9.1.4. Mutual recogniti<strong>on</strong> agreements and European<br />

c<strong>on</strong>formity assessment pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols<br />

The mandate from <str<strong>on</strong>g>the</str<strong>on</strong>g> Council <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> negotiate<br />

mutual recogniti<strong>on</strong> agreements and European c<strong>on</strong>formity<br />

assessment pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols indicated <str<strong>on</strong>g>the</str<strong>on</strong>g> objective that<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> third countries c<strong>on</strong>cerned will c<strong>on</strong>clude with <str<strong>on</strong>g>the</str<strong>on</strong>g> EEA<br />

EFTA States parallel agreements and pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols equivalent<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> those <str<strong>on</strong>g>to</str<strong>on</strong>g> be c<strong>on</strong>cluded with <str<strong>on</strong>g>the</str<strong>on</strong>g> Community, and which<br />

will, possibly, have <str<strong>on</strong>g>the</str<strong>on</strong>g> same date for entry in<str<strong>on</strong>g>to</str<strong>on</strong>g> force ( 189 ).<br />

The system <str<strong>on</strong>g>of</str<strong>on</strong>g> parallel agreements and pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols formally<br />

grants <str<strong>on</strong>g>the</str<strong>on</strong>g> third country c<strong>on</strong>cerned <str<strong>on</strong>g>the</str<strong>on</strong>g> same market<br />

access throughout <str<strong>on</strong>g>the</str<strong>on</strong>g> European Ec<strong>on</strong>omic Area for products<br />

covered by <str<strong>on</strong>g>the</str<strong>on</strong>g> mutual recogniti<strong>on</strong> agreements or European<br />

c<strong>on</strong>formity assessment pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols. As <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> practical<br />

<str<strong>on</strong>g>implementati<strong>on</strong></str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>se agreements and pro<str<strong>on</strong>g>to</str<strong>on</strong>g>cols, comm<strong>on</strong><br />

sessi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Joint Committee meetings with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

third country c<strong>on</strong>cerned will be arranged.<br />

The Community in its relati<strong>on</strong>s with third<br />

countries endeavours <str<strong>on</strong>g>to</str<strong>on</strong>g> promote internati<strong>on</strong>al<br />

trade in regulated products, in particular<br />

by c<strong>on</strong>cluding mutual recogniti<strong>on</strong><br />

agreements (MRAs) <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> Article<br />

133 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty.<br />

MRAs are designed so that each party<br />

shall accept <str<strong>on</strong>g>the</str<strong>on</strong>g> reports, certificates and<br />

marks that are in accordance with its own<br />

legislati<strong>on</strong>. These are drawn up and issued<br />

by bodies that <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r party has designated<br />

under <str<strong>on</strong>g>the</str<strong>on</strong>g> MRA for assessing c<strong>on</strong>formity<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> field(s) covered by <str<strong>on</strong>g>the</str<strong>on</strong>g> MRA. This can<br />

be achieved, because MRAs include all <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>formity<br />

assessment requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> parties necessary <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

obtain full market access ( 190 ), and <str<strong>on</strong>g>the</str<strong>on</strong>g> products are evaluated<br />

in <str<strong>on</strong>g>the</str<strong>on</strong>g> country <str<strong>on</strong>g>of</str<strong>on</strong>g> producti<strong>on</strong> against <str<strong>on</strong>g>the</str<strong>on</strong>g> regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r party.<br />

MRAs cover <str<strong>on</strong>g>the</str<strong>on</strong>g> entire terri<str<strong>on</strong>g>to</str<strong>on</strong>g>ry <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> parties in order <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

guarantee, in particular in States with a federal structure,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> full free movement <str<strong>on</strong>g>of</str<strong>on</strong>g> products certified <str<strong>on</strong>g>to</str<strong>on</strong>g> be in c<strong>on</strong>formity.<br />

As a general rule, MRAs are limited <str<strong>on</strong>g>to</str<strong>on</strong>g> products that<br />

have <str<strong>on</strong>g>the</str<strong>on</strong>g>ir origin <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> terri<str<strong>on</strong>g>to</str<strong>on</strong>g>ry <str<strong>on</strong>g>of</str<strong>on</strong>g> ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r party ( 191 ).<br />

MRAs apply <str<strong>on</strong>g>to</str<strong>on</strong>g> <strong>on</strong>e or more categories <str<strong>on</strong>g>of</str<strong>on</strong>g> products or<br />

sec<str<strong>on</strong>g>to</str<strong>on</strong>g>rs falling within <str<strong>on</strong>g>the</str<strong>on</strong>g> regulated field (<str<strong>on</strong>g>the</str<strong>on</strong>g>y are covered<br />

by <strong>New</strong> Approach or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r Community technical harm<strong>on</strong>isati<strong>on</strong><br />

<str<strong>on</strong>g>directives</str<strong>on</strong>g> in force) and, in certain cases, by n<strong>on</strong>harm<strong>on</strong>ised<br />

nati<strong>on</strong>al law. In principle MRAs should cover all<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> industrial products for which <str<strong>on</strong>g>the</str<strong>on</strong>g> regulati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> at least<br />

<strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> parties require third party c<strong>on</strong>formity assessment.<br />

MRAs comprise a framework agreement and sec<str<strong>on</strong>g>to</str<strong>on</strong>g>rial<br />

annexes. The framework agreement lays down <str<strong>on</strong>g>the</str<strong>on</strong>g> essential<br />

principles <str<strong>on</strong>g>of</str<strong>on</strong>g> a traditi<strong>on</strong>al agreement. Sec<str<strong>on</strong>g>to</str<strong>on</strong>g>rial annexes<br />

specify, in particular, <str<strong>on</strong>g>the</str<strong>on</strong>g> scope and coverage, regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry requirements,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> list <str<strong>on</strong>g>of</str<strong>on</strong>g> designated c<strong>on</strong>formity assessment<br />

bodies, <str<strong>on</strong>g>the</str<strong>on</strong>g> procedures and authorities resp<strong>on</strong>sible for<br />

9.2. Mutual recogniti<strong>on</strong> agreements<br />

● Mutual recogniti<strong>on</strong> agreements are established between<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> Community and <str<strong>on</strong>g>the</str<strong>on</strong>g> government <str<strong>on</strong>g>of</str<strong>on</strong>g> third countries, which<br />

are <strong>on</strong> a comparable level <str<strong>on</strong>g>of</str<strong>on</strong>g> technical development and have<br />

a compatible approach c<strong>on</strong>cerning c<strong>on</strong>formity assessment.<br />

● These agreements are <str<strong>on</strong>g>based</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> mutual acceptance <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

certificates, marks <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>formity and test reports issued by <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

c<strong>on</strong>formity assessment bodies <str<strong>on</strong>g>of</str<strong>on</strong>g> ei<str<strong>on</strong>g>the</str<strong>on</strong>g>r party in c<strong>on</strong>formity<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> legislati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r party.<br />

designating <str<strong>on</strong>g>the</str<strong>on</strong>g>se bodies and, if applicable, transiti<strong>on</strong>al<br />

periods. More sec<str<strong>on</strong>g>to</str<strong>on</strong>g>rial annexes can be added successively.<br />

MRAs are not <str<strong>on</strong>g>based</str<strong>on</strong>g> <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> necessity <str<strong>on</strong>g>to</str<strong>on</strong>g> mutually accept<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r party’s standards or technical regulati<strong>on</strong>s, or <str<strong>on</strong>g>to</str<strong>on</strong>g> c<strong>on</strong>sider<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> legislati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> two parties as equivalent. However,<br />

MRAs can pave <str<strong>on</strong>g>the</str<strong>on</strong>g> way <str<strong>on</strong>g>to</str<strong>on</strong>g>wards a harm<strong>on</strong>ised system<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> standardisati<strong>on</strong> and certificati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> parties. Never<str<strong>on</strong>g>the</str<strong>on</strong>g>less,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> two legislati<strong>on</strong>s are, as a rule, deemed <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

ensure a comparable level regarding <str<strong>on</strong>g>the</str<strong>on</strong>g> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

health, safety, envir<strong>on</strong>ment or o<str<strong>on</strong>g>the</str<strong>on</strong>g>r public interests. Moreover,<br />

MRAs increase <str<strong>on</strong>g>the</str<strong>on</strong>g> transparency <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry systems,<br />

since <str<strong>on</strong>g>the</str<strong>on</strong>g> different systems are shown <str<strong>on</strong>g>to</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r countries<br />

and <str<strong>on</strong>g>the</str<strong>on</strong>g>y have <str<strong>on</strong>g>to</str<strong>on</strong>g> dem<strong>on</strong>strate coherence.<br />

As a result <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> different c<strong>on</strong>diti<strong>on</strong>s established and<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> interest <str<strong>on</strong>g>of</str<strong>on</strong>g> third countries and <str<strong>on</strong>g>the</str<strong>on</strong>g> Community, <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong><br />

was authorised in 1992 <str<strong>on</strong>g>to</str<strong>on</strong>g> negotiate with <str<strong>on</strong>g>the</str<strong>on</strong>g> following<br />

countries: United States, Japan, Canada, Australia,<br />

<strong>New</strong> Zealand, H<strong>on</strong>g K<strong>on</strong>g, Israel, Singapore, Philippines,<br />

South Korea and Switzerland.<br />

At <str<strong>on</strong>g>the</str<strong>on</strong>g> time <str<strong>on</strong>g>of</str<strong>on</strong>g> writing (May 1999), <str<strong>on</strong>g>the</str<strong>on</strong>g> Commissi<strong>on</strong> has<br />

finalised negotiati<strong>on</strong>s with Australia, <strong>New</strong> Zealand, <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

United States, Canada, Switzerland and Israel ( 192 ), and is<br />

negotiating with Japan. The c<strong>on</strong>cluded MRAs all c<strong>on</strong>tain<br />

commitments <str<strong>on</strong>g>to</str<strong>on</strong>g> fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r negotiati<strong>on</strong>s.<br />
