Section 103(e) (4) toestablish a program designed to helpprevent accidents and injuries resultingfrom the misuse of drugs and alcohol byemployees who perform safety-sensitivefunctions. FTA’s regulation, 49 CFR Part653, ‘‘Prevention of Prohibited Drug Usein Transit Operations,’’ effective March17, 1994, requires recipients to submitto FTA annual reports containing datawhich summarize informationconcerning the recipients’ drug testingprogram, such as the number and typeof tests given, number of positive testresults, and the kinds of safety-sensitivefunctions the employees perform. FTAuses these data to ensure compliancewith the rule, to assess the misuse ofdrugs in the transit industry, and to setthe random testing rate.
