authority needs <str<strong>on</strong>g>to</str<strong>on</strong>g> have, or have access <str<strong>on</strong>g>to</str<strong>on</strong>g>, a sufficient<br />

number <str<strong>on</strong>g>of</str<strong>on</strong>g> suitably qualified and experienced staff, with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

necessary pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al integrity. To guarantee <str<strong>on</strong>g>the</str<strong>on</strong>g> quality <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> test data, <str<strong>on</strong>g>the</str<strong>on</strong>g> testing facility used by <str<strong>on</strong>g>the</str<strong>on</strong>g> authority should<br />

comply with <str<strong>on</strong>g>the</str<strong>on</strong>g> relevant criteria <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EN 45001 standard.<br />

The authority should also be independent, and carry out its<br />

operati<strong>on</strong>s in an impartial and n<strong>on</strong>-discrimina<str<strong>on</strong>g>to</str<strong>on</strong>g>ry way. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> authority should carry out market surveillance respecting<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> principle <str<strong>on</strong>g>of</str<strong>on</strong>g> proporti<strong>on</strong>ality, for example acti<strong>on</strong><br />

must be in accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> degree <str<strong>on</strong>g>of</str<strong>on</strong>g> risk or n<strong>on</strong>compliance<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g> impact <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> free circulati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

products may not be more than is necessary for achieving<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> objectives <str<strong>on</strong>g>of</str<strong>on</strong>g> market surveillance.<br />

The surveillance authority may subc<strong>on</strong>tract technical<br />

tasks (such as testing or inspecti<strong>on</strong>) <str<strong>on</strong>g>to</str<strong>on</strong>g> ano<str<strong>on</strong>g>the</str<strong>on</strong>g>r body, provided<br />

that it retains <str<strong>on</strong>g>the</str<strong>on</strong>g> resp<strong>on</strong>sibility for its decisi<strong>on</strong>s, and provided<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g>re is no c<strong>on</strong>flict <str<strong>on</strong>g>of</str<strong>on</strong>g> interest between <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r body’s<br />

c<strong>on</strong>formity assessment activities and its surveillance tasks.<br />

In doing so <str<strong>on</strong>g>the</str<strong>on</strong>g> authority should exercise great care <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure<br />

that <str<strong>on</strong>g>the</str<strong>on</strong>g> impartiality <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> advice it receives is bey<strong>on</strong>d reproach.<br />

The resp<strong>on</strong>sibility for any decisi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> be taken <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

basis <str<strong>on</strong>g>of</str<strong>on</strong>g> such advice shall reside in <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority.<br />

As a general rule, it is inappropriate for notified bodies<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> be resp<strong>on</strong>sible for market surveillance. In order <str<strong>on</strong>g>to</str<strong>on</strong>g> avoid<br />

a c<strong>on</strong>flict <str<strong>on</strong>g>of</str<strong>on</strong>g> interest it is necessary <str<strong>on</strong>g>to</str<strong>on</strong>g> make a clear distincti<strong>on</strong><br />

between c<strong>on</strong>formity assessment (which takes place<br />

before <str<strong>on</strong>g>the</str<strong>on</strong>g> product is placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market) and market surveillance<br />

(which takes place after <str<strong>on</strong>g>the</str<strong>on</strong>g> product has been<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market). As an excepti<strong>on</strong>, where a notified<br />

body and a market surveillance authority come under <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

same superior authority in a Member State, <str<strong>on</strong>g>the</str<strong>on</strong>g> lines <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

resp<strong>on</strong>sibility should be so organised that <str<strong>on</strong>g>the</str<strong>on</strong>g>re is no<br />

c<strong>on</strong>flict <str<strong>on</strong>g>of</str<strong>on</strong>g> interest between <str<strong>on</strong>g>the</str<strong>on</strong>g>se activities.<br />

<strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> include certain provisi<strong>on</strong>s that<br />

require Member States <str<strong>on</strong>g>to</str<strong>on</strong>g> inform <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> or <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r Member States, but <str<strong>on</strong>g>the</str<strong>on</strong>g>y usually say nothing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

c<strong>on</strong>fidentiality or transparency <str<strong>on</strong>g>of</str<strong>on</strong>g> informati<strong>on</strong> obtained<br />

during market surveillance operati<strong>on</strong>s ( 137 ). C<strong>on</strong>sequently,<br />

rules <strong>on</strong> c<strong>on</strong>fidentiality are <str<strong>on</strong>g>based</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> nati<strong>on</strong>al legal<br />

systems, and <str<strong>on</strong>g>the</str<strong>on</strong>g>refore vary between Member States.<br />

However, informati<strong>on</strong> <strong>on</strong> activities underway that c<strong>on</strong>cern<br />

individual ec<strong>on</strong>omic opera<str<strong>on</strong>g>to</str<strong>on</strong>g>rs should generally be c<strong>on</strong>sidered<br />

as c<strong>on</strong>fidential. An excepti<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> this may be justified<br />

where <str<strong>on</strong>g>the</str<strong>on</strong>g> health and safety <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>sumers is subject <str<strong>on</strong>g>to</str<strong>on</strong>g> serious<br />

and immediate danger.<br />

8.2. Market surveillance activities<br />

● Market surveillance involves two main stages:<br />

* nati<strong>on</strong>al surveillance authorities shall m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>r that products<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market comply with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

applicable nati<strong>on</strong>al legislati<strong>on</strong> transposing <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>New</strong> Approach<br />

<str<strong>on</strong>g>directives</str<strong>on</strong>g>;<br />

* subsequently, when necessary, <str<strong>on</strong>g>the</str<strong>on</strong>g>y shall take acti<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

establish c<strong>on</strong>formity.<br />

● Although market surveillance operati<strong>on</strong>s cannot take place<br />

during <str<strong>on</strong>g>the</str<strong>on</strong>g> design and product stages, efficient enforcement<br />

usually requires that surveillance authorities act in collaborati<strong>on</strong><br />

with manufacturers and suppliers in order <str<strong>on</strong>g>to</str<strong>on</strong>g> prevent <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

placing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market <str<strong>on</strong>g>of</str<strong>on</strong>g> n<strong>on</strong>-compliant products.<br />

8.2.1. M<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring <str<strong>on</strong>g>of</str<strong>on</strong>g> products placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market<br />

● The objective <str<strong>on</strong>g>of</str<strong>on</strong>g> m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring products placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market is<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> verify that <str<strong>on</strong>g>the</str<strong>on</strong>g>y comply with applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g> at <str<strong>on</strong>g>the</str<strong>on</strong>g> moment<br />

when placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market and, if relevant, when put in<str<strong>on</strong>g>to</str<strong>on</strong>g><br />

service.<br />

● The EC declarati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity and <str<strong>on</strong>g>the</str<strong>on</strong>g> technical documentati<strong>on</strong><br />

provide <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance authority with necessary<br />

informati<strong>on</strong> about <str<strong>on</strong>g>the</str<strong>on</strong>g> product.<br />

Market surveillance authorities must m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>r products<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market. The aim is <str<strong>on</strong>g>to</str<strong>on</strong>g> find out whe<str<strong>on</strong>g>the</str<strong>on</strong>g>r or not<br />

a product complies with <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable provisi<strong>on</strong>s at <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

moment when placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market and, if<br />

relevant, when put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service ( 138 ). Basically,<br />

market surveillance cannot take place<br />

during <str<strong>on</strong>g>the</str<strong>on</strong>g> design and producti<strong>on</strong> stages,<br />

that is before <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturer has taken<br />

formal resp<strong>on</strong>sibility for <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> products, usually by affixing <str<strong>on</strong>g>the</str<strong>on</strong>g> CE<br />

marking. However, this does not exclude<br />

collaborati<strong>on</strong> between <str<strong>on</strong>g>the</str<strong>on</strong>g> surveillance<br />

authority and <str<strong>on</strong>g>the</str<strong>on</strong>g> manufacturers and suppliers<br />

( 139 ).<br />

For market surveillance <str<strong>on</strong>g>to</str<strong>on</strong>g> be efficient,<br />

resources should be c<strong>on</strong>centrated where<br />

risks are likely <str<strong>on</strong>g>to</str<strong>on</strong>g> be higher or n<strong>on</strong>-compliance<br />

more frequent, or where a particular<br />

interest can be identified. Statistics and risk<br />

assessment procedures can be used for<br />

this purpose. To be able <str<strong>on</strong>g>to</str<strong>on</strong>g> m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>r products<br />

placed <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market, surveillance<br />

authorities shall have <str<strong>on</strong>g>the</str<strong>on</strong>g> power, competence<br />

and resources:<br />

● <str<strong>on</strong>g>to</str<strong>on</strong>g> regularly visit commercial, industrial<br />

and s<str<strong>on</strong>g>to</str<strong>on</strong>g>rage premises;<br />

● <str<strong>on</strong>g>to</str<strong>on</strong>g> regularly visit, if appropriate, work<br />

places and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r premises where products<br />

are put in<str<strong>on</strong>g>to</str<strong>on</strong>g> service ( 140 );<br />

● <str<strong>on</strong>g>to</str<strong>on</strong>g> organise random and spot checks;<br />

● <str<strong>on</strong>g>to</str<strong>on</strong>g> take samples <str<strong>on</strong>g>of</str<strong>on</strong>g> products, and <str<strong>on</strong>g>to</str<strong>on</strong>g> subject <str<strong>on</strong>g>the</str<strong>on</strong>g>m <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

examinati<strong>on</strong> and testing; and<br />

● <str<strong>on</strong>g>to</str<strong>on</strong>g> require all necessary informati<strong>on</strong> ( 141 ).<br />
