tariff shall be applicable alike to all aircraft whether registered in India or in anyother contracting State.(2) In the case <strong>of</strong> aerodromes belonging to the Authority, the charges mentionedin sub-rule (1) shall be levied by the Authority in accordance with section 22 <strong>of</strong>the Airports Authority <strong>of</strong> India Act, 1994. (55 <strong>of</strong> 1994).(3) In the case <strong>of</strong> licensed public aerodromes, other than the aerodromesbelonging to the Authority, the charges mentioned in sub-rule (1) shall bedetermined by the licensee in accordance with the principle <strong>of</strong> cost recovery asspecified by the International <strong>Civil</strong> <strong>Aviation</strong> Organisation and such charges shallbe notified with the approval <strong>of</strong> the Central Government or any authorityconstituted in this behalf by such Government.(4) Not withstanding anything contained in sub-rules (2) and (3), in the case <strong>of</strong> amajor airport, the tariff <strong>of</strong> charges referred to in sub-rule (1) shall be such as maybe determined under clause 9A) <strong>of</strong> sub-section (1) <strong>of</strong> section 13 <strong>of</strong> the AirportsEconomic Regulatory Authority <strong>of</strong> India Act, 2008.Explanation. – For the purpose <strong>of</strong> this rule, “Authority” means the AirportsAuthority <strong>of</strong> India constituted under section 3 <strong>of</strong> the Airports Authority <strong>of</strong> IndiaAct, 1994. Fee. – (1) The fee chargeable for the grant <strong>of</strong> a licence for an aerodromeshall be –(a) When the licence is granted Rs.1,00,000/-for private use(b) When the licence is granted Rs.5,00,000/-for public userunway length <strong>of</strong>upto 5,000 feetplus Rs.2,00,000/-for every 1,000feet or part there<strong>of</strong>.(2) The fee chargeable for renewal <strong>of</strong> license <strong>of</strong> an aerodrome shall be fifty percent <strong>of</strong> the fee for licence referred to in sub-rule (1).
