Detailed instructions for each step of the SEQR review can be found at the New York Department of Environmental<br />
Conservation‘s website under regulations, Chapter VI: 617: State Environmental Quality Review. An additional<br />
SEQR review for each construction phase is not necessary.<br />
2. Permit Process<br />
The proposed Railroad <strong>Trail</strong> will require permitting and coordination with a number of different state and federal<br />
entities, including, but not limited to, the United States Army Corps of Engineers, NYS Department of Environmental<br />
Conservation, NY State Historic Preservation Office, United State Fish and Wildlife Service, and the New York<br />
Natural Heritage Program. The Active <strong>Transportation</strong> Package is primarily on-street improvements, and is unlikely to<br />
require any of the following permits.<br />
Joint Application. Submittal of a Joint Application for Permit to both the United States Army Corps of Engineers<br />
(Corps) and the New York State Department of Environmental Conservation (NYSDEC) will be required prior to<br />
commencing construction of this project. It is anticipated that disturbance to both Waters of the United States and<br />
NYSDEC mapped wetlands and streams will occur as a result of the construction of this project. Prior to submitting a<br />
Joint Application for Permit, an on-site wetland delineation will need to be conducted, a wetland delineation report<br />
prepared, and a jurisdictional determination site visit conducted with the regulatory agencies involved.<br />
NYS Department of Environmental Conservation. This project is likely to disturb greater than one acre of land and a<br />
Stormwater Pollution Prevention Plan (SWPPP) will be needed to obtain coverage under the NYSDEC SPDES<br />
General Permit for Stormwater Discharges from Construction Activity, GP-0-10-001. Stormwater management<br />
practices set forth in a SWPPP should be designed to protect water quality, enhance operations and reduce<br />
maintenance. All measures and practices should comply with NYSDEC requirements. Prior written authorization<br />
from the NYSDEC is needed in order to proceed with construction activities that disturb more than 5 acres at a time.<br />
In addition, NYSDEC regulations require a weekly site inspection by a licensed professional engineer (or<br />
representative) to review compliance with the prepared plans during construction. Site inspections must also be<br />
performed within 24 hours of any storm event exceeding ½ inch of rainfall.<br />
NY State Historic Preservation Office. Coordination with the State Historic Preservation Office (SHPO) will be<br />
necessary to confirm the absence or presence of known archeologically sensitive areas, listed sites and eligible sites<br />
within the project area.<br />
U.S. Fish & Wildlife Service. Coordination with the U.S. Fish & Wildlife Service will be necessary for potential<br />
impacts on federally listed rare, threatened or endangered wildlife species.<br />
New York Natural Heritage Program. A letter of project intent was sent to the New York Natural Heritage Program to<br />
identify any State endangered and/or threatened wildlife and plant species and/or important ecological communities<br />
that are located in the project area boundary. A response was received and included only one historical record for a<br />
fish species (Notropis heterodon - blackchin shiner).<br />
