Bylaw No. 1373 Page 2 of 2 (5) Notwithstanding subsection 3.05.02(4) of this Bylaw and subject to maximum site coverage regulations in Part 6 of this Bylaw, where an accessory building contains a Secondary Suite permitted by Part 6 and Section 3.08 of this Bylaw on a lot in a Residential Zone or a Comprehensive Development Zone, the floor area of the accessory building may exceed 60 m2 (645 ft2), but the building footprint of the accessory building may not exceed: a) 60 m2 (645 ft2) on lots with an area less than 550 m2 (5920 ft2); b) 65 m2 (700 ft2) on lots with an area greater than or equal to 550 m2 (5920 ft2); c) 80 m2 (861 ft2) on lots with an area greater than or equal to 800 m2 (8611 ft2); or d) 100 m2 (1076 ft2) on lots with an area greater than or equal to 1000 m2 (0.25 acre); and for each additional 100 m2 (1076 ft2) of lot area in excess of 1000 m2 (0.25 acres) the maximum floor area of an accessory building may be increased by 10 m2 (107.6 ft2)." 2. By replacing Sec. 3.05.02(3) with the following: "(3)The height of an accessory building shall not exceed the maximum height for a building or structure permitted in Part 6 of this bylaw, with the exception that: (a) any building that is accessory to a one-or two-family residential use may not exceed a height equal to: i) a single storey, or the height of the principal dwelling if that building is a single storey above grade, or 60% of the height of the principal dwelling if that building is more than a single story above grade; or ii) two storeys, or the maximum height permitted for the principal dwelling where the principal use on the property is a one-family residential dwelling and the lot area is greater than or equal to 1000 m2 (0.25 acres); and (b) any building that is accessory to a multi-family residential use may not exceed a height equal to a single storey, or the height of the principal dwelling if that building is a single storey above grade, or 60% of the height of the principal dwelling if that building is two storeys in height or more above grade."
