clearly, but<br />

which <strong>the</strong>y assert is an attempt to impose <strong>the</strong> rule of Shari'a law <strong>in</strong> all civil and crim<strong>in</strong>al<br />

matters, as a threat to <strong>the</strong> "secular State." The National Security Council (NSC)<br />

categorizes religious fundamentalism as a threat to public safety.<br />

Accord<strong>in</strong>g to Mazlum-Der and o<strong>the</strong>r groups, some government m<strong>in</strong>istries have dismissed<br />

or barred from promotion civil servants suspected of anti-state or Islamist activities.<br />

Reports by Mazlum-Der, <strong>the</strong> media, and o<strong>the</strong>rs <strong>in</strong>dicated that <strong>the</strong> military sometimes<br />

dismisses religiously observant Muslims from military service. Such dismissals were<br />

based on behavior that military officials believed identified <strong>the</strong>se <strong>in</strong>dividuals as Islamic<br />

fundamentalists, which <strong>the</strong>y were concerned could <strong>in</strong>dicate disloyalty to <strong>the</strong> secular<br />

State.<br />

Accord<strong>in</strong>g to Mazlum-Der, <strong>the</strong> military charged <strong>in</strong>dividuals with lack of discipl<strong>in</strong>e for<br />

activities that <strong>in</strong>cluded perform<strong>in</strong>g Muslim prayers or be<strong>in</strong>g married to women who wore<br />

headscarves. Accord<strong>in</strong>g to <strong>the</strong> military, officers and NCOs were sometimes dismissed for<br />

ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g ties to Islamic fundamentalist organizations, despite repeated warn<strong>in</strong>gs from<br />

superior officers.<br />

In February, a military court reportedly dismissed <strong>the</strong> deputy commander of <strong>the</strong><br />

Jandarma Command <strong>in</strong> Ardahan for worshipp<strong>in</strong>g at a mosque while wear<strong>in</strong>g his uniform.<br />

Mystical Sufi and o<strong>the</strong>r religious-social orders (tarikats) and lodges (cemaats) have been<br />

banned officially s<strong>in</strong>ce <strong>the</strong> mid 1920s; however, tarikats and cemaats rema<strong>in</strong> active and<br />

widespread. Some prom<strong>in</strong>ent political and social leaders cont<strong>in</strong>ue to associate with<br />

tarikats, cemaats, and o<strong>the</strong>r Islamic communities.<br />
