Harm<strong>on</strong>ised standards provide a presumpti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity with <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements<br />

( 84 ), if <str<strong>on</strong>g>the</str<strong>on</strong>g>ir reference has been published<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> Official Journal and if <str<strong>on</strong>g>the</str<strong>on</strong>g>y have<br />

been transposed at nati<strong>on</strong>al level. However,<br />

it is not necessary that transpositi<strong>on</strong> takes<br />

place in all Member States before <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity becomes effective.<br />

Since European standards have <str<strong>on</strong>g>to</str<strong>on</strong>g> be transposed<br />

in a uniform way, a manufacturer may<br />

choose any <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> corresp<strong>on</strong>ding nati<strong>on</strong>al<br />

standards.<br />

The objective <str<strong>on</strong>g>of</str<strong>on</strong>g> publishing <str<strong>on</strong>g>the</str<strong>on</strong>g> reference<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> Official Journal is <str<strong>on</strong>g>to</str<strong>on</strong>g> set <str<strong>on</strong>g>the</str<strong>on</strong>g> earliest<br />

date for <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> take effect. Before <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> publishes<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> reference, it may verify that <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

terms <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> mandate are fulfilled. When it<br />

c<strong>on</strong>siders that a standard does not meet<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> terms <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> mandate, it will ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r not<br />

publish <str<strong>on</strong>g>the</str<strong>on</strong>g> reference <str<strong>on</strong>g>of</str<strong>on</strong>g> this standard, or it<br />

will limit publicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> reference <str<strong>on</strong>g>to</str<strong>on</strong>g> parts<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> this standard. In such cases, <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong><br />

for a harm<strong>on</strong>ised standard <str<strong>on</strong>g>to</str<strong>on</strong>g> produce a<br />

presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity is not met, or it<br />

is <strong>on</strong>ly met for <str<strong>on</strong>g>the</str<strong>on</strong>g> part that <str<strong>on</strong>g>the</str<strong>on</strong>g> published references cover.<br />

The applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> harm<strong>on</strong>ised standards that give a presumpti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity remains voluntary ( 83 ).The manufacturer<br />

can choose whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r or not <str<strong>on</strong>g>to</str<strong>on</strong>g> refer <str<strong>on</strong>g>to</str<strong>on</strong>g> harm<strong>on</strong>ised<br />

standards. However, if <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturer chooses not <str<strong>on</strong>g>to</str<strong>on</strong>g> follow<br />

a harm<strong>on</strong>ised standard, he has <str<strong>on</strong>g>the</str<strong>on</strong>g> obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> prove<br />

that his products are in c<strong>on</strong>formity with essential requirements<br />

by <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r means <str<strong>on</strong>g>of</str<strong>on</strong>g> his own choice (for<br />

example by means <str<strong>on</strong>g>of</str<strong>on</strong>g> any existing technical specificati<strong>on</strong>s).<br />

If <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturer applies <strong>on</strong>ly a part <str<strong>on</strong>g>of</str<strong>on</strong>g> a harm<strong>on</strong>ised standard<br />

or <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable harm<strong>on</strong>ised standard does not cover<br />

all <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements, <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

exists <strong>on</strong>ly <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> extent <str<strong>on</strong>g>the</str<strong>on</strong>g> standard corresp<strong>on</strong>ds <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

essential requirements.<br />

Compliance with harm<strong>on</strong>ised standards will, according<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> certain <str<strong>on</strong>g>directives</str<strong>on</strong>g>, determine <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable c<strong>on</strong>formity<br />

assessment procedure, which sometimes opens <str<strong>on</strong>g>the</str<strong>on</strong>g> possi-<br />

<strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> c<strong>on</strong>tain a clause<br />

according <str<strong>on</strong>g>to</str<strong>on</strong>g> which a harm<strong>on</strong>ised standard<br />

can be challenged ( 87 ).<br />

* Where a Member State or <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong><br />

c<strong>on</strong>siders that a harm<strong>on</strong>ised standard<br />

does not fully meet <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> matter shall be brought before<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> committee established under Directive<br />

98/34/EC, and, if provided for, <str<strong>on</strong>g>the</str<strong>on</strong>g> sec<str<strong>on</strong>g>to</str<strong>on</strong>g>ral committee,<br />

giving reas<strong>on</strong>s for doing so.<br />

* The committee shall deliver an opini<strong>on</strong> without delay.<br />

4.3. Presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

● C<strong>on</strong>formity with a nati<strong>on</strong>al standard that transposes a<br />

harm<strong>on</strong>ised standard, whose reference has been published,<br />

c<strong>on</strong>fers a presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity with <str<strong>on</strong>g>the</str<strong>on</strong>g> essential<br />

requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable <strong>New</strong> Approach directive that<br />

is covered by such a standard ( 81 ).<br />

● References (such as titles, identificati<strong>on</strong> numbers) <str<strong>on</strong>g>of</str<strong>on</strong>g> harm<strong>on</strong>ised<br />

standards are published in <str<strong>on</strong>g>the</str<strong>on</strong>g> Official Journal for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

directive in questi<strong>on</strong>. An updated list <str<strong>on</strong>g>of</str<strong>on</strong>g> references for each<br />

directive can be found at <str<strong>on</strong>g>the</str<strong>on</strong>g> following Internet address:<br />

● Member States must publish <str<strong>on</strong>g>the</str<strong>on</strong>g> reference <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al<br />

standard that transposes a harm<strong>on</strong>ised standard. It is useful <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

indicate in <str<strong>on</strong>g>the</str<strong>on</strong>g> publicati<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> link with <str<strong>on</strong>g>the</str<strong>on</strong>g> legislati<strong>on</strong> in<br />

questi<strong>on</strong>.<br />

● The applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> harm<strong>on</strong>ised standards, which give a presumpti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity, remains voluntary in <str<strong>on</strong>g>the</str<strong>on</strong>g> field <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>New</strong><br />

Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g>. Thus, <str<strong>on</strong>g>the</str<strong>on</strong>g> product may be manufactured<br />

directly <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements ( 83 ).<br />

bility for c<strong>on</strong>formity assessment without <str<strong>on</strong>g>the</str<strong>on</strong>g> interventi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

a third party or for a larger choice <str<strong>on</strong>g>of</str<strong>on</strong>g> procedures ( 85 ).<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> certain <str<strong>on</strong>g>directives</str<strong>on</strong>g>, nati<strong>on</strong>al standards may<br />

give a presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity – as a transiti<strong>on</strong>al measure<br />

– ins<str<strong>on</strong>g>of</str<strong>on</strong>g>ar as <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no harm<strong>on</strong>ised standard covering<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> same area ( 86 ). Member States may communicate <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> text <str<strong>on</strong>g>of</str<strong>on</strong>g> those nati<strong>on</strong>al standards, which<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y c<strong>on</strong>sider <str<strong>on</strong>g>to</str<strong>on</strong>g> meet <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements. After c<strong>on</strong>sulting<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Committee under Directive 98/34/EC and, if provided<br />

for, <str<strong>on</strong>g>the</str<strong>on</strong>g> sec<str<strong>on</strong>g>to</str<strong>on</strong>g>ral Committee, <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> notifies<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Member States whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r or not <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al standard<br />

should enjoy presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity. If <str<strong>on</strong>g>the</str<strong>on</strong>g> opini<strong>on</strong> is<br />

positive, Member States are required <str<strong>on</strong>g>to</str<strong>on</strong>g> publish references<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> such standards. The reference is also published in <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Official Journal. This procedure has not been used so far in<br />

order <str<strong>on</strong>g>to</str<strong>on</strong>g> give full priority <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> development <str<strong>on</strong>g>of</str<strong>on</strong>g> European<br />

standards.<br />

4.4. Withdrawal <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

● The Commissi<strong>on</strong> withdraws <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity,<br />

if it has been established that <str<strong>on</strong>g>the</str<strong>on</strong>g> harm<strong>on</strong>ised standard does<br />

not fully meet <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements.<br />

* In <str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> committee’s opini<strong>on</strong>, <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong><br />

shall inform <str<strong>on</strong>g>the</str<strong>on</strong>g> Member States who shall take necessary<br />

measures.<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> document, and by<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> withdrawal <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

c<strong>on</strong>flicting nati<strong>on</strong>al<br />

standards. However, it<br />

is acceptable <str<strong>on</strong>g>to</str<strong>on</strong>g> retain<br />

or publish a nati<strong>on</strong>al<br />

standard dealing with a<br />

subject covered by <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

harm<strong>on</strong>isati<strong>on</strong><br />

document, provided<br />

that it has technically<br />

equivalent c<strong>on</strong>tents. In<br />

additi<strong>on</strong>, harm<strong>on</strong>isati<strong>on</strong><br />

documents allow for<br />

nati<strong>on</strong>al divergences<br />

under special<br />

c<strong>on</strong>diti<strong>on</strong>s, which<br />

could create some<br />

applicati<strong>on</strong> problems if<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y were accepted as<br />

harm<strong>on</strong>ised standards.<br />

Publicly available<br />

specificati<strong>on</strong>s, which<br />

are adopted by private<br />

c<strong>on</strong>sortia <str<strong>on</strong>g>of</str<strong>on</strong>g> companies,<br />

or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r documents<br />

from European<br />

standards<br />

organisati<strong>on</strong>s, are not<br />

harm<strong>on</strong>ised standards<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> meaning <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

<strong>New</strong> Approach.<br />

( 77 ) The term ‘mandate’,<br />

although comm<strong>on</strong>, is<br />

not <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>on</strong>ly term used<br />

in this c<strong>on</strong>text. Ra<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

than focusing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

terminology, it is<br />

important <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>sider<br />

that standardisati<strong>on</strong><br />

activities must be<br />

( 78 ) The revisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>se <str<strong>on</strong>g>Guide</str<strong>on</strong>g>lines is<br />

underway. The basic<br />

principles laid down in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>Guide</str<strong>on</strong>g>lines have<br />

been reinforced by <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Council c<strong>on</strong>clusi<strong>on</strong>s <strong>on</strong><br />

efficiency and<br />

accountability in<br />

European<br />

standardisati<strong>on</strong> that<br />

were adopted <strong>on</strong> 18<br />

May 1998.<br />
