Subject: Request for permission to enter into a Municipal Encroachment Agreement<br />
With the Registered Owner <strong>of</strong> 2279 Player's Drive, <strong>Langford</strong> BC<br />
BACKGROUND<br />
The owner (Mr. Nirpal Sidhu, <strong>of</strong> 2279 Player's Drive) has requsted that the <strong>City</strong> enter into an<br />
encroachment agreement with the <strong>City</strong>, regarding an existing mortared masonry wall that was<br />
constructed on Mr. Sidhu's property. When surveyed by Scansa Construction Ltd., the wall was found<br />
to straddle <strong>City</strong> <strong>of</strong> <strong>Langford</strong> property. Please see the attached sketch and photos <strong>of</strong> wall.<br />
COMMENTARY<br />
As the wall was constructed at the cost <strong>of</strong> the owner, it is not practical to re-build the wall. The wall as<br />
constructed does not pose any danger to the public. The wall retains existing back fill that is stock<br />
piled nearby adding to usable 'back-yard' space forthe resident (to the extent <strong>of</strong> the property line).<br />
The terms <strong>of</strong> the Encroachment Agreement if approved would be for the life <strong>of</strong> the structure and be an<br />
agreement with the property owner. Any change <strong>of</strong> owner would result in Council's ability to reconsider<br />
the encroachment. Staff propose to amend the agreement to include the statement that any<br />
costs related to the removal and or repair <strong>of</strong> the wall would be borne by the owners, not the <strong>City</strong>.<br />
The retaining wall exceeds 4 feet in height; therefore a pr<strong>of</strong>essional engineer's review was required and<br />
has been provided.<br />
