7. Interim rates raised to the month <strong>of</strong> May has been minimal with only $4,744<br />

being raised. No more interims will be raised as the database is prepared for<br />

the 2013/14 rates generation. On another note, the <strong>Shire</strong> is still awaiting<br />

valuation services from Landgate to determine the Ex-gratia amount due from<br />

the Dampier Bunbury pipeline. Department <strong>of</strong> Regional Development have<br />

been in contact regarding the delay in payment and have raised the issue<br />

that the rateable area according to them should be less than that recorded in<br />

the <strong>Shire</strong>’s database.<br />

Debt Recovery<br />

8. Debt Recovery (Stage 1) – This stage involves the Debt Collection Agency<br />

sending a Letter <strong>of</strong> Demand to the defaulting ratepayer on behalf <strong>of</strong> the<br />

<strong>Shire</strong>.<br />

9. As noted in Point 5, a total <strong>of</strong> 73 letters <strong>of</strong> demand have been sent to rate<br />

payers via the debt collection agency, Dun & Bradstreet. Some <strong>of</strong> these have<br />

now paid or have made direct debit arrangements with the <strong>Shire</strong> to settle<br />

their debts. 49 files have been sent for processing a General Procedure Claim<br />

as part <strong>of</strong> Stage 2 collection.<br />

10. Debt Recovery (Stage 3) - this stage involves the issue <strong>of</strong> Property Seizure<br />

and Sale Orders (“PS&SO”) with Dun & Bradstreet.<br />

11. All <strong>of</strong> the 49 outstanding debts that remain with Dun & Bradstreet have had<br />

Judgement entered against them; 42 <strong>of</strong> these have now substantially paid<br />

their rates. Of the remaining, six have gone to PSSO stage.<br />

STATUTORY AND LEGAL IMPLICATIONS<br />

12. The <strong>Shire</strong> collects its rates debts in accordance with the Local Government<br />

Act (1995) Division 6 – Rates and Service Charges under the requirements <strong>of</strong><br />

subdivision 5 – Recovery <strong>of</strong> unpaid rates and service charges.<br />
