PART VII - RADIO TELEGRAPH APPARATUS63. Aircraft for which radio apparatus is obligatory- (1) All aircraft registered in India andrequired to be operated in accordance with VFR/IFR condition shall be provided withcommunication equipment which is capable <strong>of</strong> conducting two-way communication at all timeswith those aeronautical stations and on those frequencies as prescribed by the appropriateauthority. The communication equipment so provided shall be <strong>of</strong> a type approved by theairworthiness authority <strong>of</strong> the country <strong>of</strong> manufacture <strong>of</strong> aircraft and acceptable to the DirectorGeneral.2. An aircraft shall be provided with navigation equipment which will enable it to proceed :(a) in accordance with the flight plan; and(b) in accordance with the requirement <strong>of</strong> air traffic services, except when, if not so precluded bythe appropriate authority, navigation for flights under the visual flight rules is accomplished byvisual reference to landmarks at least every 110 kms (60 Nautical Miles).Note :- For the purpose <strong>of</strong> this rule, foreign registered aircraft falling under sub-rule (3) <strong>of</strong> rule 1shall be deemed as aircraft registered in India and Indian registered aircraft falling under sub-rule(4) <strong>of</strong> rule 1 shall be deemed as aircraft not registered in India.[Amended byGSR No. 20(E) dated 12-1-1994 andGSR No.323(E) dated 21-3-1994]64. Suspension <strong>of</strong> rules- The application <strong>of</strong> the rules in this Part may be suspended when owingto the lack <strong>of</strong> radio -telegraph organizations available for air traffic in a particular region theemployment <strong>of</strong> radio-telegraph apparatus on board aircraft would serve no useful purpose.
