14 Legislation<br />

A number of Australian <strong>and</strong> State Government Acts of Parliament relate <strong>to</strong> the adm<strong>in</strong>istration of <strong>apprenticeships</strong> <strong>and</strong><br />

<strong>tra<strong>in</strong>eeships</strong> <strong>and</strong> the tra<strong>in</strong><strong>in</strong>g of apprentices <strong>and</strong> tra<strong>in</strong>ees.<br />

Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> Department of Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g)<br />

This Act relates directly <strong>to</strong> the adm<strong>in</strong>istration of <strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong> <strong>in</strong> <strong>NSW</strong> <strong>and</strong> sets out the roles <strong>and</strong><br />

responsibilities of the Commissioner for Vocational Tra<strong>in</strong><strong>in</strong>g, employers, apprentices <strong>and</strong> tra<strong>in</strong>ees, as well as other<br />

bodies <strong>in</strong>volved <strong>in</strong> the apprenticeship <strong>and</strong> tra<strong>in</strong>eeship system <strong>in</strong> <strong>NSW</strong> such as the Vocational Tra<strong>in</strong><strong>in</strong>g Tribunal <strong>and</strong><br />

group tra<strong>in</strong><strong>in</strong>g organisations.<br />

Vocational Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g Accreditation Act 1990<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> Department of Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g)<br />

This Act sets out the constitution, roles <strong>and</strong> functions of the <strong>NSW</strong> Vocational Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g Accreditation<br />

Board (VETAB), <strong>in</strong>clud<strong>in</strong>g those relat<strong>in</strong>g <strong>to</strong> the registration of tra<strong>in</strong><strong>in</strong>g organisations <strong>and</strong> accreditation of courses.<br />

Board of Vocational Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g Act 1994<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> Department of Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g)<br />

This Act sets out the constitution, roles <strong>and</strong> functions of the <strong>NSW</strong> Board of Vocational Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g (BVET),<br />

<strong>in</strong>clud<strong>in</strong>g those relat<strong>in</strong>g <strong>to</strong> the appo<strong>in</strong>tment of advisory committees <strong>and</strong> delegation of authority <strong>to</strong> other parties.<br />

Industrial Relations Act 1996<br />

(adm<strong>in</strong>istered by the Office of Industrial Relations, <strong>NSW</strong> Department of Commerce ph 13 16 28)<br />

This Act regulates <strong>in</strong>dustrial relations <strong>in</strong> New South Wales. It provides for a centralised, award-based arbitration<br />

system with provision for enterprise barga<strong>in</strong><strong>in</strong>g. The Act provides for the regulation of <strong>in</strong>dustrial matters, <strong>in</strong>clud<strong>in</strong>g the<br />

provision that employers ma<strong>in</strong>ta<strong>in</strong> records of time worked by apprentices <strong>and</strong>/or tra<strong>in</strong>ees <strong>and</strong> the wages they are paid.<br />

Occupational Health <strong>and</strong> Safety Act 2000<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> WorkCover Authority)<br />

The Occupational Health <strong>and</strong> Safety (OH&S) Act outl<strong>in</strong>es the general health <strong>and</strong> safety requirements of workplaces <strong>in</strong><br />

<strong>NSW</strong>. Under the provisions of the Act, an employer must ensure the health, safety <strong>and</strong> welfare of employees by:<br />

• provid<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g safe systems of work<br />

• provid<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g safe equipment<br />

• ensur<strong>in</strong>g the safe use, h<strong>and</strong>l<strong>in</strong>g, s<strong>to</strong>rage <strong>and</strong> transport of equipment <strong>and</strong> substances<br />

• provid<strong>in</strong>g any <strong>in</strong>formation, <strong>in</strong>struction, tra<strong>in</strong><strong>in</strong>g <strong>and</strong> supervision that is needed <strong>to</strong> ensure the health <strong>and</strong> safety of<br />

employees<br />

• ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g workplaces <strong>in</strong> a safe condition<br />

• provid<strong>in</strong>g <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g safe entrances <strong>and</strong> exits<br />

• mak<strong>in</strong>g adequate <strong>in</strong>formation available <strong>to</strong> employees about research <strong>and</strong> relevant tests of substances used <strong>in</strong><br />

the workplace.<br />

Child Protection (Prohibited Employment) Act 1998<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> Commission for Children <strong>and</strong> Young People: www.kids.nsw.gov.au )<br />

This Act prohibits convicted sex offenders from work<strong>in</strong>g with children <strong>and</strong> young people under 18 years of age <strong>and</strong><br />

provides for pre-employment checks for those who want <strong>to</strong> work with children <strong>and</strong> young people.<br />

The Industrial Relations (Child Employment) Act 2006<br />

(adm<strong>in</strong>istered by the <strong>NSW</strong> Office of Industrial Relations)<br />

Employers operat<strong>in</strong>g under the federal Work Choices <strong>in</strong>dustrial relations system must comply with the No Net<br />

Detriment Pr<strong>in</strong>ciples of the Act, as set down by the <strong>NSW</strong> Industrial Relations Commission (IRC).<br />
