9.3.3 Request for an amended qualification or vocation<br />

Apprenticeship <strong>and</strong> tra<strong>in</strong>eeship vocations <strong>in</strong> <strong>NSW</strong> are l<strong>in</strong>ked <strong>to</strong> a specific qualification through the Vocational Tra<strong>in</strong><strong>in</strong>g<br />

Order. Any request for an apprentice or tra<strong>in</strong>ee <strong>to</strong> undertake a qualification other than that specified <strong>in</strong> the vocational<br />

tra<strong>in</strong><strong>in</strong>g order should be made at the time the tra<strong>in</strong><strong>in</strong>g contract application is submitted <strong>to</strong> State Tra<strong>in</strong><strong>in</strong>g Services<br />

through the AAC.<br />

Requests for the vocation <strong>and</strong> qualification be<strong>in</strong>g undertaken by an apprentice or tra<strong>in</strong>ee <strong>to</strong> be varied mid-contract<br />

may be submitted through the AAC but will only be approved by State Tra<strong>in</strong><strong>in</strong>g Services if the proposed changes are<br />

considered appropriate. The apprentice or tra<strong>in</strong>ee will need <strong>to</strong> demonstrate that the on-the-job tra<strong>in</strong><strong>in</strong>g undertaken <strong>to</strong><br />

date is relevant <strong>to</strong> the amended vocation as well as a capacity <strong>to</strong> atta<strong>in</strong> competence <strong>in</strong> the new trade or tra<strong>in</strong>eeship<br />

vocation with<strong>in</strong> the rema<strong>in</strong><strong>in</strong>g term of the contract. The support of the nom<strong>in</strong>ated RTO is also required <strong>in</strong> these cases.<br />

9.3.4 Nom<strong>in</strong>ation of a new registered tra<strong>in</strong><strong>in</strong>g organisation<br />

Parties <strong>to</strong> a tra<strong>in</strong><strong>in</strong>g contract may request a change <strong>in</strong> RTO. The RTO be<strong>in</strong>g replaced should be advised by the parties<br />

that their services are no longer required. They should be asked <strong>to</strong> provide a Statement of Atta<strong>in</strong>ment list<strong>in</strong>g the<br />

competencies that the apprentice or tra<strong>in</strong>ee has achieved <strong>to</strong> date.<br />

9.3.5 Request for an amended type of tra<strong>in</strong><strong>in</strong>g delivery<br />

A request <strong>to</strong> the type of tra<strong>in</strong><strong>in</strong>g delivery must be supported by the relevant RTO. The request should be submitted <strong>to</strong><br />

State Tra<strong>in</strong><strong>in</strong>g Services <strong>and</strong> will only be approved if the proposed mode of tra<strong>in</strong><strong>in</strong>g delivery is considered suitable <strong>in</strong><br />

the circumstances.<br />

9.4 Cancellation<br />

An apprentice/tra<strong>in</strong>ee cannot be forced <strong>to</strong> cancel a tra<strong>in</strong><strong>in</strong>g contract with their employer. The<br />

Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001 stipulates that cancellations will not be approved if<br />

undue <strong>in</strong>fluence has been exerted on the apprentice/tra<strong>in</strong>ee by any party. Similarly, the apprentice/<br />

tra<strong>in</strong>ee cannot simply resign or leave their employment without the consent of their employer.<br />

Apprenticeships <strong>and</strong> <strong>tra<strong>in</strong>eeships</strong> can be cancelled by<br />

mutual agreement of the employer <strong>and</strong> the apprentice or<br />

tra<strong>in</strong>ee. A cancellation application form (VT16) is available<br />

for this purpose at http://tra<strong>in</strong><strong>in</strong>g.nsw.gov.au/. The form<br />

should be submitted <strong>to</strong> State Tra<strong>in</strong><strong>in</strong>g Services as soon<br />

as possible after the decision <strong>to</strong> cancel has been made<br />

<strong>and</strong> with<strong>in</strong> 14 days of the cancellation. Signed copies<br />

must also be kept by the parties.<br />

There is a seven-day ‘cool<strong>in</strong>g off’ period dur<strong>in</strong>g which<br />

either party may elect <strong>to</strong> change their m<strong>in</strong>ds <strong>and</strong><br />

withdraw their request <strong>to</strong> cancel the tra<strong>in</strong><strong>in</strong>g contract. The<br />

cool<strong>in</strong>g-off period commences on the day on which the<br />

application for cancellation is lodged with State Tra<strong>in</strong><strong>in</strong>g<br />

Services.<br />

If either party does not agree <strong>to</strong> the proposed<br />

cancellation, or if consent is withdrawn with<strong>in</strong> the cool<strong>in</strong>goff<br />

period, a tra<strong>in</strong><strong>in</strong>g advisor from the local State Tra<strong>in</strong><strong>in</strong>g<br />

Services centre (ph 13 28 11) should be contacted<br />

immediately. (See Section 8, Resolv<strong>in</strong>g Conflict.)<br />

Tra<strong>in</strong>ee <strong>apprenticeships</strong> (which are available under some awards) can be term<strong>in</strong>ated by either the employer or<br />

apprentice simply giv<strong>in</strong>g notice <strong>to</strong> the other party <strong>and</strong> <strong>to</strong> State Tra<strong>in</strong><strong>in</strong>g Services <strong>in</strong> accordance with the provisions of<br />

the <strong>in</strong>dustrial award or workplace agreement under which the apprentice is employed. Similarly, the employment of<br />

exist<strong>in</strong>g worker <strong>tra<strong>in</strong>eeships</strong> can be term<strong>in</strong>ated by either party <strong>in</strong> accordance with the provisions of the <strong>in</strong>dustrial award<br />

or agreement that applied prior <strong>to</strong> the commencement of the tra<strong>in</strong>eeship.<br />

If the employer or the apprentice / tra<strong>in</strong>ee wants <strong>to</strong> transfer, suspend, cancel or vary the tra<strong>in</strong><strong>in</strong>g<br />

contract <strong>and</strong> the other party does not agree, then either party must contact the local State Tra<strong>in</strong><strong>in</strong>g<br />

Services centre immediately – ph. 13 28 11.<br />
