2.0 STATUTORY AND CONTRACTUAL REQUIREMENTS<br />
2.1 Introduction<br />
This section describes the statutory requirement for a <strong>Canada</strong>-<strong>Newfoundl<strong>and</strong></strong><br />
<strong>and</strong> <strong>Labrador</strong> <strong>Benefits</strong> <strong>Plan</strong>. It also references the <strong>Benefits</strong> Agreement that<br />
EMCP <strong>and</strong> the <strong>Hebron</strong> co-venturers have entered into with the Government of<br />
<strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong>.<br />
2.2 Atlantic Accord<br />
The C-NLOPB is responsible for management of the petroleum resources in the<br />
<strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong> offshore area, pursuant to the <strong>Canada</strong>-<br />
<strong>Newfoundl<strong>and</strong></strong> Atlantic Accord Implementation Act <strong>and</strong> the <strong>Canada</strong>-<br />
<strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong> Atlantic Accord Implementation <strong>Newfoundl<strong>and</strong></strong> <strong>and</strong><br />
<strong>Labrador</strong> Act (“the Acts”). The Acts establish the requirements that proponents of<br />
offshore development projects must fulfill in order to obtain approval of a<br />
Development Application. The Development Application is to be comprised of a<br />
<strong>Canada</strong>-<strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong> <strong>Benefits</strong> <strong>Plan</strong>, <strong>and</strong> a Development <strong>Plan</strong><br />
with ancillary documents.<br />
Before the C-NLOPB may approve a Development Application, it must first<br />
approve a <strong>Canada</strong>-<strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong> <strong>Benefits</strong> <strong>Plan</strong>. As outlined in<br />
section 45 of the Accord Acts, specific provisions of the <strong>Benefits</strong> <strong>Plan</strong> must<br />
include plans for:<br />

The employment of Canadians <strong>and</strong>, in particular, members of the labour<br />
force of the Province of <strong>Newfoundl<strong>and</strong></strong> <strong>and</strong> <strong>Labrador</strong>;<br />
Providing manufacturers, consultants, contractors <strong>and</strong> suppliers <strong>and</strong> service<br />
companies in the Province, <strong>and</strong> other parts of <strong>Canada</strong>, with full <strong>and</strong> fair<br />
opportunity to participate on a competitive basis in the supply of goods <strong>and</strong><br />
services used in any proposed work or activity referenced in the <strong>Benefits</strong><br />
<strong>Plan</strong>;<br />
The establishment of an office in the Province where appropriate levels of<br />
decision-making are to take place;<br />
Expenditures for R&D, including education <strong>and</strong> training, to be carried out in<br />
the Province;<br />
Consistent with the Canadian Charter of Rights <strong>and</strong> Freedoms, providing<br />
individuals resident in the Province with first consideration for training <strong>and</strong><br />
employment in the work program for which the <strong>Benefits</strong> <strong>Plan</strong> was submitted;<br />
<strong>and</strong><br />
Providing first consideration to services provided from within the Province<br />
<strong>and</strong> to goods manufactured in the Province, where those services <strong>and</strong> goods<br />
are competitive in terms of fair market price, quality <strong>and</strong> delivery.<br />
