Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001 – the legislation which governs the apprenticeship <strong>and</strong> tra<strong>in</strong>eeship<br />

system <strong>in</strong> <strong>NSW</strong>.<br />

Apprentice – a person who has been employed <strong>in</strong> a recognised trade vocation <strong>and</strong> who has entered <strong>in</strong><strong>to</strong> a tra<strong>in</strong><strong>in</strong>g<br />

contract with his/her employer under the Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001.<br />

Australian Apprentices – the national term used <strong>to</strong> describe both apprentices <strong>and</strong> tra<strong>in</strong>ees collectively.<br />

Australian Apprenticeships Centres (AACs) – organisations that are funded by the Australian Government <strong>to</strong><br />

promote <strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong> <strong>and</strong> provide advisory services <strong>and</strong> adm<strong>in</strong>istrative support <strong>to</strong> employers,<br />

apprentices <strong>and</strong> tra<strong>in</strong>ees. All applications <strong>to</strong> establish an apprenticeship or tra<strong>in</strong>eeship must be lodged with <strong>NSW</strong> DET<br />

through an Australian Apprenticeships Centre.<br />

Competency st<strong>and</strong>ard – a specification of knowledge <strong>and</strong> skill <strong>and</strong> the application of that knowledge <strong>and</strong> skill <strong>to</strong> the<br />

st<strong>and</strong>ard of performance required <strong>in</strong> the workplace.<br />

Competency record book – a log book that provides evidence that an apprentice or tra<strong>in</strong>ee has completed specific<br />

tasks <strong>and</strong> ga<strong>in</strong>ed knowledge <strong>and</strong> skills on the job. The competency record book supports formal tra<strong>in</strong><strong>in</strong>g be<strong>in</strong>g<br />

delivered by the registered tra<strong>in</strong><strong>in</strong>g organisation, <strong>and</strong> may be used by the registered tra<strong>in</strong><strong>in</strong>g organisation <strong>in</strong> mak<strong>in</strong>g an<br />

assessment of competency.<br />

Department of Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g (<strong>NSW</strong> DET) – the <strong>NSW</strong> Government department responsible for the<br />

adm<strong>in</strong>istration of vocational education <strong>and</strong> tra<strong>in</strong><strong>in</strong>g. Act<strong>in</strong>g <strong>in</strong> this capacity, <strong>NSW</strong> DET may also be referred <strong>to</strong> as the<br />

state tra<strong>in</strong><strong>in</strong>g authority.<br />

Exist<strong>in</strong>g worker tra<strong>in</strong>ee – a person who has been employed cont<strong>in</strong>uously by their current employer for more than<br />

3 months full-time or 12 months casual or part-time, or a comb<strong>in</strong>ation of both, immediately prior <strong>to</strong> commenc<strong>in</strong>g a<br />

tra<strong>in</strong>eeship.<br />

Exist<strong>in</strong>g worker tra<strong>in</strong>eeship – a tra<strong>in</strong>eeship for employees classified as exist<strong>in</strong>g workers (see above) <strong>in</strong> which<br />

the tra<strong>in</strong><strong>in</strong>g costs are met by the employer. <strong>NSW</strong> Government f<strong>in</strong>ancial <strong>in</strong>centives do not apply <strong>to</strong> exist<strong>in</strong>g worker<br />

<strong>tra<strong>in</strong>eeships</strong> although the employer may still attract Australian Government <strong>in</strong>centive payments which can be used by<br />

the employer <strong>to</strong> offset tra<strong>in</strong><strong>in</strong>g costs.<br />

Full apprenticeship – an apprenticeship under which the tra<strong>in</strong><strong>in</strong>g contract b<strong>in</strong>ds the employer <strong>and</strong> the apprentice<br />

from the end of the probationary period until the completion of the term of the apprenticeship. (See also tra<strong>in</strong>ee<br />

apprenticeship.)<br />

Group tra<strong>in</strong><strong>in</strong>g organisations (GTOs) – organisations that employ large numbers of tra<strong>in</strong>ees <strong>and</strong> apprentices each<br />

year. GTOs can place apprentices or tra<strong>in</strong>ees with one or several host employers so that the apprentice/tra<strong>in</strong>ee can<br />

develop a range of skills <strong>and</strong> work experience with different companies or bus<strong>in</strong>esses. Group tra<strong>in</strong><strong>in</strong>g organisations<br />

may be registered under the Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001.<br />

National tra<strong>in</strong><strong>in</strong>g contract – a nationally consistent form developed <strong>and</strong> adopted by all states/terri<strong>to</strong>ries <strong>in</strong><br />

conjunction with the Australian Government, for use by the employer, the apprentice/tra<strong>in</strong>ee <strong>and</strong> their nom<strong>in</strong>ated<br />

Australian Apprenticeships Centre when apply<strong>in</strong>g <strong>to</strong> establish an apprenticeship or tra<strong>in</strong>eeship. (See also tra<strong>in</strong><strong>in</strong>g<br />

contract.)<br />

New entrant tra<strong>in</strong>ee – a person employed with<strong>in</strong> an enterprise for less than three months full-time or 12 months parttime<br />

or casually, or any comb<strong>in</strong>ation of the above, prior <strong>to</strong> commenc<strong>in</strong>g a tra<strong>in</strong>eeship. To be considered a new entrant<br />

tra<strong>in</strong>ee the person must not have been employed at all by their current employer for at least six months prior <strong>to</strong> such<br />

full-time employment or twelve months prior <strong>to</strong> such part-time or casual employment.<br />

Nom<strong>in</strong>al term – the term of tra<strong>in</strong><strong>in</strong>g specified for an apprenticeship or tra<strong>in</strong>eeship under the relevant vocational<br />

tra<strong>in</strong><strong>in</strong>g order. (Note: Also referred <strong>to</strong> as the appropriate term or nom<strong>in</strong>al duration <strong>in</strong> the national tra<strong>in</strong><strong>in</strong>g contract.)<br />

Registered Tra<strong>in</strong><strong>in</strong>g Organisation (RTO) – a tra<strong>in</strong><strong>in</strong>g organisation registered <strong>to</strong> provide vocational education <strong>and</strong><br />

tra<strong>in</strong><strong>in</strong>g <strong>and</strong>/or assessment services <strong>and</strong> issue nationally recognised qualifications. Registered tra<strong>in</strong><strong>in</strong>g organisations<br />

are registered <strong>in</strong> <strong>NSW</strong> by the Vocational Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g Accreditation Board (VETAB). There are equivalent<br />

register<strong>in</strong>g bodies <strong>in</strong> the other states <strong>and</strong> terri<strong>to</strong>ries. All registered tra<strong>in</strong><strong>in</strong>g organisations are required <strong>to</strong> meet the<br />

st<strong>and</strong>ards of the Australian Quality Tra<strong>in</strong><strong>in</strong>g Framework (AQTF). The nationally recognised qualifications a registered<br />

tra<strong>in</strong><strong>in</strong>g organisation can issue are def<strong>in</strong>ed by its scope of registration.<br />

State Tra<strong>in</strong><strong>in</strong>g Authority – see Department of Education <strong>and</strong> Tra<strong>in</strong><strong>in</strong>g.<br />

State Tra<strong>in</strong><strong>in</strong>g Services – the division of <strong>NSW</strong> DET responsible for the adm<strong>in</strong>istration <strong>and</strong> quality assurance of<br />

vocational education <strong>and</strong> tra<strong>in</strong><strong>in</strong>g <strong>in</strong> <strong>NSW</strong>. State Tra<strong>in</strong><strong>in</strong>g Services manages registration of tra<strong>in</strong><strong>in</strong>g organisations <strong>and</strong><br />

tra<strong>in</strong><strong>in</strong>g courses <strong>in</strong> <strong>NSW</strong> <strong>and</strong> funds <strong>and</strong> adm<strong>in</strong>isters a range of vocational education <strong>and</strong> tra<strong>in</strong><strong>in</strong>g programs throughout<br />

<strong>NSW</strong>, <strong>in</strong>clud<strong>in</strong>g <strong>apprenticeships</strong> <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong>.
