(5) Notwithstanding subsection 3.05.02(4) <strong>of</strong> this Bylaw and subject to maximum site coverage<br />

regulations in Part 6 <strong>of</strong> this Bylaw, where an accessory building contains a Secondary Suite<br />

permitted by Part 6 and Section 3.08 <strong>of</strong> this Bylaw on a lot in a Residential Zone or a<br />

Comprehensive Development Zone, the floor area <strong>of</strong> the accessory building may exceed<br />

60 m2 (645 ft2), but the building footprint <strong>of</strong> the accessory building may not exceed:<br />

a) 60 m2 (645 ft2) on lots with an area less than 550 m2 (5920 ft2);<br />

b) 65 m2 (700 ft2) on lots with an area greater than or equal to 550 m2 (5920 ft2);<br />

c) 80 m2 (861 ft2) on lots with an area greater than or equal to 800 m2 (8611 ft2); or<br />

d) 100 m2 (1076 ft2) on lots with an area greater than or equal to 1000 m2 (0.25 acre);<br />

and for each additional 100 m2 (1076 ft2) <strong>of</strong> lot area in excess <strong>of</strong> 1000 m2 (0.25 acres) the<br />

maximum floor area <strong>of</strong> an accessory building may be increased by 10 m2 (107.6 ft2)."<br />

2. By replacing Sec. 3.05.02(3) with the following:<br />

"(3)The height <strong>of</strong> an accessory building shall not exceed the maximum height for a building or<br />

structure permitted in Part 6 <strong>of</strong> this bylaw, with the exception that:<br />

(a) any building that is accessory to a one-or two-family residential use may not exceed a<br />

height equal to:<br />

i) a single storey, or the height <strong>of</strong> the principal dwelling if that building is a single<br />

storey above grade, or 60% <strong>of</strong> the height <strong>of</strong> the principal dwelling if that building is<br />

more than a single story above grade; or<br />

ii) two storeys, or the maximum height permitted for the principal dwelling where the<br />

principal use on the property is a one-family residential dwelling and the lot area is<br />

greater than or equal to 1000 m2 (0.25 acres); and<br />

(b) any building that is accessory to a multi-family residential use may not exceed a height<br />

equal to a single storey, or the height <strong>of</strong> the principal dwelling if that building is a single<br />

storey above grade, or 60% <strong>of</strong> the height <strong>of</strong> the principal dwelling if that building is two<br />

storeys in height or more above grade."<br />
