2.3.2. Putting in<str<strong>on</strong>g>to</str<strong>on</strong>g> service ( 37 )<br />

Putting in<str<strong>on</strong>g>to</str<strong>on</strong>g> service takes place at <str<strong>on</strong>g>the</str<strong>on</strong>g> moment <str<strong>on</strong>g>of</str<strong>on</strong>g> first use<br />

within <str<strong>on</strong>g>the</str<strong>on</strong>g> Community by <str<strong>on</strong>g>the</str<strong>on</strong>g> end user ( 38 ). Where <str<strong>on</strong>g>the</str<strong>on</strong>g> product<br />

is put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace, <str<strong>on</strong>g>the</str<strong>on</strong>g> employer is <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

be c<strong>on</strong>sidered as <str<strong>on</strong>g>the</str<strong>on</strong>g> end user.<br />

Products must comply with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable<br />

<strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r Community legislati<strong>on</strong><br />

when <str<strong>on</strong>g>the</str<strong>on</strong>g>y are put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service. However, <str<strong>on</strong>g>the</str<strong>on</strong>g> need <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

verify <str<strong>on</strong>g>the</str<strong>on</strong>g> compliance <str<strong>on</strong>g>of</str<strong>on</strong>g> products, and – if applicable – that<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y are correctly installed, maintained and used for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

intended purpose, should be limited, in <str<strong>on</strong>g>the</str<strong>on</strong>g> framework <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

market surveillance ( 36 ), <str<strong>on</strong>g>to</str<strong>on</strong>g> products:<br />

● which can <strong>on</strong>ly be used after an assembly, an installati<strong>on</strong><br />

or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r manipulati<strong>on</strong> has been carried out;<br />

● whose compliance can be influenced by <str<strong>on</strong>g>the</str<strong>on</strong>g> distributi<strong>on</strong><br />

c<strong>on</strong>diti<strong>on</strong>s (for example s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage, transport); or<br />

The aim <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period is <str<strong>on</strong>g>to</str<strong>on</strong>g> allow<br />

manufacturers and notified bodies <str<strong>on</strong>g>to</str<strong>on</strong>g> adjust<br />

gradually <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity assessment procedures<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements set<br />

up by <str<strong>on</strong>g>the</str<strong>on</strong>g> new directive, and, thus, <str<strong>on</strong>g>to</str<strong>on</strong>g> avert<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> risk <str<strong>on</strong>g>of</str<strong>on</strong>g> blocking producti<strong>on</strong>. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r,<br />

manufacturers, importers and distribu<str<strong>on</strong>g>to</str<strong>on</strong>g>rs<br />

need <str<strong>on</strong>g>to</str<strong>on</strong>g> be given time <str<strong>on</strong>g>to</str<strong>on</strong>g> exercise any rights<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y have acquired under <str<strong>on</strong>g>the</str<strong>on</strong>g> rules predating<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> new directive, for example <str<strong>on</strong>g>to</str<strong>on</strong>g> sell<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir s<str<strong>on</strong>g>to</str<strong>on</strong>g>cks <str<strong>on</strong>g>of</str<strong>on</strong>g> products manufactured in<br />

line with <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al rules in force before<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> directive. Finally, <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period<br />

provides for extra time for <str<strong>on</strong>g>the</str<strong>on</strong>g> adopti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

harm<strong>on</strong>ised standards, even though this is<br />

not, in principle, a prec<strong>on</strong>diti<strong>on</strong> for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g>.<br />

In line with <str<strong>on</strong>g>the</str<strong>on</strong>g> objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al<br />

period, Member States are obliged <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

maintain <str<strong>on</strong>g>the</str<strong>on</strong>g>ir nati<strong>on</strong>al system as an opti<strong>on</strong><br />

until <str<strong>on</strong>g>the</str<strong>on</strong>g> end <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period,<br />

unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise provided for ( 44 ). The obligati<strong>on</strong><br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> maintain <str<strong>on</strong>g>the</str<strong>on</strong>g> pre-existing rules<br />

applies not <strong>on</strong>ly <str<strong>on</strong>g>to</str<strong>on</strong>g> all manda<str<strong>on</strong>g>to</str<strong>on</strong>g>ry provisi<strong>on</strong>s<br />

in force in each Member State, but also <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

all nati<strong>on</strong>al specificati<strong>on</strong>s applied voluntarily by manufacturers.<br />

C<strong>on</strong>sequently, Member States with no regulati<strong>on</strong>s, in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> strict sense, must maintain <str<strong>on</strong>g>the</str<strong>on</strong>g> existing system and,<br />

hence, refrain from legislati<strong>on</strong>. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al standards<br />

bodies are obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> make available, throughout <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

transiti<strong>on</strong>al period, copies <str<strong>on</strong>g>of</str<strong>on</strong>g> nati<strong>on</strong>al standards applied<br />

under <str<strong>on</strong>g>the</str<strong>on</strong>g> existing nati<strong>on</strong>al system.<br />

Each directive providing for a transiti<strong>on</strong>al period sets <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

date for freezing <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al system in force. Generally, this<br />

is <str<strong>on</strong>g>the</str<strong>on</strong>g> date <strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g> directive enters in<str<strong>on</strong>g>to</str<strong>on</strong>g> force, but<br />

sometimes it is <str<strong>on</strong>g>the</str<strong>on</strong>g> date <strong>on</strong> which <str<strong>on</strong>g>the</str<strong>on</strong>g> directive is adopted.<br />

During <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period Member States, may<br />

● which are not placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market prior <str<strong>on</strong>g>to</str<strong>on</strong>g> putting in<str<strong>on</strong>g>to</str<strong>on</strong>g><br />

service (for example products manufactured for own<br />

use) ( 39 ).<br />

Member States may not prohibit, restrict or impede <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

putting in<str<strong>on</strong>g>to</str<strong>on</strong>g> service <str<strong>on</strong>g>of</str<strong>on</strong>g> products that meet <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g> ( 40 ). However, Member States are<br />

allowed <str<strong>on</strong>g>to</str<strong>on</strong>g> maintain and adopt, in compliance with <str<strong>on</strong>g>the</str<strong>on</strong>g> Treaty<br />

(in particular Articles 28 and 30 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty), additi<strong>on</strong>al<br />

nati<strong>on</strong>al provisi<strong>on</strong>s regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> putting in<str<strong>on</strong>g>to</str<strong>on</strong>g> service,<br />

installati<strong>on</strong> or use, <str<strong>on</strong>g>of</str<strong>on</strong>g> products which are intended for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> workers or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r users, or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r products.<br />

Such nati<strong>on</strong>al provisi<strong>on</strong>s may not require modificati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

product manufactured in accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g>.<br />

2.4. Transiti<strong>on</strong>al period<br />

● Most <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> provide for a transiti<strong>on</strong>al<br />

period ( 41 ).<br />

● Member States are obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> allow <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir markets, until<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> end <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period, products designed and manufactured<br />

according <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir nati<strong>on</strong>al system. Thus, <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacture<br />

has <str<strong>on</strong>g>the</str<strong>on</strong>g> choice, throughout <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period,<br />

ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r <str<strong>on</strong>g>to</str<strong>on</strong>g> apply <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al system or <str<strong>on</strong>g>the</str<strong>on</strong>g> directive.<br />

● During <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period, products c<strong>on</strong>forming <str<strong>on</strong>g>to</str<strong>on</strong>g> all<br />

applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g> may be placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Community market<br />

and put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service in any Member State. Products manufactured<br />

in line with nati<strong>on</strong>al regulati<strong>on</strong>s or with n<strong>on</strong>-manda<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

technical specificati<strong>on</strong>s move freely according <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> principles<br />

laid down by Articles 28 and 30 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty ( 42 ).<br />

● At <str<strong>on</strong>g>the</str<strong>on</strong>g> end <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> transiti<strong>on</strong>al period, <str<strong>on</strong>g>the</str<strong>on</strong>g> directive applies <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> exclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> any nati<strong>on</strong>al rules covering <str<strong>on</strong>g>the</str<strong>on</strong>g> same products<br />

or <str<strong>on</strong>g>the</str<strong>on</strong>g> same essential requirements ( 43 ). C<strong>on</strong>sequently, <strong>on</strong>ly<br />

products in compliance with <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable directive may be<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Community market and put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service after <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

transiti<strong>on</strong>al period.<br />

make no changes <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> system in questi<strong>on</strong> which would<br />

modify product requirements or <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity assessment<br />

procedure or which would o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise have an effect <strong>on</strong><br />

acquired rights. However, Member States are allowed <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

carry out changes in cases <str<strong>on</strong>g>of</str<strong>on</strong>g> force majeure. For example,<br />

technical progress or excepti<strong>on</strong>al circumstances may<br />

reveal that <str<strong>on</strong>g>the</str<strong>on</strong>g> system in force fails <str<strong>on</strong>g>to</str<strong>on</strong>g> satisfy a legitimate<br />

requirement and that this shortcoming creates risks, which<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Member State was unable <str<strong>on</strong>g>to</str<strong>on</strong>g> prevent by amending <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

rules in force in good time. Such amendments have <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

notified at <str<strong>on</strong>g>the</str<strong>on</strong>g> draft stage, as required by Directive<br />

98/34/EC, so that <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r Member<br />

c<strong>on</strong>structi<strong>on</strong> products<br />

manufactured by <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

c<strong>on</strong>struc<str<strong>on</strong>g>to</str<strong>on</strong>g>rs <str<strong>on</strong>g>the</str<strong>on</strong>g>mselves<br />

<strong>on</strong> site or elsewhere<br />

should be regarded as<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

although a transfer is<br />

not taking place.<br />
