does not affect <strong>the</strong> validity or enforceability of <strong>the</strong> modified order of <strong>the</strong> new tribunal having<br />

continuing, exclusive jurisdiction.<br />

Comment<br />

For <strong>the</strong> act <strong>to</strong> function properly, <strong>the</strong> prevailing party in a proceeding that modifies a<br />

controlling order must inform <strong>the</strong> original issuing tribunal about its loss of continuing, exclusive<br />

jurisdiction over its child-support order. Thereafter, <strong>the</strong> original tribunal may not modify, or<br />

review and adjust, <strong>the</strong> amount of child support. Notice <strong>to</strong> <strong>the</strong> issuing tribunal and o<strong>the</strong>r affected<br />

tribunals that <strong>the</strong> continuing, exclusive jurisdiction of <strong>the</strong> former controlling order has been<br />

modified is crucial <strong>to</strong> avoid <strong>the</strong> confusion and chaos of <strong>the</strong> multiple-order system UIFSA<br />

replaced.<br />

The new issuing <strong>the</strong> tribunal has authority <strong>to</strong> impose sanctions on a party who fails <strong>to</strong><br />

comply with <strong>the</strong> requirement <strong>to</strong> give notice of a modification <strong>to</strong> all interested tribunals. Note,<br />

however, that failure <strong>to</strong> notify a displaced tribunal of <strong>the</strong> modification of its order does not affect<br />

<strong>the</strong> validity of <strong>the</strong> modified order.<br />

PART 4.<br />

REGISTRATION AND MODIFICATION OF FOREIGN CHILD-SUPPORT ORDER<br />

SECTION 615. JURISDICTION TO MODIFY CHILD-SUPPORT ORDER OF<br />

FOREIGN COUNTRY OR POLITICAL SUBDIVISION.<br />

(a) Except as o<strong>the</strong>rwise provided in Section 711, If if a foreign country or political<br />

subdivision that is a State will not or may not modify its order lacks or refuses <strong>to</strong> exercise<br />

jurisdiction <strong>to</strong> modify its child-support order pursuant <strong>to</strong> its laws, a tribunal of this State state<br />

may assume jurisdiction <strong>to</strong> modify <strong>the</strong> child-support order and bind all individuals subject <strong>to</strong> <strong>the</strong><br />

personal jurisdiction of <strong>the</strong> tribunal whe<strong>the</strong>r or not <strong>the</strong> consent <strong>to</strong> modification of a child-support<br />

order o<strong>the</strong>rwise required of <strong>the</strong> individual pursuant <strong>to</strong> Section 611 has been given or whe<strong>the</strong>r <strong>the</strong><br />

individual seeking modification is a resident of this State state or of <strong>the</strong> foreign country or<br />

political subdivision.<br />

(b) An order issued by a tribunal of this state modifying a foreign child-support order<br />
