4.10 Confidential information acquired by a judge in thejudge's judicial capacity shall not be used or disclosed bythe judge for any other purpose not related to the judge'sjudicial duties.CommentaryConfidential information not to be used for personal gain or communicated toothers154. In the course of performing judicial duties, a judge may acquireinformation of commercial or other value that is unavailable to the public. Thejudge must not reveal or use such information for personal gain or for any purposeunrelated to judicial duties.Essence of this prohibition155. This prohibition is principally concerned with the improper use ofundisclosed evidence such as, for example, evidence subject to a confidentialityorder in a large- scale commercial litigation.104
