H10.4 Any amount that remains outstanding to the department at the expiry <strong>of</strong> the transport ticket,<br />
transfer <strong>of</strong> the employee to another location or cessation <strong>of</strong> the employee's employment will be<br />
deducted from the employee’s salary or final entitlements. Amounts payable by an employee<br />
under this subclause H10.4 may, in accordance with a relevant Chief Executive’s Instruction,<br />
be deducted from monies otherwise payable to the employee or recovered as a debt due to the<br />
Commonwealth.<br />
H11<br />
UNIFORMS<br />
H11.1 The department will continue to consult with employees and their representatives on the design<br />
and gradual implementation <strong>of</strong> the DHS corporate wardrobe. Implementation <strong>of</strong> compulsory<br />
uniform in the department will take into consideration OH&S principles and obligations. Where<br />
the uniform is required it will be issued to staff at no cost. A subsidy program will be provided<br />
for wardrobe items for staff in other work areas.<br />
H12<br />
LACTATION BREAKS<br />
H12.1 The department will support employees who choose to continue breastfeeding by:<br />
(a)<br />
(b)<br />
(c)<br />
(d)<br />
facilitating discussion between individual employees and their managers about<br />
accommodating the employee’s lactation needs and practical arrangements to meet<br />
those needs;<br />
planning for and providing access to the most suitable available facilities;<br />
providing paid lactation breaks <strong>of</strong> up to 10% <strong>of</strong> the employees working time; and<br />
providing telephone access to relevant free breastfeeding support services.<br />
H12.2 An employee may access the flexible working hours arrangements or personal/carer’s leave to<br />
access support or treatment in relation to breastfeeding.<br />
H13<br />
EMERGENCY MANAGEMENT SITUATIONS<br />
H13.1 In the event that the department is required to respond to an emergency situation, either within<br />
Australia or overseas, the Secretary may activate this clause H13 to assist in providing suitable<br />
terms and conditions <strong>of</strong> employment for those employees who are required to assist in that<br />
response.<br />
H13.2 The Secretary will, in consultation with potentially affected employees and their representatives,<br />
determine which employees or groups <strong>of</strong> employees any decisions under this clause H13 will<br />
apply to.<br />
H13.3 The Secretary will, in consultation with potentially affected employees and their representatives,<br />
determine the length <strong>of</strong> time for which any decisions under this clause H13 will apply for.<br />
H13.4 The Secretary may, under this clause H13, decide that some clauses <strong>of</strong> this <strong>Agreement</strong> will be<br />
varied for affected employees. Depending on the nature <strong>of</strong> the event, these clauses may<br />
include:<br />
(a)<br />
(b)<br />
(c)<br />
(d)<br />
(e)<br />
where work is performed;<br />
penalty rates (including shift or overtime);<br />
allowances;<br />
application <strong>of</strong> flex arrangements;<br />
application <strong>of</strong> leave arrangements, such as miscellaneous leave; and/or<br />
<strong>Department</strong> <strong>of</strong> <strong>Human</strong> <strong>Services</strong> <strong>Agreement</strong> 2011 – 2014 65
