guaranteed students in the Student H<strong>and</strong>book. The proceedings of the AppealsCourt may be audio taped <strong>and</strong> filed in the Student Development office.3. APPEALS PROCEDURE Appeals are submitted in writing to the Vice Presidentfor Student Development who contacts the members of the Appeals Court. Oneeach of students, administrators <strong>and</strong> faculty will serve on the Appeals Court. TheVice President for Student Development will determine if the Appeals Court willbe convened.4. HEARING PROCEDURE The Appeals Court is closed to the student body <strong>and</strong> thepublic. The student appealing must attend. The Vice President for StudentDevelopment summarizes the charges against the student, specifies the<strong>University</strong> policy violated, <strong>and</strong> states the penalty imposed on the student. Then,the student is invited to present a case that appeals either the judgment or to thepenalty. If the student wishes to present witnesses, signed statements must bepresented to the Vice President for Student Development no less than two daysbefore the hearing. No witnesses will be heard by the Appeals Court unless thiscondition is met. Testimony by witnesses for the student must be relevant to thecase. The Appeals Court has the right to question the Vice President for StudentDevelopment, the student <strong>and</strong> witnesses.After the appeal has been presented, the court will deliberate <strong>and</strong> make adecision based on the new testimony presented. A majority of members presentwill determine the decision of the Appeals Court. Decisions of the Appeals Courtare final. The court may make the following decisions:a. Uphold the judgment <strong>and</strong> penaltyb. Reverse the judgmentc. Modify the penalty5. APPEALS BY ORGANIZATIONS Official campus organizations have the sameright of appeal as do individual students, subject to the following conditions: BCU campus organizations include all clubs recognized by the StudentDevelopment Office. If certification of a group is disputed, the VicePresident for Student Development has final authority. Only the advisor or the president of an organization may file an appeal onbehalf of the organization. During the hearing, the organization may have its advisor present.OFFICIAL SUMMONSStudents neglecting to answer a summons from residence hall staff, campus security, VicePresident for Student Development within three days of the summons will receive a secondsummons <strong>and</strong> may be found in violation of the failure to comply with the policy. If studentsdo not answer the second summons, a decision regarding alleged violation <strong>and</strong> sanctionswill be made without the student’s presence. Failure to complete sanctions may result inadditional sanctions, including a fine.JURISDICTIONStudents are responsible for their own personal safety while engaged in off-campusactivities. Students are urged to report any criminal activity that occurs to the local police<strong>and</strong> to the Vice President for Student Development. Any student engaged in crime oractivity contrary to regulations <strong>and</strong> policies outlined in the Student H<strong>and</strong>book off-campusmay be subject to <strong>University</strong> judicial processes <strong>and</strong> sanctions.45
