H.5. Physical Expansion<br />

An existing Formula Fast Food Restaurant<br />

may only be physically expanded in a<br />

manner to increase seating capacity:<br />

a. Onto a site other than a corner;<br />

b. Where it would not result in two<br />

or more Formula Fast Food Restaurants<br />

operating on that site<br />

(i.e., two or more Formula Fast<br />

Food Restaurant business entities<br />

requiring separate business<br />

licenses, or displaying in a manner<br />

visible from public property<br />

separate business trademarks,<br />

logos, service marks or other<br />

mutually identifying names or<br />

symbols, for the daily or weekly<br />

conducting <strong>of</strong> business on the<br />

same site); and<br />

c. So long as the <strong>Plan</strong>ning Commission<br />

finds that physically expanding<br />

the Formula Fast Food<br />

Restaurant will not increase the<br />

intensity <strong>of</strong> use on the site to a<br />

level that will adversely impact:<br />

i. Land uses in the area;<br />

ii. Pedestrian or motor vehicle<br />

traffic; or<br />

iii. <strong>The</strong> public welfare.<br />

H.6. Trash<br />

<strong>The</strong> Formula Fast Food Restaurant will<br />

operate in accordance with a “Trash Disposal<br />

<strong>Plan</strong>,” approved by the <strong>Plan</strong>ning<br />

Commission. <strong>The</strong> <strong>Plan</strong> shall address litter<br />

control, trash collection, on-site storage,<br />

and pick-up on a regular basis. <strong>The</strong> <strong>Plan</strong><br />

shall include pro<strong>of</strong> <strong>of</strong> a contract with the<br />

<strong>City</strong> disposal contractor, and specify that<br />

such a contract shall be maintained as a<br />

requirement for the issuance and retention<br />

<strong>of</strong> the Minor Special Use Permit.<br />

H.7. Design Review<br />

Establishment or exterior alteration <strong>of</strong> a<br />

Formula Fast Food Restaurant is subject<br />

to the Design Review Ordinance.<br />
