4. Regulating availability<br />

Conditions<br />

The Board, where it has established criteria under subsection (1), may specify conditions that may<br />

be imposed on a holder’s licence to sell liquor and on <strong>the</strong> premises in respect <strong>of</strong> which <strong>the</strong> licence<br />

is issued…<br />

2) A licence is subject to such conditions as may be consented to by <strong>the</strong> applicant or licensee,<br />

imposed by <strong>the</strong> Board or prescribed (2002).<br />

Criteria<br />

1) When deciding whe<strong>the</strong>r to grant a licence or ref<strong>use</strong> a licence, <strong>the</strong> Authority shall have regard<br />

to <strong>the</strong> following criteria:<br />

a) <strong>the</strong> suitability <strong>of</strong> <strong>the</strong> applicant;<br />

b) <strong>the</strong> location and suitability <strong>of</strong> <strong>the</strong> premises, in relation to neighbouring land <strong>use</strong> and<br />

proximity to any school, hospital, place <strong>of</strong> worship;<br />

c) <strong>the</strong> number and density <strong>of</strong> <strong>alcohol</strong> outlets currently in <strong>the</strong> vicinity; and<br />

d) <strong>the</strong> nature <strong>of</strong> <strong>the</strong> licensed business proposed, including:<br />

i) for on-licenses:<br />

a) <strong>the</strong> food and non-<strong>alcohol</strong>ic drinks to be provided;<br />

b) any o<strong>the</strong>r goods and services to be provided;<br />

c) whe<strong>the</strong>r for accommodation guests only; and<br />

d) whe<strong>the</strong>r for club members only.<br />

ii) for <strong>of</strong>f-licences:<br />

a) <strong>the</strong> definition <strong>of</strong> specialist bottle store or supermarket;<br />

b) restriction in regard to petrol outlets;<br />

c) <strong>the</strong> steps <strong>the</strong> licensee will take to ensure that <strong>alcohol</strong> is not sold or served to<br />

minors or intoxicated persons;<br />

e) <strong>the</strong> hours and days <strong>of</strong> trading proposed (unless set by <strong>the</strong> Act);<br />

f) any matters raised by police or local <strong>of</strong>ficers;<br />

g) any objections raised by <strong>the</strong> public; and<br />

h) <strong>the</strong> object <strong>of</strong> <strong>the</strong> Act.<br />
