MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES & PENSIONSCHAPTER - 5RESERVATION FOR SCHEDULED CASTES, SCHEDULED TRIBES, OTHERBACKWARD CLASSES, EX-SERVICEMEN AND PHYSICALLY HANDICAPPEDPERSONS IN THE CENTRAL GOVERNMENT SERVICESRESERVATION FOR SCHEDULED CASTES, SCHEDULED TRIBES AND OBCs5.1 Clause (4) of Article 16 of the Constitution of India enables the State to make provisionsfor reservation of appointments or posts in favour of any backward class of citizens which, inthe opinion of the State, is not adequately represented in the services under the State. Clause(4A) of the same Article enables the State to provide reservation for the members of theScheduled Castes and Scheduled Tribes in the matter of promotion. Article 335 declares thatthe claims of the members of the Scheduled Castes and the Scheduled Tribes shall be takeninto consideration, consistent with the maintenance of efficiency of administration in the makingof appointments to services and posts in connection with the affairs of the Union or of a State.Proviso to the said Article empowers the State to make any provision in favour of the membersof the Scheduled Castes and Scheduled Tribes for relaxation in qualifying marks in anyexamination or lowering the standards of evaluation, for reservation in matters of promotion toany class or classes of services or posts in connection with the affairs of the Union or of aState. Armed with powers given by these provisions of the Constitution, Government hasissued various instructions providing for reservation in services for the members of theScheduled Castes (SCs), the Scheduled Tribes (STs) and the Other Backward Classes (OBCs).5.2 Reservation for SCs, STs and OBCs is available in all groups of posts in case of directrecruitment. While in case of direct recruitment on all India basis by open competition,reservation for SCs, STs and OBCs is 15%, 7.5% and 27%, respectively in case of directrecruitment on all India basis otherwise than by open competition it is 16.66%, 7.5% and25.84% respectively. In case of direct recruitment to Groups C and D posts, normally attractingcandidates from a locality or a region, percentage of reservation for SCs/STs is generally fixedin proportion to the population of SCs and STs in the respective States/UTs and reservation forOBCs in such cases has been so fixed that it is not more than 27%, and total reservation doesnot exceed the limit of 50%. Reservation in promotion by non-selection method is available toSCs and STs in all groups of services viz. A, B, C and D at the rate of 15% and 7.5% respectively.In case of promotion by selection method, reservation to SCs/STs is available upto the lowestrung of Group ‘A’ at the same rates. There is no reservation for OBCs in case of promotions.In promotion by selection to posts within Group ‘A’ which carry an ultimate salary of Rs.18300or less, there is no reservation, but the instructions provide that the Scheduled Caste/Scheduled24DOPT AR 2006 PG-1-176N-FINAL.pmd247/15/2006, 11:53 AM

SERVICES 5Tribe officers, who are senior enough in the zone of consideration for promotion so as to bewithin the number of vacancies for which the select list is to be drawn up, would be included inthat list provided they are not considered unfit for promotion.5.3 Representation of SCs, STs and OBCs in the Central Government Services ason 1 January, 2004 is given in the statement at Appendix-I. In the All India Services andother Central services to which recruitment is made through the Civil Services Examination,almost all the vacancies reserved for SCs/STs/OBCs have been filled by the candidates ofrespective categories in the recent years. Vacancies reserved and filled in IndianAdministrative Service, Indian Foreign Service and Indian Police Service in the year ofExamination 2004 are given in Appendix-II. Reservation for OBCs was started only in 1993.It is expected that as a result of introduction of reservation for them, their representation inservices would increase in due course of time.RELAXATIONS AND CONCESSIONS5.4 Various concessions like relaxation in the upper age limit, unlimited number of chanceswithin the relaxed age limit prescribed for appearing in the competitive examinations, exemptionfrom payment of examination fees, relaxation in standards of suitability, non-adjustment ofcandidates selected on their own merit against reserved vacancies, provisions of carry forward,of reservation, etc. continue to be prescribed to improve the representation of SCs and STs inthe services/posts. Likewise, concessions like relaxations in the upper age limit upto threeyears, relaxation in number of chances upto seven within the relaxed age limit for appearing inthe Civil Services examination etc. are available to Other Backward Classes. To ensure thatposts reserved for SCs, STs and OBCs are filled by candidates belonging to these categoriesof persons only, there is a ban on dereservation of posts in case of direct recruitment.5.5 The National Common Minimum Programme provides that all reservation quota ofScheduled Castes and Scheduled Tribes, including in promotions, will be filled in a timebound manner and a Reservation Act will be enacted. Accordingly, the Government haslaunched a Special Recruitment Drive to fill up the backlog reserved vacancies of SCs andSTs in direct recruitment as well as promotion within a fixed time frame. With a view to codifythe provisions of reservation for SCs, STs and OBCs, the Government has introduced a Billin the Rajya Sabha, namely, the Scheduled Castes, Scheduled Tribes and Other BackwardClasses (Reservation in Posts and Services) Bill, 2004.REPORT 2005 - 2006AL REPORANNUALRESERVATION FOR EX-SERVICEMEN5.6 Reservation for ex-servicemen was initially introduced for a period of two years in1966.
