burden. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, failure <str<strong>on</strong>g>to</str<strong>on</strong>g> present <str<strong>on</strong>g>the</str<strong>on</strong>g> documentati<strong>on</strong> in<br />

resp<strong>on</strong>se <str<strong>on</strong>g>to</str<strong>on</strong>g> a duly substantiated request by a nati<strong>on</strong>al surveillance<br />

authority, within an acceptable delay, may c<strong>on</strong>stitute<br />

sufficient grounds for doubting <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> directive ( 147 ).<br />

A nati<strong>on</strong>al authority may request a translati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

technical documentati<strong>on</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> EC declarati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity<br />

in<str<strong>on</strong>g>to</str<strong>on</strong>g> its <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial language. However, it should avoid<br />

doing so if <str<strong>on</strong>g>the</str<strong>on</strong>g>y, especially <str<strong>on</strong>g>the</str<strong>on</strong>g> detailed technical informati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> documentati<strong>on</strong>, are available in a language that<br />

can be unders<str<strong>on</strong>g>to</str<strong>on</strong>g>od by <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al authority in questi<strong>on</strong>. If<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> authority c<strong>on</strong>siders a translati<strong>on</strong> necessary, it must<br />

clearly define <str<strong>on</strong>g>the</str<strong>on</strong>g> part <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> documentati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> be translated<br />

and allow reas<strong>on</strong>able time for this <str<strong>on</strong>g>to</str<strong>on</strong>g> take place. No fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

c<strong>on</strong>diti<strong>on</strong>s may be imposed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> translati<strong>on</strong>, such as<br />

a requirement <str<strong>on</strong>g>of</str<strong>on</strong>g> a transla<str<strong>on</strong>g>to</str<strong>on</strong>g>r accredited or recognised by<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> public authorities. The request for a translati<strong>on</strong> must be<br />

assessed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 28 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty <strong>on</strong> a<br />

case by case basis, taking in<str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>siderati<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> proporti<strong>on</strong>ality<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> demands.<br />

It must be possible <str<strong>on</strong>g>to</str<strong>on</strong>g> make <str<strong>on</strong>g>the</str<strong>on</strong>g> technical documentati<strong>on</strong><br />

available in <str<strong>on</strong>g>the</str<strong>on</strong>g> Community. However, it need not be<br />

kept inside <str<strong>on</strong>g>the</str<strong>on</strong>g> Community, unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise provided for in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g> ( 148 ). The requirement for making<br />

it available does not mean that <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> who bears this<br />

resp<strong>on</strong>sibility must be in possessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> it, as l<strong>on</strong>g as he is<br />

capable <str<strong>on</strong>g>of</str<strong>on</strong>g> stating where it can be found and <str<strong>on</strong>g>of</str<strong>on</strong>g> presenting<br />

it <strong>on</strong> request from <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al authority. The name and<br />

address <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong> in possessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> documentati<strong>on</strong><br />

need not be expressly menti<strong>on</strong>ed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> product or <strong>on</strong> its<br />

packaging, unless o<str<strong>on</strong>g>the</str<strong>on</strong>g>rwise specified. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, <str<strong>on</strong>g>the</str<strong>on</strong>g> technical<br />

documentati<strong>on</strong> can be kept in any format (for example<br />

as a hard copy or CD-ROM), which allows it <str<strong>on</strong>g>to</str<strong>on</strong>g> be made<br />

available within a period <str<strong>on</strong>g>of</str<strong>on</strong>g> time commensurate with its<br />

importance and <str<strong>on</strong>g>the</str<strong>on</strong>g> risk in questi<strong>on</strong>.<br />

Member States must ensure that every<strong>on</strong>e receiving<br />

informati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tents <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> technical documentati<strong>on</strong><br />

during market surveillance is bound <str<strong>on</strong>g>to</str<strong>on</strong>g> secrecy according<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> principles laid down in <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al legislati<strong>on</strong>.<br />

( 147 ) As essential<br />

technical data is <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

c<strong>on</strong>sidered, in<br />

particular: <str<strong>on</strong>g>the</str<strong>on</strong>g> name<br />

and address <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

manufacturer; <str<strong>on</strong>g>the</str<strong>on</strong>g> list<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> harm<strong>on</strong>ised<br />

standards followed or<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r soluti<strong>on</strong>s adopted<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> satisfy <str<strong>on</strong>g>the</str<strong>on</strong>g> essential<br />

requirements; a<br />

descripti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

product; <str<strong>on</strong>g>the</str<strong>on</strong>g> operating<br />

instructi<strong>on</strong>s, if any; and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> overall plan <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

product, if any.<br />
