DELEGATION<br />

A5.1 The Secretary may, in writing, delegate or authorise any person to perform any <strong>of</strong> the<br />

Secretary’s powers or functions under this <strong>Agreement</strong>.<br />

A5.2 Delegation and authorisation instruments will be published on the department’s intranet pages<br />

as soon as practicable after being signed by the Secretary.<br />

A6<br />

INDIVIDUAL FLEXIBILITY ARRANGEMENT<br />

A6.1 The Secretary and an employee covered by this <strong>Agreement</strong> may agree to make an individual<br />

flexibility arrangement to vary the effect <strong>of</strong> terms <strong>of</strong> this <strong>Agreement</strong> if:<br />

(a)<br />

the arrangement deals with one or more <strong>of</strong> the following matters:<br />

(i)<br />

(ii)<br />

(iii)<br />

(iv)<br />

arrangements about when work is performed, overtime rates and/or penalty<br />

rates;<br />

allowances;<br />

remuneration; and/or<br />

leave;<br />

(b)<br />

(c)<br />

the arrangement meets the genuine needs <strong>of</strong> the Secretary and employee in relation<br />

to one or more <strong>of</strong> the matters mentioned in paragraph (a); and<br />

the arrangement is genuinely agreed to by the Secretary and the employee.<br />

A6.2 The Secretary must ensure that the terms <strong>of</strong> the individual flexibility arrangement:<br />

(a) are about permitted matters under section 172 <strong>of</strong> the Fair Work Act 2009;<br />

(b)<br />

(c)<br />

are not unlawful terms under section 194 <strong>of</strong> the Fair Work Act 2009; and<br />

result in the employee being better <strong>of</strong>f overall than the employee would be if no<br />

arrangement was made.<br />

A6.3 The Secretary must ensure that the individual flexibility arrangement:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

is in writing;<br />

includes the name <strong>of</strong> the Secretary and the employee;<br />

is signed by the Secretary and the employee and if the employee is under 18 years<br />

<strong>of</strong> age, signed by a parent or guardian <strong>of</strong> the employee; and<br />

includes details <strong>of</strong>:<br />

(i)<br />

(ii)<br />

(iii)<br />

(iv)<br />

the terms <strong>of</strong> the enterprise agreement that will be varied by the arrangement;<br />

how the arrangement will vary the effect <strong>of</strong> the terms;<br />

how the employee will be better <strong>of</strong>f overall in relation to the terms and<br />

conditions <strong>of</strong> his or her employment as a result <strong>of</strong> the arrangement; and<br />

states the day on which the arrangement commences, and where relevant, the<br />

day on which the arrangement ceases.<br />
