Claims for corrections of an invoice to a customer must bemade within two (2) months of the invoice date.Claims for transport damage must be presented separatelyfor individual processing (cannot be set off againstunsettled freight invoices).When there is more than one consignor, the freight payershall be named in a separate agreement.DB Schenker can return a consignment reference onthe transport invoice and present in Tracking assumingthat a reference has been sent correctly in the transportinstructions via EDI by the Transport customer*.* Exception, Parcel International and text length limitationper DB Schenker product.3.3 Faults related to consignmentsConsignments received for transport and which areincomplete, i.e. where the remaining item(s) are to bepresented later, are regarded as new consignments and anew freight charge will be debited.If the transport instructions/waybill lack weight/volumedetails, or if they contain incorrect weight/volume details,DB Schenker reserves the right to check and measure theweight. The new weight/volume information is added tothe transport instructions/waybill to calculate the freight.4. Supplementary conditions for domestictransport in Sweden4.1 DB Schenker’s extended liabilityFor domestic transportation (original consignor and finalconsignee in Sweden) DB Schenker assumes extendedliability over and above the provisions in the GeneralConditions as follows:§ 21 General Conditions in NSAB 2000The client is entitled to compensation if the goods arelost if hand-over could have taken place within 30 daysof the goods being received for transport. Exceptionsare temperature-controlled goods where the shelf life isshorter than 30 days.§ 22 General Conditions in NSAB 2000For DB SCHENKERparcel liability is limited to SEK 50,000per damaged or lost delivery (irrespective of weight).‘Delivery’ refers to transportation of one or more itemsfrom the same consignor to the same consignee on thesame occasion.Compensation for services involving delivery via anagent is limited to SEK 5,000 per package.For domestic goods, liability is limited to SEK 150per gross kilo in accordance with the terms laid outin legislation concerning Swedish domestic roadtransportation.§ 23 General Conditions in NSAB 2000In the event of forwarding by another mode of transportonce the goods have been loaded onto a truck or otherload carrier, limitations of liability according to theGeneral Conditions do not apply (according to NSAB 2000)to damage, shrinkage or loss that could only have arisenduring and as a result of such forwarding.Amending § 16 section g, NSAB, DB Schenker’s liabilityalso covers damage to goods resulting from a trafficaccident, fire or theft.The supplementary conditions above do not apply todomestic transport that is part of cross-border transport.For such transport, the CMR convention is primarilyapplicable.Insured goods. When damage, shrinkage or loss can becompensated through separate goods insurance taken outby the customer, DB Schenker is liable to the entitled partyin accordance with NSAB 2000.4.2 Other supplementary conditionsRight of disposal. The consignor has right of disposal overthe goods until the goods are delivered to the consignee orplaced at the consignee’s disposal at the stated location.From this time onwards the consignee has right ofdisposal.Obstacles preventing delivery of the goodsIf delivery of the goods is hindered and the consignor doesnot supply adequate instructions concerning what to dowith the goods, DB Schenker is entitled to sell the goods:a) immediately, in the case of goods at risk of spoiling orrapid ruin or that require excessively expensive care, orb) in the case of other goods, after 60 days of the goodsbeing received for forwarding.DB Schenker shall, as far as possible, inform the consignorin advance that the goods are to be sold. After deductionof DB Schenker’s claims based on the transport assignmentand other claims that may be applicable to the goods aswell as costs for storage and sale of the goods, the salesum shall be remitted to the consignor without delay,provided this person’s address is known to DB Schenker.If the consignor’s address is not known, and the funds dueare not claimed within one year of the date of sale, thesaid funds become the property of DB Schenker.5. Claims5.1 Damaged goodsLiabilityDB Schenker’s responsibility as a carrier comes into effectwhen, through authorised personnel, DB Schenker takescontrol of the consignment, and responsibility stops whenthe consignment is handed over to the consignee at thedestination or when it is placed at the consignee’s disposalaccordingt to 1.3.If an agreement has been reached that the consignor,without DB Schenker’s involvement, puts together full loadunits for transport by DB Schenker and, in conjunctiontherewith, DB Schenker is prevented, when collecting theunit, from performing the customary collection check ofthe individual items in the load unit, DB Schenker is onlyresponsible for damage to or loss of individual items oncondition that it is shown that the damage or loss occurredduring DB Schenker’s period of liability and for reasons forwhich DB Schenker is responsible.In the event of subsequent transport with differentcarriers, DB Schenker is not responsible if it is likely thatdamage has not occurred during the period DB Schenkerwas responsible for the consignment.8
