PART VI - AIRWORTHINESS49. Type Certificate for an aircraft, component and item <strong>of</strong> equipment, designed ormanufactured in India and issue <strong>of</strong> Type Certificate- (1) The Director-General may direct bygeneral or special order that there shall be a Type Certificate in respect <strong>of</strong> any aircraft, aircraftcomponent or item <strong>of</strong> equipment designed, manufactured, sold or distributed in India, as aprerequisite to the issue, renewal or continued validity <strong>of</strong> a certificate <strong>of</strong> airworthiness, in respect <strong>of</strong> anaircraft in which an aircraft component or item <strong>of</strong> equipment <strong>of</strong> that type has been fitted or installed :Provided that nothing contained in this sub-rule shall apply in case <strong>of</strong> Microlight Aircraft.(2) A person may apply to the Director-General for issue <strong>of</strong> a Type Certificate in respect <strong>of</strong>any aircraft, aircraft component or item <strong>of</strong> equipment.(3) The Director-General may issue a Type Certificate when(a) an applicant furnishes such documents or other evidence relating to the suitability <strong>of</strong> theaircraft, aircraft component or item <strong>of</strong> equipment for aviation purposes, as may be specified, inclusive<strong>of</strong> a flight test, if necessary, as the Director-General may require. The applicant shall provide allnecessary facilities for such inspection and tests as may be stipulated ; and(b) the Director-General is satisfied as to its suitability for aviation purposes.[Amended by -GSR No. 1202 dated 23-7-1976, andGSR No. 218 dated 13-3-1991.]49A. Issue <strong>of</strong> Type Certificate to an aircraft, aircraft component and items <strong>of</strong> equipmentimported in India- (1) The Director-General may direct by general or special order that there shall bea type certificate in respect <strong>of</strong> any aircraft, aircraft component or item or equipment imported in India.(2) The Director-General may issue a Type Certificate in respect <strong>of</strong> any aircraft, aircraft component oritem <strong>of</strong> equipment imported in India.[Inserted by GSR No. 1202 dated 23-7-1976]49B. Validation <strong>of</strong> Type Certificate for aircraft, aircraft components and items <strong>of</strong> equipmentimported in India - (1) The Director-General may validate a Type Certificate in respect <strong>of</strong> anyaircraft, aircraft component and item <strong>of</strong> equipment, that may be imported :Provided that(a) the airworthiness authority <strong>of</strong> the country in which it is manufactured has issued aCertificate <strong>of</strong> Airworthiness, Type Certificate or a similar document in respect <strong>of</strong> that aircraft, aircraftcomponent, or item <strong>of</strong> equipment, as the case may be ;(b) it meets with the airworthiness requirements which may be laid down by the Director-General; and(c) the applicant furnishes such documents and technical data regarding the suitability <strong>of</strong> theproduct for aviation purposes as may be specified and as the Director-General may require :Provided further that the Director-General may, by order in writing and subject to such conditions asmay be stated in that order, exempt any aircraft, aircraft component or item <strong>of</strong> equipment from theprovisions <strong>of</strong> this rule.
