Many products covered by <strong>New</strong> Approach<br />

<str<strong>on</strong>g>directives</str<strong>on</strong>g> are used at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace.<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>directives</str<strong>on</strong>g> <str<strong>on</strong>g>based</str<strong>on</strong>g> <strong>on</strong> Article<br />

138 <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> EC Treaty ( 65 ), employers have<br />

obligati<strong>on</strong>s as regards <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> work<br />

equipment at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace. An employer is<br />

c<strong>on</strong>sidered <str<strong>on</strong>g>to</str<strong>on</strong>g> be any natural or legal pers<strong>on</strong><br />

who has an employment relati<strong>on</strong>ship with a<br />

worker (that is any pers<strong>on</strong> employed by an<br />

employer), and has resp<strong>on</strong>sibility for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

undertaking or establishment.<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum<br />

safety and health requirements for <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> work equipment<br />

by workers at work (89/655/EEC, modificati<strong>on</strong><br />

95/63/EC), <str<strong>on</strong>g>the</str<strong>on</strong>g> employer must take all measures necessary<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> ensure that <str<strong>on</strong>g>the</str<strong>on</strong>g> work equipment (for example<br />

machinery and apparatus) made available <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> workers is<br />

suitable for <str<strong>on</strong>g>the</str<strong>on</strong>g> work carried out, and may be used by workers<br />

without impairment <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir safety or health. The employer<br />

may <strong>on</strong>ly obtain or use work equipment that complies<br />

with <str<strong>on</strong>g>the</str<strong>on</strong>g> provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> applicable <str<strong>on</strong>g>directives</str<strong>on</strong>g>, or, if no<br />

o<str<strong>on</strong>g>the</str<strong>on</strong>g>r directive is applicable or is <strong>on</strong>ly partially applicable,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> minimum requirements laid down in <str<strong>on</strong>g>the</str<strong>on</strong>g> annex <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

Directive 89/655/EEC. The employer must also take <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

necessary measures <str<strong>on</strong>g>to</str<strong>on</strong>g> ensure that work equipment is kept<br />

at such a level. Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r, <str<strong>on</strong>g>the</str<strong>on</strong>g> employer has an obligati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

provide informati<strong>on</strong> and training for workers as regards <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

use <str<strong>on</strong>g>of</str<strong>on</strong>g> work equipment.<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum<br />

health and safety requirements for <str<strong>on</strong>g>the</str<strong>on</strong>g> use <str<strong>on</strong>g>of</str<strong>on</strong>g> pers<strong>on</strong>al protective<br />

equipment by workers at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace<br />

(89/656/EEC), such equipment must comply with <str<strong>on</strong>g>the</str<strong>on</strong>g> relevant<br />

Community provisi<strong>on</strong>s <strong>on</strong> design and manufacture with<br />

respect <str<strong>on</strong>g>to</str<strong>on</strong>g> safety and health (that is <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>New</strong> Approach<br />

Directive relating <str<strong>on</strong>g>to</str<strong>on</strong>g> pers<strong>on</strong>al protective equipment). Fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r,<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> equipment must be appropriate for <str<strong>on</strong>g>the</str<strong>on</strong>g> risk involved, corresp<strong>on</strong>d<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> existing c<strong>on</strong>diti<strong>on</strong>s at <str<strong>on</strong>g>the</str<strong>on</strong>g> workplace, take in<str<strong>on</strong>g>to</str<strong>on</strong>g><br />

account erg<strong>on</strong>omic requirements and <str<strong>on</strong>g>the</str<strong>on</strong>g> worker’s state <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

health, fit <str<strong>on</strong>g>the</str<strong>on</strong>g> wearer correctly, and be compatible where<br />

more than <strong>on</strong>e equipment must be used simultaneously. The<br />

materials and comp<strong>on</strong>ents <str<strong>on</strong>g>of</str<strong>on</strong>g> final products.<br />

Services as such are excluded from<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> scope at present. Sec<strong>on</strong>dly, <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive<br />

applies <strong>on</strong>ly <str<strong>on</strong>g>to</str<strong>on</strong>g> defective products, that<br />

is products not providing <str<strong>on</strong>g>the</str<strong>on</strong>g> safety that a<br />

pers<strong>on</strong> is entitled <str<strong>on</strong>g>to</str<strong>on</strong>g> expect. The fact that<br />

a product is not fit for <str<strong>on</strong>g>the</str<strong>on</strong>g> use expected is<br />

not enough. Only if a product lacks safety,<br />

3.6. User (employer)<br />

● <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> do not lay down obligati<strong>on</strong>s for<br />

users, apart from those related <str<strong>on</strong>g>to</str<strong>on</strong>g> putting in<str<strong>on</strong>g>to</str<strong>on</strong>g> service.<br />

● Community legislati<strong>on</strong> c<strong>on</strong>cerning <str<strong>on</strong>g>the</str<strong>on</strong>g> health and safety <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> workplace has an impact <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> maintenance and use <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

products covered by <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> that are used at<br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> workplace.<br />

3.7. Product liability<br />

employer is required, before choosing <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>al protective<br />

equipment, <str<strong>on</strong>g>to</str<strong>on</strong>g> assess that it satisfies <str<strong>on</strong>g>the</str<strong>on</strong>g> requirements.<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum safety and<br />

health requirements for work with display screen equipment<br />

(90/270/EEC), employers are obliged <str<strong>on</strong>g>to</str<strong>on</strong>g> perform an analysis<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> workstati<strong>on</strong>s in order <str<strong>on</strong>g>to</str<strong>on</strong>g> evaluate <str<strong>on</strong>g>the</str<strong>on</strong>g> safety and health<br />

c<strong>on</strong>diti<strong>on</strong>s, particularly regarding possible risks <str<strong>on</strong>g>to</str<strong>on</strong>g> eyesight,<br />

physical problems and problems <str<strong>on</strong>g>of</str<strong>on</strong>g> mental stress. The<br />

Directive also lays down <str<strong>on</strong>g>the</str<strong>on</strong>g> minimum requirements for <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

display screen and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r equipment.<br />

According <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> introducti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> measures<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> encourage improvements in <str<strong>on</strong>g>the</str<strong>on</strong>g> safety and health <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

workers at work (89/391/EEC), workers have a general<br />

resp<strong>on</strong>sibility <str<strong>on</strong>g>to</str<strong>on</strong>g> take care, as far as possible, <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>ir own<br />

safety and health and that <str<strong>on</strong>g>of</str<strong>on</strong>g> o<str<strong>on</strong>g>the</str<strong>on</strong>g>r pers<strong>on</strong>s affected by <str<strong>on</strong>g>the</str<strong>on</strong>g>ir<br />

acts at work. In accordance with <str<strong>on</strong>g>the</str<strong>on</strong>g> training and <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

instructi<strong>on</strong>s given by <str<strong>on</strong>g>the</str<strong>on</strong>g>ir employer <str<strong>on</strong>g>the</str<strong>on</strong>g>y must, for instance,<br />

make correct use <str<strong>on</strong>g>of</str<strong>on</strong>g> machinery, apparatus, and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r<br />

means <str<strong>on</strong>g>of</str<strong>on</strong>g> producti<strong>on</strong>, and <str<strong>on</strong>g>the</str<strong>on</strong>g> pers<strong>on</strong>al protective equipment.<br />

Directives 89/391/EEC, 89/655/EEC, 89/656/EEC<br />

and 90/270/EEC lay down minimum requirements. Therefore,<br />

Member States are allowed <str<strong>on</strong>g>to</str<strong>on</strong>g> adopt or retain more<br />

stringent provisi<strong>on</strong>s, as l<strong>on</strong>g as <str<strong>on</strong>g>the</str<strong>on</strong>g>y are compatible with <str<strong>on</strong>g>the</str<strong>on</strong>g><br />

EC Treaty. The provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>New</strong> Approach <str<strong>on</strong>g>directives</str<strong>on</strong>g> must<br />

be respected and, thus, additi<strong>on</strong>al nati<strong>on</strong>al provisi<strong>on</strong>s may<br />

nei<str<strong>on</strong>g>the</str<strong>on</strong>g>r request a modificati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a product within <str<strong>on</strong>g>the</str<strong>on</strong>g> scope<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a <strong>New</strong> Approach directive, nor influence <str<strong>on</strong>g>the</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

<str<strong>on</strong>g>the</str<strong>on</strong>g> placing <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g> market <str<strong>on</strong>g>of</str<strong>on</strong>g> such products.<br />

● The Directive <strong>on</strong> product liability covers any product manufactured<br />

or imported in<str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> Community, which causes damage<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> individuals or private property. Thus, <str<strong>on</strong>g>the</str<strong>on</strong>g> Directive<br />

applies also <str<strong>on</strong>g>to</str<strong>on</strong>g> products that fall within <str<strong>on</strong>g>the</str<strong>on</strong>g> scope <str<strong>on</strong>g>of</str<strong>on</strong>g> a <strong>New</strong><br />

Approach directive.<br />

● The Directive <strong>on</strong> product liability establishes a strict liability<br />

regime <strong>on</strong> manufacturers and importers in <str<strong>on</strong>g>the</str<strong>on</strong>g> Community.<br />
