that said staffing is unacceptable or that any individual is not per<strong>for</strong>ming in a manner<br />

consistent with <strong>the</strong> requirements <strong>for</strong> such a position.<br />

The Design-Build Firm represents that its staff personnel have <strong>the</strong> proper skills, training,<br />

background, knowledge, experience, rights, authorizations, integrity, character and<br />

licenses as necessary to per<strong>for</strong>m <strong>the</strong> Work, in a competent and pr<strong>of</strong>essional manner.<br />

The Design-Build Firm shall per<strong>for</strong>m <strong>the</strong> work complete, in place, and ready <strong>for</strong><br />

continuous service, and shall include repairs, testing, permits, clean-up, replacements,<br />

and restoration required as a result <strong>of</strong> damages caused during this construction.<br />

The Design-Build Firm shall provide temporary facilities and controls necessary to<br />

per<strong>for</strong>m <strong>the</strong> Work and to ensure safe and proper access and use <strong>of</strong> <strong>the</strong> site by <strong>the</strong><br />

Project Manager and <strong>the</strong> Consultant.<br />

The Design-Build Firm shall at all times cooperate with <strong>the</strong> <strong>City</strong>, or <strong>the</strong> Consultant and<br />

coordinate its respective Work ef<strong>for</strong>ts to most effectively and efficiently progress <strong>the</strong><br />

per<strong>for</strong>mance <strong>of</strong> <strong>the</strong> Work.<br />

The <strong>City</strong>, <strong>the</strong> Consultant and o<strong>the</strong>r agencies authorized by <strong>the</strong> <strong>City</strong>, shall have full<br />

access to <strong>the</strong> Project(s) site(s) at all times.<br />

The Design-Build Firm shall be responsible <strong>for</strong> <strong>the</strong> good condition <strong>of</strong> <strong>the</strong> Work or<br />

materials until <strong>for</strong>mal release from his obligations under <strong>the</strong> terms <strong>of</strong> <strong>the</strong> Contract<br />

Documents.<br />

Design-Build Firm shall bear all losses resulting to it on account <strong>of</strong> <strong>the</strong> amount or<br />

character <strong>of</strong> <strong>the</strong> Work, or <strong>the</strong> character <strong>of</strong> <strong>the</strong> ground, being different from what he<br />

anticipated.<br />

All newly constructed work shall be carefully protected from injury in any way. No<br />

wheeling or walking or placing <strong>of</strong> heavy loads on it shall be allowed and <strong>the</strong> Design-Build<br />

Firm at its own expense shall reconstruct all portions damaged.<br />

The Design-Build Firm shall at all times conduct <strong>the</strong> Work in such manner and in such<br />

sequence as will ensure <strong>the</strong> least practicable local interference. Design-Build Firm shall<br />

not open up Work to <strong>the</strong> prejudice <strong>of</strong> Work already started, and <strong>the</strong> Project Manager<br />

may require <strong>the</strong> Design-Build Firm to finish a section on which Work is in progress<br />

be<strong>for</strong>e Work is started on any additional section.<br />

11. Method <strong>of</strong> Per<strong>for</strong>ming <strong>the</strong> Work<br />

When measurements are affected by conditions already established or where items are<br />

to be fitted into constructed conditions, it shall be <strong>the</strong> Design-Build Firm's responsibility<br />

to verify all such dimensions at <strong>the</strong> site and <strong>the</strong> actual job dimensions shall take<br />

precedence.<br />

The apparent silence <strong>of</strong> <strong>the</strong> Contract documents as to any detail, or <strong>the</strong> apparent<br />

omission from <strong>the</strong>m <strong>of</strong> a detailed description concerning any Work to be done and<br />

materials to be furnished, shall be regarded as meaning that only <strong>the</strong> best general<br />

practice is to prevail and that only material and workmanship <strong>of</strong> <strong>the</strong> best quality is to be<br />

used, and interpretation <strong>of</strong> <strong>the</strong> Contract Documents shall be made upon that basis.<br />

If <strong>the</strong> Project Manager or Consultant reasonably determines <strong>the</strong> rate <strong>of</strong> progress <strong>of</strong> <strong>the</strong><br />

Work is not such as to ensure its completion within <strong>the</strong> <strong>design</strong>ated completion time, or if,<br />

in <strong>the</strong> opinion <strong>of</strong> <strong>the</strong> Project Manager <strong>the</strong> Design-Build Firm is not proceeding with <strong>the</strong><br />

Work diligently or expeditiously or is not per<strong>for</strong>ming all or any part <strong>of</strong> <strong>the</strong> Work according<br />

to <strong>the</strong> Project schedule accepted by or determined by <strong>the</strong> Project, <strong>the</strong> Project Manager<br />

shall have <strong>the</strong> right to order <strong>the</strong> Design-Build Firm to do ei<strong>the</strong>r or both <strong>of</strong> <strong>the</strong> following:<br />
