6 Rights <strong>and</strong> responsibilities of employers<br />

6.1 Employers’ rights<br />

Employers should expect that their apprentice or tra<strong>in</strong>ee will:<br />

• make every effort <strong>to</strong> learn the skills required <strong>in</strong> their apprenticeship or tra<strong>in</strong>eeship<br />

• follow all lawful <strong>in</strong>structions of their employer or workplace supervisor<br />

• make every effort <strong>to</strong> abide by the policies <strong>and</strong> procedures that apply <strong>in</strong> the workplace <strong>and</strong> become a valuable<br />

employee with a commitment <strong>to</strong> the bus<strong>in</strong>ess for which they work.<br />

6.2 Employers’ responsibilities<br />

Employers of apprentices <strong>and</strong> tra<strong>in</strong>ees have obligations under each of the follow<strong>in</strong>g:<br />

• the Apprenticeship <strong>and</strong> Tra<strong>in</strong>eeship Act 2001<br />

• the <strong>in</strong>dustrial award or agreement under which their apprentice or tra<strong>in</strong>ee is employed<br />

• other legislation relat<strong>in</strong>g <strong>to</strong> conditions of employment<br />

These obligations are summarised below.<br />

An employer, <strong>in</strong>clud<strong>in</strong>g a group tra<strong>in</strong><strong>in</strong>g organisation, that places an apprentice or tra<strong>in</strong>ee with a host employer, must<br />

ensure that the host employer is also able <strong>to</strong> discharge these obligations.<br />

6.2.1 Tra<strong>in</strong><strong>in</strong>g obligations<br />

An employer of an apprentice or tra<strong>in</strong>ee must:<br />

• ensure that the apprentice or tra<strong>in</strong>ee receives the work-based tra<strong>in</strong><strong>in</strong>g by provid<strong>in</strong>g appropriate supervision <strong>and</strong><br />

all necessary facilities, resources <strong>and</strong> opportunities <strong>to</strong> acquire the skills of the vocation<br />

• ensure that the apprentice or tra<strong>in</strong>ee is given every opportunity <strong>to</strong> obta<strong>in</strong> the appropriate qualification for the<br />

vocation by releas<strong>in</strong>g him/her <strong>to</strong> attend tra<strong>in</strong><strong>in</strong>g delivered by the relevant registered tra<strong>in</strong><strong>in</strong>g organisation (RTO)<br />

<strong>and</strong> by liais<strong>in</strong>g with the RTO regard<strong>in</strong>g the apprentice or tra<strong>in</strong>ee’s progress <strong>in</strong> their formal tra<strong>in</strong><strong>in</strong>g<br />

Competency record books <strong>and</strong> work evidence <strong>guide</strong>s are available, <strong>in</strong> most vocations, <strong>to</strong> support the delivery of<br />

tra<strong>in</strong><strong>in</strong>g <strong>to</strong> apprentices <strong>and</strong> tra<strong>in</strong>ees. These booklets are provided by the RTO <strong>and</strong> should be used <strong>to</strong> moni<strong>to</strong>r the<br />

apprentice’s/tra<strong>in</strong>ee’s progress through his/her tra<strong>in</strong><strong>in</strong>g.<br />

6.2.2 Industrial relations obligations<br />

An employer must meet the m<strong>in</strong>imum requirements for pay, leave <strong>and</strong> other conditions of employment set out <strong>in</strong> the<br />

<strong>in</strong>dustrial award or agreement under which the apprentice or tra<strong>in</strong>ee is employed.<br />
