BYLAW NO. 1332
A BYLAW TO AUTHORIZE A HOUSING AGREEMENT
WHEREAS the owner of land in the City has applied to rezone the land legally described as
PID No. 000-192-490, Parcel "A" (DD 140453-1), Section 84, Metchosin District, Except Part in
Plan 6521 and Except Parcel No. 1 (DD 1971001) and PID No. 005-396-662, Amended Lot 3
(DD 3161161), Section 84, Metchosin District, Plan 9835 (the "Land") to permit the construction
of ten or more single-family residential dwellings; and
WHEREAS the Council has determined that the rezoning application should be permitted, if a
certain number of the new lots created by subdivision of the rezoned Land were designated for
affordable housing for low-income individuals and families; and
WHEREAS the owner intends to subdivide the Land in accordance with the proposed
subdivision plan attached as Schedule "A"; and
WHEREAS the owner has agreed to restrictions on the occupancy of the dwelling units to be
constructed on the Land as more particularly set out in Schedule "B" to this Bylaw; and
The Council of the City of Langford, in open meeting assembled, enacts as a bylaw under
s. 905 of the Local Government Act as follows:
1. Council hereby authorizes the City to enter into a housing agreement with the owner of
the Land to be registered as a covenant against proposed Lots 1, 20, 21 & 28, shown on
Schedule "A".
2. The Mayor and Administrator of the City are authorized to execute the Form C housing
agreement and the Administrator is authorized to sign and file in the Land Title Office a
notice of the housing agreement, as required by the Local Government Act.
3. All schedules attached to this Bylaw are incorporated into and form a part of this Bylaw.
4. This Bylaw may be cited as "City of Langford Housing Agreement (941 Flatman Avenue
and 3467 Happy Valley Road) Bylaw No. 1332, 2011".
