School students can undertake an apprenticeship or tra<strong>in</strong>eeship as part of their HSC. Part-time school-based<br />

<strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong> <strong>in</strong>clude all the requirements of full-time <strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong>.<br />

5.4 Probationary period<br />

All <strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong> (with the exception of tra<strong>in</strong>ee <strong>apprenticeships</strong>) have a probationary period. The<br />

probationary period is specified <strong>in</strong> the relevant Vocational Tra<strong>in</strong><strong>in</strong>g Order <strong>and</strong> varies from 1 <strong>to</strong> 3 months, depend<strong>in</strong>g<br />

on the term of the tra<strong>in</strong><strong>in</strong>g contract. The date on which the probationary period ends is specified <strong>in</strong> the approval letters<br />

sent <strong>to</strong> the employer <strong>and</strong> apprentice/ tra<strong>in</strong>ee.<br />

The probationary period can be extended by up <strong>to</strong> three months on application by the employer, apprentice/tra<strong>in</strong>ee or<br />

both provid<strong>in</strong>g that the extension request is lodged with State Tra<strong>in</strong><strong>in</strong>g Services before the orig<strong>in</strong>al probationary period<br />

elapses.<br />

While the apprentice/tra<strong>in</strong>ee is ‘on probation’, the employer or apprentice/tra<strong>in</strong>ee can withdraw from the tra<strong>in</strong><strong>in</strong>g<br />

contract simply by giv<strong>in</strong>g the appropriate period of notice (as per the award or workplace agreement) <strong>to</strong> the other<br />

party. The employer must notify State Tra<strong>in</strong><strong>in</strong>g Services (ph 13 28 11) with<strong>in</strong> 14 days of withdrawal.<br />

Once the probationary period has elapsed, the tra<strong>in</strong><strong>in</strong>g contract becomes b<strong>in</strong>d<strong>in</strong>g on both parties. It can only be<br />

5.5 Wages <strong>and</strong> awards<br />

Employers are required by law <strong>to</strong> have a copy of the relevant award or <strong>in</strong>dustrial agreement on file <strong>in</strong> the workplace.<br />

Each apprentice/tra<strong>in</strong>ee must be paid at least the wage rate set out <strong>in</strong> the State or Federal <strong>in</strong>dustrial award or<br />

workplace agreement under which they have been employed. Wages vary accord<strong>in</strong>g <strong>to</strong> the <strong>in</strong>dustry <strong>in</strong> which the<br />

apprentice/tra<strong>in</strong>ee is employed <strong>and</strong> may depend on the type of apprenticeship or tra<strong>in</strong>eeship, the stage they have<br />

reached, their age, <strong>and</strong> the number of years s<strong>in</strong>ce they left school.<br />

State <strong>and</strong> Federal awards are <strong>in</strong>creas<strong>in</strong>gly be<strong>in</strong>g varied <strong>to</strong> accommodate part-time <strong>tra<strong>in</strong>eeships</strong> <strong>and</strong> school-based<br />

<strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong>.<br />

Employers are obliged by law <strong>to</strong> keep records of times worked by each apprentice/tra<strong>in</strong>ee (<strong>in</strong>clud<strong>in</strong>g attendance at<br />

off-the-job tra<strong>in</strong><strong>in</strong>g) <strong>and</strong> his/her wages. They are also obliged <strong>to</strong> provide employees with a pay slip which <strong>in</strong>cludes<br />

details such as the period of employment <strong>to</strong> which the pay relates, hours worked (<strong>in</strong>clud<strong>in</strong>g overtime), gross pay, tax<br />

deducted, other deductions <strong>and</strong> net pay.<br />

Like other employees, apprentices <strong>and</strong> tra<strong>in</strong>ees are eligible <strong>to</strong> receive entitlements such as leave<br />

(sick leave, annual leave, parental leave, bereavement leave) <strong>and</strong> allowances (<strong>to</strong>ol allowance,<br />
