Although market surveillance cannot, basically, take<br />

place during <str<strong>on</strong>g>the</str<strong>on</strong>g> design and producti<strong>on</strong> stages, <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance<br />

authority may make a check <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> producti<strong>on</strong> premises<br />

after a n<strong>on</strong>-compliance has been discovered <str<strong>on</strong>g>to</str<strong>on</strong>g> verify<br />

whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r or not a c<strong>on</strong>stant error can be established ( 142 ).<br />

O<str<strong>on</strong>g>the</str<strong>on</strong>g>r excepti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> principle that market surveillance<br />

can <strong>on</strong>ly take place after <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturer has taken formal<br />

resp<strong>on</strong>sibility for <str<strong>on</strong>g>the</str<strong>on</strong>g> products are trade fairs, exhibiti<strong>on</strong>s<br />

and dem<strong>on</strong>strati<strong>on</strong>s. Most <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> allow<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> showing <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-compliant products under such circumstances,<br />

provided that a visible sign clearly indicates that<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> products may not be marketed or put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service until<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>y have been made <str<strong>on</strong>g>to</str<strong>on</strong>g> comply, and that adequate measures<br />

are taken during dem<strong>on</strong>strati<strong>on</strong>s, where appropriate,<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> ensure <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>s. Market surveillance<br />

authorities must m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>r that this obligati<strong>on</strong> is respected.<br />

Market surveillance should cover all applicable provisi<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <str<strong>on</strong>g>directives</str<strong>on</strong>g> in questi<strong>on</strong>. To a certain extent formal<br />

checks are sufficient, for example regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> CE<br />

marking and its affixing, <str<strong>on</strong>g>the</str<strong>on</strong>g> availability <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC declarati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity, <str<strong>on</strong>g>the</str<strong>on</strong>g> informati<strong>on</strong> accompanying <str<strong>on</strong>g>the</str<strong>on</strong>g> product<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> correct choice <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity assessment procedures.<br />

More pr<str<strong>on</strong>g>of</str<strong>on</strong>g>ound checks are necessary <str<strong>on</strong>g>to</str<strong>on</strong>g> verify <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

material c<strong>on</strong>formity <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> product, for example regarding<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> correct applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity assessment procedure,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> compliance with <str<strong>on</strong>g>the</str<strong>on</strong>g> essential requirements,<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>tents <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC declarati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity. In<br />

practice, individual market surveillance operati<strong>on</strong>s can<br />

focus <strong>on</strong> certain aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements.<br />

Besides market surveillance operati<strong>on</strong>s, that have as<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>ir explicit object <str<strong>on</strong>g>the</str<strong>on</strong>g> verificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> products placed <strong>on</strong><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> market, o<str<strong>on</strong>g>the</str<strong>on</strong>g>r public mechanisms exist that, although<br />

not directly designed for that aim, can never<str<strong>on</strong>g>the</str<strong>on</strong>g>less have as<br />

a c<strong>on</strong>sequence <str<strong>on</strong>g>the</str<strong>on</strong>g> uncovering <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-compliance ( 143 ).<br />

Labour inspec<str<strong>on</strong>g>to</str<strong>on</strong>g>rates that check safety at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace,<br />

for example, can discover that <str<strong>on</strong>g>the</str<strong>on</strong>g> design or c<strong>on</strong>structi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

a machine, or pers<strong>on</strong>al protective equipment bearing <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

CE marking, is not in c<strong>on</strong>formity with <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable requirement<br />

( 144 ). C<strong>on</strong>sequently, <str<strong>on</strong>g>the</str<strong>on</strong>g>y may take measures that<br />

affect <str<strong>on</strong>g>the</str<strong>on</strong>g> placing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market <str<strong>on</strong>g>of</str<strong>on</strong>g> a product and, thus,<br />

carry out market surveillance, or <str<strong>on</strong>g>the</str<strong>on</strong>g>y may c<strong>on</strong>tact <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

surveillance authority that may take <str<strong>on</strong>g>the</str<strong>on</strong>g> necessary<br />

measures. Informati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> compliance <str<strong>on</strong>g>of</str<strong>on</strong>g> a product at<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> moment when it was placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market can also be<br />

obtained during in-use inspecti<strong>on</strong>s, or by analysing <str<strong>on</strong>g>the</str<strong>on</strong>g> fac<str<strong>on</strong>g>to</str<strong>on</strong>g>rs<br />

that caused an accident. Complaints from c<strong>on</strong>sumers<br />

or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r users about <str<strong>on</strong>g>the</str<strong>on</strong>g> product, or from manufacturers or<br />

distribu<str<strong>on</strong>g>to</str<strong>on</strong>g>rs about unfair competiti<strong>on</strong> can also provide informati<strong>on</strong><br />

for market surveillance purposes.<br />

M<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring <str<strong>on</strong>g>of</str<strong>on</strong>g> products placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market may be<br />

divided between several authorities <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al level, for<br />

example functi<strong>on</strong>ally or geographically. Where <str<strong>on</strong>g>the</str<strong>on</strong>g> same<br />

products are subject <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>trol by more than <strong>on</strong>e authority<br />

(for example cus<str<strong>on</strong>g>to</str<strong>on</strong>g>ms and a sec<str<strong>on</strong>g>to</str<strong>on</strong>g>ral authority, or local<br />

authorities), coordinati<strong>on</strong> between services within a<br />

Member State is necessary.<br />

Voluntary initiatives, such as product certificati<strong>on</strong> or<br />

applicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a quality system, cannot be put <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> same<br />

footing as surveillance activities carried out by an authority.<br />

Still, <str<strong>on</strong>g>the</str<strong>on</strong>g>y can c<strong>on</strong>tribute <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> eliminati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> risks. However,<br />

market surveillance authorities must be impartial, in<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> light <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 28 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty, regarding all voluntary<br />

marks, labels and arrangements, and <str<strong>on</strong>g>the</str<strong>on</strong>g>y may <strong>on</strong>ly be<br />

taken in<str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>siderati<strong>on</strong>, in a transparent and n<strong>on</strong>-discrimina<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

way, for <str<strong>on</strong>g>the</str<strong>on</strong>g> risk assessment. Accordingly, products<br />

may not be excluded from market surveillance operati<strong>on</strong>s<br />

even if <str<strong>on</strong>g>the</str<strong>on</strong>g>y have been subject <str<strong>on</strong>g>to</str<strong>on</strong>g> voluntary certificati<strong>on</strong> or<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r voluntary initiatives.<br />

<strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> provide for two different <str<strong>on</strong>g>to</str<strong>on</strong>g>ols<br />

that enable surveillance authorities <str<strong>on</strong>g>to</str<strong>on</strong>g> receive informati<strong>on</strong><br />

<strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> product: <str<strong>on</strong>g>the</str<strong>on</strong>g> EC declarati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

technical documentati<strong>on</strong>. These must be made available by<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturer, <str<strong>on</strong>g>the</str<strong>on</strong>g> authorised representative established<br />

within <str<strong>on</strong>g>the</str<strong>on</strong>g> Community, or under certain circumstances by<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> importer or pers<strong>on</strong> resp<strong>on</strong>sible for placing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market.<br />

O<str<strong>on</strong>g>the</str<strong>on</strong>g>r natural or legal pers<strong>on</strong>s, such as notified bodies,<br />

distribu<str<strong>on</strong>g>to</str<strong>on</strong>g>rs, retailers, suppliers or subc<strong>on</strong>trac<str<strong>on</strong>g>to</str<strong>on</strong>g>rs, cannot<br />

be obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> make <str<strong>on</strong>g>the</str<strong>on</strong>g>se available. However, <str<strong>on</strong>g>the</str<strong>on</strong>g>y can<br />

assist <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority in obtaining <str<strong>on</strong>g>the</str<strong>on</strong>g>m. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority may request <str<strong>on</strong>g>the</str<strong>on</strong>g> notified body <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

provide informati<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity assessment<br />

for <str<strong>on</strong>g>the</str<strong>on</strong>g> product in questi<strong>on</strong> ( 145 ).<br />

The EC declarati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity must be made available<br />

for <str<strong>on</strong>g>the</str<strong>on</strong>g> market surveillance authority immediately up<strong>on</strong><br />

request. Therefore, it should be kept inside <str<strong>on</strong>g>the</str<strong>on</strong>g> Community.<br />

It can be made available for surveillance purposes in each<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Member States, for instance, by means <str<strong>on</strong>g>of</str<strong>on</strong>g> administrative<br />

cooperati<strong>on</strong>. A failure <str<strong>on</strong>g>to</str<strong>on</strong>g> present <str<strong>on</strong>g>the</str<strong>on</strong>g> declarati<strong>on</strong><br />

when requested by a nati<strong>on</strong>al surveillance authority may<br />

c<strong>on</strong>stitute sufficient grounds for doubting <str<strong>on</strong>g>the</str<strong>on</strong>g> presumpti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity with <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> directive ( 146 ).<br />

The technical documentati<strong>on</strong> must be made available <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority within a period <str<strong>on</strong>g>of</str<strong>on</strong>g> time commensurate<br />

with its importance and <str<strong>on</strong>g>the</str<strong>on</strong>g> risk in questi<strong>on</strong>, but <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

authority cannot request it systematically. In general, it can<br />

be requested <strong>on</strong>ly during random checks made for market<br />

surveillance purposes, or when <str<strong>on</strong>g>the</str<strong>on</strong>g>re are grounds for a c<strong>on</strong>cern<br />

that a product does not <str<strong>on</strong>g>of</str<strong>on</strong>g>fer <str<strong>on</strong>g>the</str<strong>on</strong>g> level <str<strong>on</strong>g>of</str<strong>on</strong>g> protecti<strong>on</strong><br />

required in all respects. Initially <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority<br />

may be provided with <strong>on</strong>ly a summary <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> technical documentati<strong>on</strong><br />

(<str<strong>on</strong>g>the</str<strong>on</strong>g> essential technical data), if it has been<br />

drawn up, with reas<strong>on</strong>able time allowed for transmissi<strong>on</strong>.<br />

More detailed informati<strong>on</strong> (for example certificates and<br />

decisi<strong>on</strong>s from <str<strong>on</strong>g>the</str<strong>on</strong>g> notified body) can, never<str<strong>on</strong>g>the</str<strong>on</strong>g>less, be<br />

requested in cases <str<strong>on</strong>g>of</str<strong>on</strong>g> serious doubt about <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> product <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Community regulati<strong>on</strong>s. The full technical<br />

documentati<strong>on</strong> should be requested <strong>on</strong>ly where clearly necessary,<br />

and not, for example, when <strong>on</strong>ly a detail has <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

checked. This request has <str<strong>on</strong>g>to</str<strong>on</strong>g> be evaluated in accordance<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> principle <str<strong>on</strong>g>of</str<strong>on</strong>g> proporti<strong>on</strong>ality and, thus, taking in<str<strong>on</strong>g>to</str<strong>on</strong>g><br />
