K. Issue: Request to Defer Final Action on New Rates
Public Comments:
All parties expressed concerns regarding the time allotted for review of the data
supporting the pending rate action and have requested a delay in implementing
the proposed rate increase. NYAPP has formally requested a delay in the
increase until July 1, 2007 and Neighboring States request a delay until at least
until the end of the summer (October) both citing the need for more time to
review the responses to the data requests.
Staff Analysis:
Staff believes that there was sufficient time to review the data supporting the
pending rate action including the responses to the significant number of data
requests received.
As noted earlier in Part l, subsequent to the January 30, 2007 Trustee action, the
Authority promptly sent copies to its customers of the rate modification plan, filed
all appropriate notices in the State Register, made staff available to the
customers and/or their representatives on a number of occasions to answer
questions regarding the proposed rate revisions. The proposed rate action
employs the same principles and methodologies agreed to by the customers and
adopted by the Trustees in the 2003 rate action. Meetings and telephone
conference calls were held with the MEUA and NYAPP representatives to
discuss the proposal, and staff responded to a total of 159 formal data requests.
As noted above, on the basis of comments made at the March 22, 2007 Public
Forum regarding the time allotted for the data review the April 2, 2007 deadline
for submitting written comments on was extended one week until April 9, 2007.
The time allotted for review and comment on the proposed rate action follows the
timetable of the 1992 and 2003 rate actions. Staff acknowledges the complexity
