8. Regulating <strong>alcohol</strong> marketing<br />

115A Prohibited advertising or promotion<br />

1) The Director may give a notice to a licensee banning <strong>the</strong> licensee from advertising or<br />

promoting—<br />

a) <strong>the</strong> supply <strong>of</strong> liquor by <strong>the</strong> licensee; or<br />

b) <strong>the</strong> conduct <strong>of</strong> licensed premises by <strong>the</strong> licensee—<br />

if, in <strong>the</strong> opinion <strong>of</strong> <strong>the</strong> Director, <strong>the</strong> advertising or promotion, or <strong>the</strong> proposed<br />

advertising or promotion, is likely to encourage irresponsible consumption <strong>of</strong> <strong>alcohol</strong> or<br />

is o<strong>the</strong>rwise not in <strong>the</strong> public interest.<br />

2) A licensee to whom a notice applies must comply with <strong>the</strong> notice. 120 penalty units.<br />

154A. Promotion <strong>of</strong> excessive consumption <strong>of</strong> <strong>alcohol</strong>- Every person commits an <strong>of</strong>fence and is<br />

liable to a fine not exceeding New Zealand $5000 [U.S. $3,744] who, being a licensee or manager<br />

<strong>of</strong> licensed premises, does anything in <strong>the</strong> promotion <strong>of</strong> <strong>the</strong> business conducted on <strong>the</strong> premises,<br />

or in <strong>the</strong> promotion <strong>of</strong> any event or activity held or conducted on <strong>the</strong> premises, that is intended or<br />

likely to encourage persons on <strong>the</strong> licensed premises to consume <strong>alcohol</strong> to an excessive extent.<br />

30. Sale <strong>of</strong> <strong>alcohol</strong> beverage in <strong>the</strong> following methods or manners is prohibited: …<br />

3) Discount for sale promotion purpose;<br />

4) Giving or <strong>of</strong>fering to give <strong>the</strong> right to attend a competition or performance or to win<br />

some rewards, or any o<strong>the</strong>r privileges in favour <strong>of</strong> <strong>alcohol</strong> beverage buyers or those<br />

bringing <strong>the</strong> packages, labels or any o<strong>the</strong>r materials related to <strong>the</strong> <strong>alcohol</strong> beverage to<br />

exchange or trade with anything;<br />

5) Distributing, attaching, giving or trading with <strong>alcohol</strong> beverage or with o<strong>the</strong>r products<br />

or providing o<strong>the</strong>r services, as <strong>the</strong> case may be, or distributing <strong>alcohol</strong> beverage as<br />

sample <strong>of</strong> <strong>the</strong> beverage or motivating <strong>the</strong> public to consume <strong>alcohol</strong> beverage as well<br />

as setting sale conditions in <strong>the</strong> manner that <strong>the</strong> consumers are directly or indirectly<br />

forced to buy <strong>the</strong> <strong>alcohol</strong> beverage; and<br />

6) Sale <strong>of</strong> <strong>alcohol</strong> beverage by any means or manners announced by <strong>the</strong> Minister with<br />

advice <strong>of</strong> <strong>the</strong> Committee.<br />

Every person commits an <strong>of</strong>fence punishable on conviction by a fine <strong>of</strong> XX who undertakes a<br />

promotion or o<strong>the</strong>r activities (including price discounting or supply <strong>of</strong> <strong>alcohol</strong> free <strong>of</strong> charge) that<br />

is likely to encourage rapid or excessive consumption <strong>of</strong> <strong>alcohol</strong>.<br />
