The Alcohol Control Board<br />

1) An <strong>alcohol</strong> control board is established. The board’s functions are to: give effect to <strong>the</strong><br />

purposes <strong>of</strong> <strong>the</strong> Act;<br />

a) sell <strong>alcohol</strong> and non-<strong>alcohol</strong>ic beverages for consumption <strong>of</strong>f <strong>the</strong> premises;<br />

b) control <strong>the</strong> sale, transportation and distribution <strong>of</strong> <strong>alcohol</strong>;<br />

c) establish and operate stores for <strong>the</strong> sale <strong>of</strong> <strong>alcohol</strong> to <strong>the</strong> public;<br />

d) control and supervise <strong>the</strong> marketing <strong>of</strong> <strong>alcohol</strong>; and<br />

e) fix uniform prices for <strong>the</strong> sale <strong>of</strong> <strong>alcohol</strong> in all stores operated by <strong>the</strong> board.<br />

2) Nothing in this section affects <strong>the</strong> licensing <strong>of</strong> any person to sell <strong>alcohol</strong> for consumption<br />

on <strong>the</strong> premises which is under <strong>the</strong> sole jurisdiction <strong>of</strong> <strong>the</strong> [separate licensing board or<br />

authority].<br />

Prohibited to sell <strong>alcohol</strong><br />

1) No person o<strong>the</strong>r than <strong>the</strong> Alcohol Control Board shall sell or supply <strong>alcohol</strong> for consumption<br />

<strong>of</strong>f <strong>the</strong> premises.<br />

2) No person, o<strong>the</strong>r than <strong>the</strong> Alcohol Control Board, may sell or distribute <strong>alcohol</strong> from any<br />

store, wareho<strong>use</strong> or o<strong>the</strong>r place which is not operated by <strong>the</strong> board.<br />

3) No person shall sell or supply <strong>alcohol</strong> without a licence for consumption on <strong>the</strong> premises.<br />

4) No person shall allow any unlicensed premises which <strong>the</strong>y own, rent, manage or control to<br />

be <strong>use</strong>d as a place <strong>of</strong> resort for <strong>the</strong> consumption <strong>of</strong> <strong>alcohol</strong>.<br />

5) Subsection (2) does not apply to any dwelling ho<strong>use</strong> and to a gift <strong>of</strong> <strong>alcohol</strong> to ano<strong>the</strong>r<br />

person by <strong>the</strong> person at <strong>the</strong>ir dwelling ho<strong>use</strong>.<br />

6) Any person who contravenes subsection (1), (2), (3) or (4) commits an <strong>of</strong>fence punishable on<br />

conviction by a fine.<br />

Planning restrictions<br />

Where liquor licensing legislation does not provide for decision-making on <strong>the</strong> number and<br />

location <strong>of</strong> different types <strong>of</strong> <strong>alcohol</strong> outlet, <strong>the</strong> issue is likely to arise in locality planning<br />

processes. If licensing laws are permissive, <strong>the</strong>n planning for <strong>the</strong> location <strong>of</strong> different types <strong>of</strong><br />

<strong>alcohol</strong> outlet becomes important.<br />

Typically, in high income countries, national-level legislation will dictate <strong>the</strong> processes and<br />

zone types for local district planning. Then local councils decide what land <strong>use</strong> activities <strong>the</strong>y<br />
