Prohibition <strong>of</strong> unlicensed sale <strong>of</strong> <strong>alcohol</strong><br />
1) Alcohol is not to be sold on any premises except under and in accordance with—<br />
a) a premises licence, or<br />
b) an occasional licence, granted under this Act in respect <strong>of</strong> <strong>the</strong> premises.<br />
2) Subsection (1) does not apply to <strong>the</strong> selling <strong>of</strong> <strong>alcohol</strong>—<br />
a) on exempt premises, or<br />
b) to trade.<br />
3) A person who—<br />
a) sells <strong>alcohol</strong>, or<br />
b) knowingly allows <strong>alcohol</strong> to be sold, in breach <strong>of</strong> subsection (1)<br />
commits an <strong>of</strong>fence.<br />
4) A person guilty <strong>of</strong> an <strong>of</strong>fence under subsection (3) is liable on summary conviction to—<br />
a) a fine not exceeding £20 000 [U.S. $31,545],<br />
b) imprisonment for a term not exceeding 6 months, or<br />
c) both.<br />
Sale <strong>of</strong> Liquor Act, New Zealand (1989)<br />
Sale or supply <strong>of</strong> liquor to intoxicated person<br />
1) Every person commits an <strong>of</strong>fence and is liable to <strong>the</strong> penalty set out in subsection (4) who,<br />
being <strong>the</strong> licensee or a manager <strong>of</strong> any licensed premises, sells or supplies liquor to any<br />
o<strong>the</strong>r person who is already intoxicated.<br />
2) Every person commits an <strong>of</strong>fence and is liable to <strong>the</strong> penalty set out in subsection (4) who,<br />
not being <strong>the</strong> licensee or a manager <strong>of</strong> any licensed premises, sells or supplies liquor to any<br />
o<strong>the</strong>r person who is already intoxicated.<br />
3) Subsection (2) <strong>of</strong> this section applies irrespective <strong>of</strong> any liability that may attach to <strong>the</strong><br />
licensee or any manager in respect <strong>of</strong> <strong>the</strong> same <strong>of</strong>fence.<br />
4) The penalty is,—<br />
a) In <strong>the</strong> case <strong>of</strong> a licensee,—<br />
i) A fine not exceeding New Zealand $10 000 [U.S. $7,488]; or<br />
ii) The suspension <strong>of</strong> <strong>the</strong> licensee’s licence for a period not exceeding 7 days; or<br />
iii) Both:<br />
b) In <strong>the</strong> case <strong>of</strong> a manager, a fine not exceeding New Zealand $10 000 [U.S. $7,488]:<br />
c) In <strong>the</strong> case <strong>of</strong> a person (not being a licensee or manager), a fine not exceeding New<br />
Zealand $2000 [U.S. $1,497].<br />
