9.1. Agreement <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> European Ec<strong>on</strong>omic Area<br />

● The Agreement <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> European Ec<strong>on</strong>omic Area is established<br />

between <str<strong>on</strong>g>the</str<strong>on</strong>g> European Community and Iceland, Liechtenstein<br />

and Norway. The Agreement extends <str<strong>on</strong>g>the</str<strong>on</strong>g> single market<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se three EFTA States.<br />

experts <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se States in <str<strong>on</strong>g>the</str<strong>on</strong>g> same way as<br />

it seeks advice from experts <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Member<br />

States. As regards <str<strong>on</strong>g>the</str<strong>on</strong>g> committees assisting<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> in its work, close cooperati<strong>on</strong><br />

has been established. The EEA<br />

Council meets biannually, and <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA Joint<br />

Parliamentary Committee and <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA C<strong>on</strong>sultative<br />

Committee regularly.<br />

9.1.1. Basic elements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Agreement<br />

The Agreement <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> European Ec<strong>on</strong>omic Area, in force<br />

since 1 January 1994, covers all <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g>,<br />

and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r Community legislati<strong>on</strong> and acquis relevant <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

free circulati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> products. Hence, it extends <str<strong>on</strong>g>the</str<strong>on</strong>g> single<br />

market <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> so-called EEA EFTA States: Iceland, Liechtenstein<br />

and Norway.<br />

The objective <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA Agreement is <str<strong>on</strong>g>to</str<strong>on</strong>g> establish a<br />

dynamic and homogeneous European Ec<strong>on</strong>omic Area,<br />

<str<strong>on</strong>g>based</str<strong>on</strong>g> <strong>on</strong> comm<strong>on</strong> rules and equal c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> competiti<strong>on</strong>.<br />

The Agreement is amended <strong>on</strong> a c<strong>on</strong>tinuous basis<br />

through decisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA Joint Committee following<br />

changes in relevant Community legislati<strong>on</strong>. To arrive at and<br />

maintain a uniform interpretati<strong>on</strong> and applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Agreement an EFTA Court and an EFTA Surveillance Authority<br />

have been established.<br />

Rights c<strong>on</strong>ferred and obligati<strong>on</strong>s imposed up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Member States, or <str<strong>on</strong>g>the</str<strong>on</strong>g>ir public entities, undertakings, or<br />

individuals in relati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> each o<str<strong>on</strong>g>the</str<strong>on</strong>g>r, are, according <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

EEA Agreement, unders<str<strong>on</strong>g>to</str<strong>on</strong>g>od <str<strong>on</strong>g>to</str<strong>on</strong>g> be c<strong>on</strong>ferred or imposed in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> same way also up<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States. This ensures<br />

that <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States, and <str<strong>on</strong>g>the</str<strong>on</strong>g>ir ec<strong>on</strong>omic opera<str<strong>on</strong>g>to</str<strong>on</strong>g>rs,<br />

are subject <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> same rights and obligati<strong>on</strong>s as <str<strong>on</strong>g>the</str<strong>on</strong>g>ir counterparts<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> Community. For instance, <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>New</strong> Approach<br />

<str<strong>on</strong>g>directives</str<strong>on</strong>g> are applied in exactly <str<strong>on</strong>g>the</str<strong>on</strong>g> same way in <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA<br />

EFTA States as in <str<strong>on</strong>g>the</str<strong>on</strong>g> Member States — although <str<strong>on</strong>g>the</str<strong>on</strong>g> administrative<br />

procedures c<strong>on</strong>cerning notificati<strong>on</strong> bodies and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

safeguard clause are modified. Therefore, all guidance<br />

applicable <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Member States according <str<strong>on</strong>g>to</str<strong>on</strong>g> this <str<strong>on</strong>g>Guide</str<strong>on</strong>g><br />

applies also <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States.<br />

For <str<strong>on</strong>g>the</str<strong>on</strong>g> purpose <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA Agreement references <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Community or <str<strong>on</strong>g>the</str<strong>on</strong>g> comm<strong>on</strong> market in <str<strong>on</strong>g>the</str<strong>on</strong>g> EU/EEA acts are<br />

unders<str<strong>on</strong>g>to</str<strong>on</strong>g>od <str<strong>on</strong>g>to</str<strong>on</strong>g> be references <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> terri<str<strong>on</strong>g>to</str<strong>on</strong>g>ries <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> C<strong>on</strong>tracting<br />

Parties. Accordingly, a product is not <strong>on</strong>ly placed<br />

<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> Community market, but <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA market.<br />

The EEA Agreement ensures a close cooperati<strong>on</strong><br />

between <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> administrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA<br />

EFTA States. The Commissi<strong>on</strong> seeks informal advice from<br />

9.1.2. Notificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> bodies<br />

Procedures for notificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity assessment bodies<br />

from <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States have been established <str<strong>on</strong>g>based</str<strong>on</strong>g><br />

<strong>on</strong> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA Agreement. The request for allocati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> an identificati<strong>on</strong> number is first presented <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

EFTA Secretariat, applying <str<strong>on</strong>g>the</str<strong>on</strong>g> same notificati<strong>on</strong> form as in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Community. The Secretariat verifies its formal correctness<br />

and transmits <str<strong>on</strong>g>the</str<strong>on</strong>g> applicati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> with<br />

a request for an identificati<strong>on</strong> number (or for an extensi<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> identificati<strong>on</strong> number <str<strong>on</strong>g>to</str<strong>on</strong>g> new<br />

<str<strong>on</strong>g>directives</str<strong>on</strong>g>/tasks). The Commissi<strong>on</strong> allocates <str<strong>on</strong>g>the</str<strong>on</strong>g> number<br />

and communicates it via <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretariat <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> notifying<br />

country. After this <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA State makes a formal notificati<strong>on</strong><br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r EEA EFTA States, <str<strong>on</strong>g>the</str<strong>on</strong>g> EFTA Surveillance<br />

Authority and <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretariat. The Surveillance Authority<br />

examines <str<strong>on</strong>g>the</str<strong>on</strong>g> notificati<strong>on</strong> and informs <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong>,<br />

which keeps an updated list <str<strong>on</strong>g>of</str<strong>on</strong>g> notified bodies from <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Member States and <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States, and publishes it<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> Official Journal.<br />

When a notified body ceases <str<strong>on</strong>g>to</str<strong>on</strong>g> fulfil <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements or<br />

its obligati<strong>on</strong>s, <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA State has <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

withdraw <str<strong>on</strong>g>the</str<strong>on</strong>g> notificati<strong>on</strong>. The Member State must also publish<br />

this informati<strong>on</strong>, and inform <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r EEA EFTA States,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> EFTA Surveillance Authority and <str<strong>on</strong>g>the</str<strong>on</strong>g> Secretariat. The<br />

Surveillance Authority informs <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

withdrawal, which will <str<strong>on</strong>g>the</str<strong>on</strong>g>n update <str<strong>on</strong>g>the</str<strong>on</strong>g> list <str<strong>on</strong>g>of</str<strong>on</strong>g> notified bodies.<br />

9.1.3. Safeguard clause procedure<br />

The EFTA Surveillance Authority is resp<strong>on</strong>sible for <str<strong>on</strong>g>the</str<strong>on</strong>g> examinati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> safeguard clause notificati<strong>on</strong>s from <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA<br />

EFTA States. The Authority c<strong>on</strong>sults all parties c<strong>on</strong>cerned<br />

and exchanges informati<strong>on</strong> with <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> proceedings<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> case. The Authority transmits its decisi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> EEA EFTA States and <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> for fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

acti<strong>on</strong>s. If an EEA EFTA State does not follow <str<strong>on</strong>g>the</str<strong>on</strong>g> decisi<strong>on</strong>,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Surveillance Authority can initiate an infringement<br />

procedure.<br />

In cases where a Member State triggers a safeguard<br />
