Staff Report
to
Council
Date: October 17, 2011
File: 2240-40
Subject: Request for permission to enter into a Municipal Encroachment Agreement
With the Registered Owner of 2279 Player's Drive, Langford BC
BACKGROUND
The owner (Mr. Nirpal Sidhu, of 2279 Player's Drive) has requsted that the City enter into an
encroachment agreement with the City, regarding an existing mortared masonry wall that was
constructed on Mr. Sidhu's property. When surveyed by Scansa Construction Ltd., the wall was found
to straddle City of Langford property. Please see the attached sketch and photos of wall.
COMMENTARY
As the wall was constructed at the cost of the owner, it is not practical to re-build the wall. The wall as
constructed does not pose any danger to the public. The wall retains existing back fill that is stock
piled nearby adding to usable 'back-yard' space forthe resident (to the extent of the property line).
The terms of the Encroachment Agreement if approved would be for the life of the structure and be an
agreement with the property owner. Any change of owner would result in Council's ability to reconsider
the encroachment. Staff propose to amend the agreement to include the statement that any
costs related to the removal and or repair of the wall would be borne by the owners, not the City.
The retaining wall exceeds 4 feet in height; therefore a professional engineer's review was required and
has been provided.
