Keep<strong>in</strong>g Records<br />
It is important for an employer <strong>to</strong> reta<strong>in</strong>:<br />
• the approval letter from State Tra<strong>in</strong><strong>in</strong>g Services conta<strong>in</strong><strong>in</strong>g the Tra<strong>in</strong><strong>in</strong>g Contract ID (TCID) number<br />
• their copy of the tra<strong>in</strong><strong>in</strong>g contract<br />
• records of time worked <strong>and</strong> wages paid <strong>to</strong> the apprentice/tra<strong>in</strong>ee<br />
• a copy of the <strong>in</strong>dustrial award or workplace agreement under which the apprentice/tra<strong>in</strong>ee is employed<br />
• their copy of the tra<strong>in</strong><strong>in</strong>g plan (as agreed with the RTO)<br />
• the apprentice’s or tra<strong>in</strong>ee’s attendance details from the RTO<br />
• results of formal tra<strong>in</strong><strong>in</strong>g undertaken by the apprentice/tra<strong>in</strong>ee with the RTO<br />
• a copy of the tra<strong>in</strong>ee apprentice’s Progress Card, if applicable<br />
Employers’ responsibilities (Section 6)<br />
Employers must:<br />
• provide apprentices <strong>and</strong> tra<strong>in</strong>ees with workers’ compensation <strong>in</strong>surance coverage<br />
• provide annual <strong>and</strong> other leave entitlements <strong>and</strong> superannuation for apprentices <strong>and</strong> tra<strong>in</strong>ees <strong>in</strong> accordance<br />
with relevant legislation or as specified by the relevant <strong>in</strong>dustrial award or workplace agreement<br />
• moni<strong>to</strong>r the progress of each apprentice or tra<strong>in</strong>ee at work <strong>and</strong> the tra<strong>in</strong><strong>in</strong>g he or she does with the RTO, <strong>and</strong><br />
• discharge his/her obligations as specified <strong>in</strong> the tra<strong>in</strong><strong>in</strong>g contract.<br />
Wages <strong>and</strong> awards (Section 5.5)<br />
Apprentices <strong>and</strong> tra<strong>in</strong>ees must be paid at least the m<strong>in</strong>imum or tra<strong>in</strong><strong>in</strong>g wage as set out <strong>in</strong> the State or Federal<br />
<strong>in</strong>dustrial award or workplace agreement under which they have been employed.<br />
Transfer (Section 9)<br />
An apprentice or tra<strong>in</strong>ee can be transferred <strong>to</strong> another employer provid<strong>in</strong>g that all parties are <strong>in</strong> agreement.<br />
Applications <strong>to</strong> transfer must be lodged with State Tra<strong>in</strong><strong>in</strong>g Services with<strong>in</strong> 14 days of the transfer. AACs assist<br />
employers <strong>in</strong> this process.<br />
Dismissal (Section 9)<br />
An apprentice (other than a tra<strong>in</strong>ee apprentice) or tra<strong>in</strong>ee cannot be<br />
dismissed once the contract is b<strong>in</strong>d<strong>in</strong>g (that is, after the tra<strong>in</strong><strong>in</strong>g contract<br />
has been approved by State Tra<strong>in</strong><strong>in</strong>g Services <strong>and</strong> the probationary period<br />
has elapsed). However a b<strong>in</strong>d<strong>in</strong>g tra<strong>in</strong><strong>in</strong>g contract can be cancelled by the<br />
mutual agreement of the parties (see below).<br />
Tra<strong>in</strong>ee <strong>apprenticeships</strong> can only be established where the relevant<br />
<strong>in</strong>dustrial award or agreement provides for them. A tra<strong>in</strong>ee apprenticeship<br />
may be term<strong>in</strong>ated by either the employer or the tra<strong>in</strong>ee apprentice giv<strong>in</strong>g<br />
notice <strong>in</strong> accordance with the provisions of the <strong>in</strong>dustrial award or agreement<br />
under which the tra<strong>in</strong>ee apprentice is employed.<br />
Mutual cancellation (Section 9.2)<br />
An employer <strong>and</strong> their apprentice or tra<strong>in</strong>ee can apply <strong>to</strong> cancel the tra<strong>in</strong><strong>in</strong>g contract at any time if both parties agree.<br />
They must then submit an application <strong>to</strong> cancel the tra<strong>in</strong><strong>in</strong>g contract <strong>to</strong> State Tra<strong>in</strong><strong>in</strong>g Services with<strong>in</strong> 14 days of the<br />
cancellation date. AACs can assist employers <strong>in</strong> this process.<br />
If either the employer or apprentice/tra<strong>in</strong>ee does not agree <strong>to</strong> the proposed cancellation, a Tra<strong>in</strong><strong>in</strong>g Advisor at your<br />
local State Tra<strong>in</strong><strong>in</strong>g Services regional office (ph 13 28 11) must be contacted immediately.<br />
Mutual suspension (Section 9.3)<br />
An employer <strong>and</strong> their apprentice or tra<strong>in</strong>ee can apply <strong>to</strong> mutually suspend the tra<strong>in</strong><strong>in</strong>g contract <strong>in</strong> certa<strong>in</strong><br />
circumstances, such as if there is a lack of work or if the apprentice/tra<strong>in</strong>ee has <strong>to</strong> take a long time off work through<br />
<strong>in</strong>jury or illness. Applications <strong>to</strong> suspend tra<strong>in</strong><strong>in</strong>g contracts must be lodged with the State Tra<strong>in</strong><strong>in</strong>g Services centre<br />
with<strong>in</strong> 14 days of the date of suspension. AACs can assist employers <strong>in</strong> this process.<br />
If either the employer or apprentice/tra<strong>in</strong>ee does not agree <strong>to</strong> the proposed suspension, a Tra<strong>in</strong><strong>in</strong>g Advisor from the<br />
local State Tra<strong>in</strong><strong>in</strong>g Services regional office (ph 13 28 11) must be contacted immediately.<br />
