APPENDIX 2Western AustralianFISHERIES ACT 1905MARMION MARINE PARK OCEAN REEF AND HILLARYS BOAT HARBOURSFISHING RESTRICTIONSNotice No. 376516/85MADE by the Minister pursuant to sections 9, 10 and I I <strong>of</strong> the Act.Citations1. This Notice may be cited as the <strong>Marmion</strong> <strong>Marine</strong> <strong>Park</strong> Ocean Reef and Hillarys Boat Harbour FishingRestrictions Notice 1989.Prohibition on taking fish2. All persons are prohibited from taking any fish whatsoever in the waters described in the Schedule except ashereinafter provided.Licensed pr<strong>of</strong>essional fishermen3. The holder <strong>of</strong> a pr<strong>of</strong>essional fisherman's licence shall not take any species <strong>of</strong> fish for sale in the waterdescribed in the Schedule except that -(i) rock lobster may be taken by means <strong>of</strong> rock lobster pots used from a boat authorised to operate in theWest Coast Rock Lobster Limited Entry Fishery.(ii) Roe's abalone may be taken by a person authorised to take abalone within Zone 3 <strong>of</strong> the AbaloneLimited Entry Fishery; and(iii) other fish may be taken with the use <strong>of</strong> a hauling net by a person authorised in writing by the Directorin the waters <strong>of</strong> the <strong>Marmion</strong> <strong>Marine</strong> <strong>Park</strong> provided such net is not used within the Ocean Reef andHillarys Boat Harbours and within 200 metres seaward <strong>of</strong> the groynes and entrances <strong>of</strong> those harbours.Use <strong>of</strong> nets to take crabs4. Any person may use a hand held scoop net or drop net to take crabs.Use <strong>of</strong> spearguns etc5. Any person may use a speargun, harpoon, hawaiian sling and all other similar pointed instruments to take -(i) any species <strong>of</strong> fish <strong>of</strong> the classes Osteichthyes (boney fishes) and Chondrichthyes (cartilaginousfishes); and(ii) any species <strong>of</strong> fish <strong>of</strong> the class Cephalopoda commonly known as cuttlefish, squid and octopus;provided that a speargun, harpoon, hawaiian sling and all other similar pointed instruments are notused to take any fish whatsoever in any waters within 1800 metres <strong>of</strong> the high water mark <strong>of</strong> the westcoast <strong>of</strong> Australia.Use <strong>of</strong> other means <strong>of</strong> capture6. Any person -(1) being the holder <strong>of</strong> a recreational fishing licence authorising the taking <strong>of</strong> rock lobster, may take thespecies <strong>of</strong> fish <strong>of</strong> the class Crustacea known as Panulirus cygnus (western rock lobster)(a) by hand; or(b) by means <strong>of</strong> rock lobster pots;(2) may take the species <strong>of</strong> fish <strong>of</strong> the class Crustacea. known as Haliotis roei (Roe's abalone), providedthat the taking is permitted in accordance with Fisheries Notice No. 375 (Metropolitan RecreationalAbalone Fishery);68
