3.2. Search warrants, drug search powers and o<strong>the</strong>r relevant legislation<br />
in <strong>NSW</strong><br />
It is important to place <strong>the</strong> <strong>Drug</strong> <strong>Premises</strong> <strong>Act</strong> in <strong>the</strong> context <strong>of</strong> legislation that is <strong>of</strong>ten used in conjunction with this <strong>Act</strong>. Aspects <strong>of</strong> <strong>the</strong>se<br />
laws that are relevant to <strong>the</strong> operation <strong>of</strong> <strong>the</strong> <strong>Drug</strong> <strong>Premises</strong> <strong>Act</strong> are summarised below.<br />
It is also noted that two o<strong>the</strong>r drug laws, <strong>the</strong> <strong>Police</strong> <strong>Powers</strong> (Internally Concealed <strong>Drug</strong>s) <strong>Act</strong> <strong>2001</strong> and <strong>the</strong> <strong>Police</strong> <strong>Powers</strong> (<strong>Drug</strong> Detection<br />
Dogs) <strong>Act</strong> <strong>2001</strong>, have come into operation since <strong>the</strong> commencement <strong>of</strong> <strong>the</strong> <strong>Drug</strong> <strong>Premises</strong> <strong>Act</strong>. The <strong>NSW</strong> Ombudsman has a review role<br />
in relation to <strong>the</strong>se laws.<br />
3.2.1. The Search Warrants <strong>Act</strong> 1985<br />
In <strong>NSW</strong>, <strong>the</strong> principal legislation that regulates <strong>the</strong> application, issuing and execution <strong>of</strong> search warrants is <strong>the</strong> Search Warrants <strong>Act</strong>. As<br />
noted above, many <strong>of</strong> <strong>the</strong> procedures that apply to warrants issued under <strong>the</strong> <strong>Drug</strong> <strong>Premises</strong> <strong>Act</strong> are contained in <strong>the</strong> Search Warrants <strong>Act</strong>.<br />
Section 5(1) <strong>of</strong> <strong>the</strong> Search Warrants <strong>Act</strong> authorises police to apply for a search warrant if <strong>the</strong>y have reasonable grounds for believing that<br />
any <strong>of</strong> <strong>the</strong> following things are, or will be, on <strong>the</strong> premises within 72 hours:<br />
(a)<br />
a thing connected with a particular indictable <strong>of</strong>fence,<br />
(b) a thing connected with a particular firearms <strong>of</strong>fence,<br />
(b1) a thing connected with a prohibited weapons <strong>of</strong>fence,<br />
(c ) a thing connected with a particular narcotics <strong>of</strong>fence, or<br />
(d) a thing stolen or o<strong>the</strong>rwise unlawfully obtained. 113<br />
