FINANCIAL IMPLICATIONS If Council agrees to enter into the Encroachment Agreement, there will be no financial implications to the City of Langford. The agreement will clearly state that any costs associated with the fence will be paid by the current owners, as stated above. LEGAL IMPLICATIONS None. OPTIONS That Council direct staff to: 1. Enter into an Encroachment Agreement with the owners of 2279 Player's Drive; OR 2. Decline to enter into an Encroachment Agreement with the owners of 2279 Player's Drive and notify the registered owner of the property to remove the wall. Langford Review of Stone Retaining Wall This letter summarizes our meeting of September 21 at the above site. Of interest is the mortared stone retaining wall along the rear property line. Photos are appended. The grade difference between the front and back of the wall will be approximately 1.0 m. The wall has a substantial base approximately 0.5 m wide. The wall will be backfilled with shotrock stockpiled nearby on the City ofLangford Parks property. The wall is suitable for the intended purpose of retaining higher ground on the City ofLangford properly behind the subject lot. Wall backfill should be graded level w ithin 1.2 m of the property boundary. I trust that this information meets your present requirements.
