8 Resolv<strong>in</strong>g problems<br />

Help is available if problems arise between an employer <strong>and</strong> their apprentice or tra<strong>in</strong>ee.<br />

8.1 Problems that can lead <strong>to</strong> disputes<br />

Disputes can arise as a result of:<br />

• claims that the employer is not fulfill<strong>in</strong>g their obligations <strong>to</strong> provide on-the-job tra<strong>in</strong><strong>in</strong>g <strong>and</strong> supervision<br />

• claims that the employer is not fulfill<strong>in</strong>g their obligation <strong>to</strong> release an apprentice or tra<strong>in</strong>ee for off-the-job tra<strong>in</strong><strong>in</strong>g,<br />

or <strong>to</strong> provide support for formal tra<strong>in</strong><strong>in</strong>g through the registered tra<strong>in</strong><strong>in</strong>g organisation (RTO)<br />

• claims that the employer is not fulfill<strong>in</strong>g their other responsibilities, such as meet<strong>in</strong>g the conditions of the<br />

<strong>in</strong>dustrial award or workplace agreement, or provid<strong>in</strong>g a workplace that is safe <strong>and</strong> free of harassment<br />

• claims that the apprentice or tra<strong>in</strong>ee is not mak<strong>in</strong>g satisfac<strong>to</strong>ry progress <strong>in</strong> develop<strong>in</strong>g their skills<br />

• claims that the apprentice or tra<strong>in</strong>ee is not mak<strong>in</strong>g satisfac<strong>to</strong>ry progress <strong>in</strong> their formal tra<strong>in</strong><strong>in</strong>g through the RTO<br />

• claims that the apprentice or tra<strong>in</strong>ee is not meet<strong>in</strong>g their obligation <strong>to</strong> follow the <strong>in</strong>structions of their employer<br />

• personal differences between the apprentice or tra<strong>in</strong>ee <strong>and</strong> their employer or other employees<br />

• failure of the parties <strong>to</strong> agree about a request <strong>to</strong> transfer, suspend, cancel or vary the tra<strong>in</strong><strong>in</strong>g contract.<br />

8.2 Communication between apprentice or tra<strong>in</strong>ee <strong>and</strong> employers<br />

A large number of problems can be resolved before <strong>in</strong>volvement of State Tra<strong>in</strong><strong>in</strong>g Services. It is important for<br />

problems <strong>to</strong> be addressed by either party through direct communication. State Tra<strong>in</strong><strong>in</strong>g Services have created several<br />

resources that can assist the employer <strong>and</strong> their apprentice or tra<strong>in</strong>ee. A <strong>guide</strong> for workplace supervisors provides an<br />

outl<strong>in</strong>e of what is expected of the supervisor, <strong>and</strong> what the supervisor can expect of the apprentice or tra<strong>in</strong>ee. If you<br />

would like a copy of this booklet, please contact your nearest State Tra<strong>in</strong><strong>in</strong>g Services regional office on 13 28 11.<br />

Clear communication means that before <strong>in</strong>volv<strong>in</strong>g of organisations such as unions or employer groups, the apprentice<br />

or tra<strong>in</strong>ee <strong>and</strong> their employer should attempt <strong>to</strong> discuss the issue <strong>and</strong> seek a solution. Where a solution cannot be<br />

found, State Tra<strong>in</strong><strong>in</strong>g Services must be advised.<br />

8.3 Help available through the State Tra<strong>in</strong><strong>in</strong>g Services<br />

State Tra<strong>in</strong><strong>in</strong>g Services staff (ph 13 28 11) can be contacted <strong>to</strong> seek confidential advice about tra<strong>in</strong><strong>in</strong>g arrangements.<br />

Employers, apprentices <strong>and</strong> tra<strong>in</strong>ees can request assistance <strong>in</strong> resolv<strong>in</strong>g the dispute. State Tra<strong>in</strong><strong>in</strong>g Services staff are<br />

tra<strong>in</strong>ed <strong>in</strong> mediation <strong>and</strong> dispute resolution <strong>and</strong> can discuss the issue with each of the parties <strong>to</strong> diffuse the situation<br />

<strong>and</strong> <strong>to</strong> seek a resolution that allows the cont<strong>in</strong>uation of the tra<strong>in</strong><strong>in</strong>g contract. The Tra<strong>in</strong><strong>in</strong>g Advisor may visit the<br />

workplace or arrange a meet<strong>in</strong>g <strong>to</strong> try <strong>and</strong> resolve the dispute.<br />

If difficulties arise between apprentices/tra<strong>in</strong>ees <strong>and</strong> their employers, State Tra<strong>in</strong><strong>in</strong>g Services<br />

should be contacted immediately - ph. 13 28 11<br />

8.4 Disputes may be referred <strong>to</strong> the Vocational Tra<strong>in</strong><strong>in</strong>g Tribunal<br />

If the Tra<strong>in</strong><strong>in</strong>g Advisor is not able <strong>to</strong> resolve the dispute, the matter must be formalised. It will then be referred <strong>to</strong> the<br />

<strong>NSW</strong> Vocational Tra<strong>in</strong><strong>in</strong>g Tribunal (VTT) for resolution. The Tribunal will convene a hear<strong>in</strong>g at which it will attempt <strong>to</strong><br />

reach a settlement that is acceptable <strong>to</strong> all parties.<br />

In the event that the dispute cannot be resolved, the VTT will make a determ<strong>in</strong>ation that may result <strong>in</strong> the compla<strong>in</strong>t<br />

be<strong>in</strong>g dismissed or <strong>in</strong> variation, suspension or cancellation of the apprenticeship or tra<strong>in</strong>eeship. The VTT also has the<br />

power under the Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act <strong>to</strong> caution or reprim<strong>and</strong> either one or both of the parties, <strong>and</strong> <strong>to</strong><br />

order a party <strong>to</strong> a tra<strong>in</strong><strong>in</strong>g contract <strong>to</strong> redress the situation as it sees fit.<br />

The Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001 makes provision for certa<strong>in</strong> decisions by the Commissioner or the VTT,<br />

<strong>to</strong> be appealed. Information on this process can be obta<strong>in</strong>ed from your local State Tra<strong>in</strong><strong>in</strong>g Services regional office (ph<br />

13 28 11).<br />

An appeal will be heard by the Vocational Tra<strong>in</strong><strong>in</strong>g Appeal Panel, at which new evidence or <strong>in</strong>formation may be given.<br />

A f<strong>in</strong>al appeal can be made <strong>to</strong> the <strong>NSW</strong> Industrial Relations Commission. This can only occur through an application<br />

<strong>to</strong> the Commission for leave <strong>to</strong> appeal. Such applications must be made with<strong>in</strong> six months of the Appeal Panel’s<br />

determ<strong>in</strong>ation unless otherwise allowed by the Commissioner.<br />
